PURPOSE OF MEETING: Record Commission meeting.
OPENING: The Muskingum Township Records Commission met on January 2, 2014 following the re-organizational meeting in the Fire Building. Chairman Mike Maniaci and Fiscal Officer Jason T. Baughman were present.
Fiscal Officer noted he had no records at the present time to get rid of. Maniaci made a motion that at this time the commission has nothing to discuss as far as records to get rid of. Fiscal Officer Baughman seconded motion, all ayed.
All other records will be left as they are for now.
Maniaci moved to adjourn. Seconded by Baughman. All ayed.

Muskingum Twp. 2014 Re-Organizational Meeting

PURPOSE OF MEETING: 2014 Re-Organizational Meeting
OPENING: Muskingum Township Trustees met in special session at 7 p.m. on January 2, 2014 for the re-organizational meeting in the Fire Building. All Trustees and Fiscal Officer were present. There were 2 residents present.
Hittle nominated Mike Maniaci for President, Fell seconded. All ayed.
Maniaci made the motion to have Matt Hittle and Ed Fell on the Burial Committee. Hittle seconded. Fell ayed.
Maniaci made the motion to keep the emergency labor at $8.00 per hour unless they have a CDL and then they would be paid $10.00 per hour. Hittle seconded. Fell ayed.
Maniaci made motion to keep public records policy the same for this year, public records will be provided in a timely manner/or the next regularly scheduled meeting. That there will be an optional written request advising what records is requested. The charge will be $.05 per page and $2.50 for cassette tape copies or going rate of a flash drive if preferred method. Fell seconded. Hittle ayed.
Mrs. Cohagen asked if this had changed from $.05 per page in excess of x amount of copies. Maniaci stated the policy is the same as it was before and we had changed to this in 2012.
Maniaci made a motion to continue and accept our current credit card policy. All three trustees and fiscal officer will have access to the Capital one Visa Card, Tractor Supply and Lowes cards. Township Maintenance workers will have access to all credit cards. The limits for all cards will be $150 per transaction. If purchase is over that amount, permission must be obtained by township trustees. Hittle seconded. Fell ayed.
Maniaci made the motion that the Township equipment can be operated by all road crew and trustees or any other person who has been authorized by the trustees or road crew to do so. Hittle seconded. Fell ayed.
Maniaci read and motioned the adoption of the Annual Temporary Appropriations Resolution for fiscal year December 31, 2014 (per O.R.C. 5705.38) until the Amended Official Certificate of Estimated Resources is adopted and received from the Office of Budget Commission, Muskingum County, Ohio. Hittle seconded. Fell ayed.
Maniaci stated the inventory is completed and be submitted to the County Engineer by second week per O.R.C. 505.04. Mrs. Cohagen asked if same inventory presented as prior year. Maniaci presented type written listing.
The Records Commission, according to O.R.C. 149.42 will consist of a Chairman of the Board; this being Mike Maniaci and the Fiscal Officer, Jason Baughman will be the Records Commission. Maniaci made the motion, seconded by Hittle. Fell ayed.
Maniaci made the motion that employees/elected officials who are authorized to use their private vehicles for township business such as conferences, training, etc. will be reimbursed at the standard mileage reimbursement rate established by the I.R.S. of 56 cents per mile which is allowable under the O.R.C. Hittle seconded. Fell ayed.
Maniaci moved to keep the regular monthly township meetings the first Thursday of every month at the township fire station at 7:00 p.m. That is will be posted in the newspaper once, on the website and posted monthly on the sign in the front of the township. Any changes or special meetings will be posted on the website, the sign out in the front of the township hall and newspaper at least 24 hours before the meeting. Hittle seconded. Fell ayed.
In regards to “Storage and distribution of personnel files and personal information”, Maniaci appointed the fiscal officer to have control of all files. Fell seconded. Hittle ayed. All personnel files will be in a locked filing cabinet at the township building. Fiscal Officer was informed that he/she is responsible for all the rules adopted in accordance with this section and shall maintain a written request log and show trustees requests made; they can sign off on the request which will show they are monitoring the accuracy of the requests. If there is a question of what can or cannot be released, fiscal officer is to contact legal counsel, Bud Chess. If above rules are not followed a written reprimand could be issued from the prosecutor’s office and could lead to termination depending on the situation. Maniaci made the motion to accept this procedure. Hittle seconded. Fell ayed.
Mrs. Cohagen asked about ORC 109.43(e) public records training. Maniaci stated it also indicates fiscal officer or a designee in place to take the training for them. Jerry Newell would have been, and in minutes, as designee during Maniaci and Fusners terms. Baughman came in with Hittle and designated to satisfy the training during his term. Public Records training is required once every 4 year term.

BOARD OF MUSKINGUM TOWNSHIP TRUSTEES
January 28, 2014
PURPOSE OF MEETING: Special Meeting.
OPENING: The Muskingum Township Trustees met in special session on January 28, 2014 at 7:00 p.m. in the Fire Building for the specific purpose to adopt A RESOLUTION DETERMINING TO PROCEED WITH THE SUBMISSION TO THE ELECTORS OF THE QUESTION OF LEVYING A TAX IN EXCESS OF THE TEN-MILL LIMITATION RC 5705.19, RC 5705.191, RC 5705.25, RC 5705.26.
All trustees and fiscal officer were present.
There was 1 residents in attendance.
Maniaci called to order the special meeting and read the above mentioned resolution. The Board of Township Trustees of Muskingum Township, Muskingum County, Ohio met in Special session on January 28, 2014, at the office of the township, with the following members present: Michael G. Maniaci, Matt Hittle, and Kurt E. Fell.
Mr. Maniaci moved the adoption of the resolution to proceed with the submission to the electors of the question of levying a tax in excess of the ten-mill limitation, RC 5705.19, RC 5705.191, RC 5705.25, RC 5705.26; and WHEREAS, the County Auditor has certified to this Board that the total current tax valuation of Muskingum Township is $84,704,860 and the dollar amount of revenue that will be produced annually by the millage stated below would be $211,763.00.
Mr. Hittle seconded the resolution and the roll being called upon its adoption, the vote resulted as follows:

Adopted the 28th day of January, 2014.

Maniaci asked Mr. Fell if he would like comment in regards to the Levy. Fell indicated that although we do need the money generated from an additional fire levy, however at this time he would like to obtain some more detailed information regarding the levy and more specific details from Falls Fire Department before he supports this levy.

PURPOSE OF MEETING: Regular Meeting.
OPENING: The Muskingum Township Trustees met in regular session on February 6, 2014 at 7:00 p.m. in the Fire Building. All trustees and fiscal officer were present. There were 2 residents present.
The December 30th, 2013 Regular Annual Year-End Meeting minutes were read approved.
The January 2nd, 2014 Re-Organizational Meeting minutes were read and approved.
The January 2nd, 2014 Records Commission Meeting minutes were read and approved.
The January 28th, 2014 Special Meeting Minutes were read and approved.
Checks were approved and signed for payment.
Fiscal Officer stated that he received a call from Jeff Hardwick of Bryan & Snider Funeral Home and presented trustees with the follow-up letter, township duties with regards to indigent residents per O.R.C 5101.52, and an invoice from Mr. Hardwick for services rendered for a Mr. James H. Bayes, Jr., an indigent resident in our township, of 3175 Jacks Fairway Vista View, Zanesville, Ohio. Maniaci motioned to pay the $478 invoice for services rendered by Mr. Hardwick, upon verification of residency for the indigent resident Mr. Bayes, Jr. Hittle seconded, Fell ayed.

Fiscal Officer stated that the 2.5 mil Fire Levy was timely filed with the board of elections.

Maniaci provided an update on the salt supply. Charlie stated we have about 2-3 snows worth of salt after mixing. Maniaci stated he called around in Ohio and Indiana and there is just no salt supply available unless we want to spend $250 per ton to bring up from North Carolina. The county engineer indicated in our conference call last week that we are looking at 2-3 weeks before salt is available. The ODOT indicated that when salt becomes available, they would provide around 150,000 tons among various locations for distribution.
Maniaci stated that there has been some complaints regarding damage to our roads with all the snow and plowing.
Maniaci stated more snow equals more complaints and damage.
Maniaci indicated that we have a lot of mailboxes needing replacement due to all the snow and plowing of snow that clipped the mailboxes. There were also issues with snow blocking driveways. Unfortunately we do our best to clear the roads of snow somewhere and apologize for the inconvenience. Hittle stated you also have to consider the amount of snow we have got this year and we have to plow it somewhere clear of the roadways.
Hittle stated he has a list from the messages of mailboxes that need replaced. Maniaci stated we will fix or replace the mailboxes as soon as the weather breaks.
Maniaci wanted to address bidding of mowing township and cemeteries for this year. Last year we used Jerry Miller, Twin Hills Landscaping, and Jerry has indicated that he would hold the prices the same as last year if we wish to use him again. Maniaci stated that we are not required to bid this out if we don't want to and we would discuss more at our next meeting.
Maniaci indicated he would be attending the Ohio Township convention in Columbus on February 12th, 13th, 14th.
Maniaci stated we received a letter in mail from Frost Tree Service but trustees agreed that we would use someone locally if we need any tree services.
Maniaci stated he spoke with Ann Gildow regarding our new credit cards but she still hasn't responded. Maniaci is going to give her one more chance before we proceed elsewhere.
Maniaci presented and read 2013 Township Highway System Mileage Certification for Muskingum Township received from Ohio Department of Transportation. Total mileage for 2013 is 47.362 miles.
Maniaci stated that the annual back-flow test required by the health department has been completed.

March 2014 REGULAR MEETING MINUTES
BOARD OF MUSKINGUM TOWNSHIP TRUSTEES
March 6, 2014
PURPOSE OF MEETING: Regular Meeting.
OPENING: The Muskingum Township Trustees met in regular session on March 6, 2014 at 7:00 p.m. in the Fire Building. All trustees and fiscal officer were present. There were 7 residents present.
The February 6, 2014 Regular Minutes were read and Hittle motioned to approve, Fell second, Maniaci ayed.
Checks were approved and signed for payment.
Fiscal Officer presented trustees with 2014 Permanent Appropriation Budget based on the Amended Certificate of Estimated Resources from the County Auditor, as required by April 1, 2013, O.R.C. 5705.38.
Maniaci read and made motion to approve the Permanent Appropriations Budget.
Total Estimated Revenues for 2014 $592,337.50
Total carryover from 2013 $94,267.07
For total 2014 budget appropriations of $686,604.57

Maniaci introduced Ms. Mollie Crooks, Muskingum County Commissioner candidate on the May primary election ballot. Ms. Crooks spoke to those on hand about her experiences, devotion to serving Muskingum County, leadership qualities, emphasis on like, trust and respect in your leaders, communication and working together with and among our leaders, jobs, grant funding, license taxes for bridge funding in response to questions from Mr. Dunfee and accessibility of Ms. Crooks, in comparison to our current officials, asked by Mrs. Cohagen. Ms. Crooks urged all to vote and emphasized her candidacy of committed to community and dedicated to service.
Maniaci opened for old business.
Mr. Dunfee, Licking Township, presented bill for an additional $96.98 for 2013 Vanderbark chip seal. The approved motion was made in the December 2013 meeting and waiting on documentation from Mr. Dunfee with the difference in what was applied from Matt Russell's calculation received.
Maniaci stated that we have procured another 50 ton of salt from Cargill and another 50 ton on stand-by if we need it and we have close to 300 ton of cinders and another 20 ton of salt available through the state. Maniaci motioned to approve $81 per ton of salt (up from $49 per ton) and another $1.50 per ton plus delivery for cinders. Hittle seconded, Fell ayed.
Maniaci made motion to accept Twin Hills Landscaping contract offer to keep current price of $464 per month for 7 months, $3,428 annual, for cemetery and township garage mowing for 2014. Fell expressed concern regarding mowing of other residences and Maniaci assured Fell that this contract and mowing is solely for said purposes and any other mowing would have to go through a separate bid and contract approval process. Hittle seconded the motion, Fell ayed. Roll Call: Maniaci ayed, Hittle ayed, Fell ayed.
Maniaci stated that our new credit cards from Century National Bank has finally arrived after the delay and shipping mix-up.
Maniaci addressed mail box replacement. Maniaci stated that after attending the state conference and sessions regarding mail box replacement policies, Maniaci recommended that the trustees look into proximity requirements by the post office, height, distance, dollar limit and developing and putting in place a policy within our own township policies.
Maniaci opened for new business.

Maniaci also wanted to state that his neighbor Chris Brauning's house was destroyed by fire and indicated that both the Zanesville Times Recorder and WHIZ reported that it took an extra 15 minutes to respond to the fire because the roads were impassible to his house and Maniaci went on record to say Chris's driveway was impassible and not our roads. Our township roads were clear and passable.
Maniaci indicated that Charles Mattingly will be retiring at the end of March and we will have a position opening. Maniaci presented copy of job description of maintenance worker for review and recommended that we should advertise the position out. Maniaci made a motion to advertise for the position and put out to bid in paper for maintenance worker. Hittle seconded, Fell ayed. Roll Call: Maniaci ayed, Hittle ayed, Fell ayed.
Maniaci presented to trustees a copy of old policies for review, prior proposed amendments that were not approved, and excerpts of a few specific policy changes that were approved in past minutes. Maniaci asked and to pay attention to the language, clarity and specific changes to propose that will be in place for current and future employees. Fiscal Officer Baughman indicated that the policies are not incorrect but vague and needs more clarity with trustees review.
Maniaci indicated after attending the state conference, in regards to emergency meeting situations, O.R.C. 121.22, there are exceptions to the need for an emergency meeting. The emergency meeting policy needs to be in the re-organizational meeting minutes. The re-organizational meetings and minutes are allowed to be amended any time during the year. Maniaci will present a resolution at the next meeting so we can amend and revise our re-organizational meeting to include an approved resolution covering our emergency meeting situation policy.
Maniaci also presented and discussed his discussions with micro seal for asphalt roads he received from the state conference and will discuss in more detail for all at our next monthly meetings.
Hittle indicated that while we discuss Charlie’s replacement we should look discuss the need for multiple part-time employees instead of one full-time employee, wage and benefit options and availability of the replacement during our most important times of need,
Mr. Dunfee asked trustees about Doug Davis utilizing motor paving and our township's interest. Maniaci stated we would have to look into it. Mr. Dunfee also asked if we dealt with any cemetery stone replacement issues. Mr. Dunfee also inquired as to who we used for our health and dental insurance. Fiscal Officer Baughman indicated we use Aetna for health under Rankin & Rankin and Dental insurance through Delta Dental under Wicert Insurance. Maniaci and Baughman also mentioned we explore for the best price and deal and are looking into Health Savings Account (HSA) which is very cost favorable for all.
County Commissioner Porter visited with the township and indicated that he has some opponents this year in his re-election bid as Muskingum County Commissioner stopped in to answer any questions, emphasized his 19 years experience as a township trustee and his current experiences as county commissioner. Mr. Porter answered questions regarding the license taxes proposed by Doug Davis. Mr. Porter stated he was not in favor of any new tax. The townships will get a portion of the $5 license fee. Mr. Porter stated that the county engineer department has a $4.9 million budget and only $200,000 has been going toward bridges. Mr. Porter also indicated that in regards to the license fee tax of $5, before any grant money is available from the state, we would have to utilize the full $10 license fee first before grant money would be available. The $5 license fee will get us closer to utilizing a full $10 license fee which would open up the availability of grant money for us.

APRIL 2014 REGULAR MEETING MINUTES
BOARD OF MUSKINGUM TOWNSHIP TRUSTEES
April 3, 2014
PURPOSE OF MEETING: Regular Meeting.
OPENING: The Muskingum Township Trustees met in regular session April 3, 2014 at 7:00 p.m. in the Fire Building. All trustees and fiscal officer were present. There were 7 residents present.
The March 6, 2014 Regular Minutes were read and Maniaci motioned to approve as amended. Fell second, Hittle ayed.
Maniaci motioned that the trustees move to executive committee for the purpose of employee hiring. The following were invited to executive committee in addition to the trustees: Fiscal Officer Baughman. The following maintenance worker applicants were invited individually at a time: Bice, Jasper, Conkle, and Clements. Hittle seconded, Fell ayed. Roll Call: Maniaci ayed, Hittle ayed, Fell ayed.
Maniaci motioned that we exit out of executive session and back to regular session. Hittle seconded. Roll Call: Maniaci ayed, Hittle ayed, Fell ayed.

Mrs. Cohagen indicated that she was glad to see progress being made on the 6415 Frazeysburg Property. Fell stated that the property was going up for sheriff’s sale and set for an auction sometime in May. Fell also stated that the prosecutor Jerry Earnhardt stated if we have any mowing claims on this property or any foreclosed properties to file the claims.
Maniaci stated that Mr. Charles Mattingly is retiring and last day was March 30th and wanted to thank Charles Mattingly for his years of services to our township and wish him a happy retirement. Hittle also reiterated the same sentiment and enjoyed working with him.
Maniaci read and motioned to adopt Resolution in accordance with ORC 122.22, to amend the Re-Organizational Policies for Muskingum Township. Emergency meetings can be held within 1 hour for emergency purposes only when immediate official action is necessary. In the event of an emergency, the member or members calling the meeting shall notify the news media that have requested notification immediately of the time, place, and purpose of the meeting. Jason Baughman, Fiscal Officer of the Township of Muskingum, Muskingum County, Ohio, certify that the foregoing is a true and correct copy of the resolution adopted by the township trustees on April 3rd, 2014. Mr. Ed Fell seconded the resolution with the roll being called upon its adoption the vote resulted as follows: Maniaci ayed, Hittle ayed, Fell ayed.
Maniaci stated we received a letter from ODOT regarding salt bids. The bids have to be turned in by April 8th. The old process was 80% of total tonnage. The new process is 90% total tonnage with 10% allowance for overage. Our minimum would be 180 tons now vs. 160 tons under the old process. Maniaci stated that in a year’s cycle we use about 220 tons. Hittle indicated the average per year is about 180 tons. Maniaci stated we have until December 31st to by 100% and then until May 31st to buy 90%/10% of the remaining tons. Hittle stated that of the 70 tons we currently have on hand we bought 50 tons with the other 20 tons we took from the state to be returned. The trustees agreed to go with a total of 180 tons for the ODOT bid.
Maniaci asked trustees about their follow-up with the township employee handbook. Fell inquired about full-time employee requirements and if we should identify full-time as 40 hours per week, 2080 hours per year or 30 hours per week, 1600 hours per year and in line with state of Ohio. Fell inquired regarding 8 hour work day that includes a half hour lunch vs. an 8 hour work day with a half hour unpaid lunch. Maniaci stated these revisions are made in the new draft presented to the trustees. Fell inquired about overtime rules and 40 hour work week. Maniaci indicated that he agree to the comp-time hours being included in determining overtime qualifications but not vacation, sick, and holiday time.
Mrs. Cohagen indicated that per federal labor laws that sick-time did not count in determining overtime hours and vacation and comp-time and even holiday are considered earned hours. As for accruals and carryover and paying out paid time leave upon termination of service is set forth by your policy. Hittle stated we can look at adjusting our policy accrual cap. Maniaci indicated that the draft presented to the trustees has most all of the revisions up for discussion and adoption.
Fell also identified defining call out pay. Baughman indicated that the policy states the work week of 40 hours includes Sunday through Saturday therefore there is no call-out pay and if so, this is unclear and needs defined differently.
Maniaci stated that one thing to think about moving forward regarding hiring additional drivers for our salt trucks is motivation and incentive such as better wage for perspective employees. Hittle stated that annually we are not going to have very many of these call out instances and should provide a good fair wage for these situations.
Fell inquired about safety, mileage, and fuel logs. Maniaci stated that when the trucks are take out the logs are performed. If they are sitting in the garage for the day they are not.
Maniaci stated once we put our notes together regarding the employee handbook we will incorporate the changes and finalize and approve the changes. We can consider a special meeting to finalize and put in place a soon as possible as we move forward to hiring the replacement maintenance workers.
Mrs. Cohagen asked about policies and procedures included in the handbook. This should be kept separate from the employee policy handbook.
Hittle stated that the Plunkett & Clooney case has been settled and the Township has no part further to play regarding this matter.
Maniaci opened for new business
Maniaci stated that we did not receive a Fire and EMS run report at the time of the meeting and would provide at the next meeting.
Hittle stated that we have our new AEP badges for getting our own cinders.
In closing, Mrs. Cohagen thought the advertisement for maintenance worker effective start date April 1st and in the paper March 31st was interesting. Baughman indicated that he submitted the draft to CareerBuilder and the rep handling the account reduced the advertisement to it.

MAY 2014 REGULAR MEETING MINUTES

May 1, 2014
PURPOSE OF MEETING: Regular Meeting.
OPENING: The Muskingum Township Trustees met in regular session May 1, 2014 at 7:00 p.m. in the Fire Building. All trustees and fiscal officer were present. There were 2 residents present.
The April 3, 2014 Regular Minutes were read and Fell motioned to approve. Hittle second, Maniaci ayed.
The April 24, 2014 Special Meeting Minutes were read. Hittle motioned to approve. Maniaci seconded. Fell ayed.

Jeff Schlaegel on Dutch School Road inquired about the Plunkett & Clooney Case with the trustees. Jeff's stated his property adjoins to the Dutch School Road property and he was not notified of the case. Maniaci stated we just received a letter indicated were listed as a party on the case and closing the road but we had nothing to do with it. Jeff stated that he was interested in the access and right away to his property. Hittle stated he would talk with Porter about this and see what can be done.

Mrs. Cohagen asked about call out pay and how it figured into the overtime hours in their forty hour week. Maniaci stated those 3 hours per the policy was outside of regular hours. Baughman clarified by stating that the call out pay is paid at whatever rate is in effect at the time they incur the 3 hours call out. However, the majority of the time the hours are earned outside of their regular eight hour day and falls into the overtime pay. Baughman indicated that this is one of the issues in the policy that he questions as the policy defines the work week as 40 hours beginning Sunday through Saturday and not per individual 8 hour days which conflicts with the definition of call out pay and how it is paid. This issue has been addressed and is defined in the new policy.
Mrs. Cohagen stated that she noticed that the Frazeysburg Road property has been cleaned up and the van is gone.
Fell asked about the Time Warner bills and why there was two separate billings and if we could get these combined. Baughman indicated that he met with Time Warner last year about the contracts and we are currently under separate contracts with different terms and periods. There is one bill for the Township and one bill for the Fire Department and is charged accordingly to the appropriate funds and has never been an audit issue.
Hittle stated that he spoke with Curtis and Mr. Bruce Russi at 3175 Fairview regarding replacement of his mailbox. Brock's Welding is repairing the mailbox and will be fixing it as soon as we can.
Maniaci stated that this instance and issues with mailbox replacement is an example of our need to develop a policy identifying what and how much is an reasonable amount that is allowed in replacement of mailboxes and that conforms with specific height, location, types allowed per state and federal regulations. Maniaci stated that the trustees would work on writing up a policy to put in place and adopted with a resolution.
Maniaci opened for new business
Maniaci stated that we did not receive a Fire and EMS run report at the time of the meeting and would provide at the next meeting.
Mrs. Cohagen stated that Curtis has done an excellent job with patch work on Jones road, however at the end of Jones Road near Rt. 60 by the stop sign the road is caving in especially after this last rain we had and the trustees might want to take a look at it to see what can be done.
Fell indicated that he spoke with Curtis regarding a culvert on Melody Lane. The culvert wasn't draining and they can't find the end of the culvert and is needing fixed or replaced. Fell stated he spoke with the sewer department. The culvert was 60 feet from where it should be. Fell indicated to them it was there responsibility and cost and they should be replacing and not the township. Maniaci agreed.
Hittle stated that he spoke with gentlemen on Kenlo Woods about a plugged up culvert and we need to take a look at to fix.
Hittle stated with all the rain we have had here of late he has done a lot of checking of ditches around the township in particular Rollins, Vista and Northcrest and indicated that water looks to be flowing very good and has seen no signs of issues. Maniaci stated that this type of rain we have been having is not an issue and it's the heavy buckets of rain all at once that causes the problems with getting backed up and bigger culverts is not the solution but just keeping them clean and clear.
Maniaci stated he called the county regarding a damaged guardrail on Prior Road.
Hittle presented pictures he took of areas in the township with water flowing good with no signs of problems.
Maniaci stated that these pictures were areas of roads that we chip sealed and looks to be holding up very well.
Maniaci indicated that he spoke with Curtis about reducing our 400 ton of hot mix from last year to about 100 ton so we could focus more of our budget on chip seal and asphalt this year.
Maniaci indicated he believed that Schneider Lane is Cass Townships turn to chip seal this year and we did it the last time and it's their turn now.
Maniaci stated that we need to look at our miles for this year to chip seal and make a decision as to bidding it out or go with the county as they have historically came in better than anyone.
Mrs. Cohagen asked when the last time Schneider Lane was done with the culvert. Maniaci indicated 2 years ago and the road still looks good.
Mrs. Cohagen stated that the chip seal done last year on Jones Road has held up very well. Maniaci stated we patched about 100 ton which helped to hold up the chip seal.
Hittle stated that applying more patching on roads with slopes and hills helps with keeping the roads chip seal from breaking down.
Hittle stated he was looking at a product called rolled compacted concrete which is rated for 8000 PSI and is cheaper than asphalt. Muskingum Iron and Metal has it and is looking into some estimates.
Baughman stated he received a call from Bev Lamaster on Terra Shores and she indicated that she was in a near accident from another vehicle that tried to pass on Fairview Road and asked about dotted passing lines still on Fairview. I told her I would bring up to the trustees to get with Falls or the county about addressing Fairview Road. Hittle stated he needed to talk with the County about the sign on Creamery and would address Fairview also.
Fell stated he spoke to County regarding the ditch on Bellevue and they would look at it.

Maniaci stated the Employee Handbook Policy revisions and copies made. The definition of overtime & call out pay is addressed. Call-Out pay is time and a half with overtime pay paid for hours over 40 hour work week.
Maniaci stated the Fairview Road mailbox has been installed. The policy and resolution for mailbox replacement has not been completed to-date.
Maniaci stated that Hittle spoke with Commissioner Porter regarding the Clooney & Plunkett case for Mr. Schleagel and indicated the case is with the courts since the courts made the ruling.
Maniaci stated there is an issue with a slip in need of repair on Dresden Road due to a bank caving that they are working on and looking for estimates.
Mrs. Cohagen indicated due to the last rains the corner of Jones Road and Rt. 60 has caved even more since mention at the last meeting.
Mrs. Cohagen asked if Hittle had checked on culvert issue in Kenlo Woods. Fell indicated it was a clean out issue and Maniaci stated they would have to ask Hittle when he returns.
Mrs. Cohagen asked if any type of street sweeping agreement had been found regarding Fulton Lane and Schneider Lane. Maniaci indicated there was no agreement as for Fulton Lane. Mr. Jerry Miller stated in the past there was a winter agreement for these roads.
Fell indicated he spoke with sewer department regarding Melody Lane but hasn't heard back and is trying to get something in writing.
Maniaci stated he spoke with the county engineer’s office regarding the passing dotted lines on Fairview and they were not sure when and if solid non-passing lines would be done.
NEW BUSINESS:
Maniaci stated Fell and Hittle received call about a noise issue on Harper Drive. Per O.R.C. 505.172 the trustees can issue noise control only in the unincorporated areas of township, zoned areas or areas that have been issued a D liquor permit. Our township has none of these therefore there isn’t anything we can do.
Mrs. Cohagen asked how many and how insurance reimbursements were being paid; pre-tax or post-tax. Fiscal Officer Baughman indicated there are 2 on township insurance and he and Maniaci on reimbursement. Baughman indicated Mrs. Cohagen was referring to the Affordable Care Act and IRS notice 2013-54, O.R.C. 505.60 and stated the reimbursements were and have always been handled on a post-tax basis and in accordance with these provisions.
Maniaci introduced Zack Helm from Strauser Construction to discuss a new product called Onyx.
Onyx is a mixture of asphalt emulsion, fine aggregates, and polymers. Onyx is black in color and cost about $13,000 per mile or 1.25 square yard. Strauser is preservation experts in seals such as Micro Seal. Strauser manufactures the emulsion. Micro Seal is more expensive and has a 7 year life vs. Onyx which is a cost effective, low risk alternative that extends chip-seal road life approximately 30%, 3-5 years. Onyx can be applied to both asphalt and chip-seal roads. Approximately 5-6 miles of Onyx cost as much as 1 mile of asphalt. Onyx will hold up to salt, sand and cinders and not affect its life or wear. Onyx is applied on roads 2 sides at a time and has a 1 hour dry time in comparison to a fog seal that has a 23 hour dry time. Approximately 2-4 miles of Onyx is a typical spec to get the price to $13,000 per mile. Onyx has been in Ohio for about a year and mainly been applied in the Midwest. Mr. Helm indicated that he would be back in Muskingum County to talk more about the product to other local townships and county officials and look at our roads.

Mrs. Cohagen stated that she was disappointed the Fire Levy failed for the second time and lack of push from Falls Fire for the levy and stressed the need for the additional levy and for an emergency shelter for our township. In response to Mrs. Cohagen comments and question by resident in attendance, Maniaci stated we contract with Falls Fire & EMS to guard our township. We get a really great bargain for what we pay. Falls Fire & EMS is independent and not owned or operated by Falls Township. Falls Fire & EMS has 2 stations with 2 full-time staff at both Ritchie and Dillon stations. About 10-15 of our residents are on Falls Fire & EMS roster and with the levy we would have 2 full-time staff at our fire station.
Maniaci discussed roads for chip-seal, asphalt and putting it out for bid again. Maniaci identified the following roads having 10-11 miles each in need of repairs, chip-seal or asphalt: Squirrel, Dutch School, Stagecoach, Dresden Ct., Tiffany, McCassin, Applo, Harper, Saddlebrook, Virginia, Carolina, Saddlebrook, Tunis, Conn, Fawn, Stonehenge, and Melody Lane.
Maniaci indentified the following roads having 1-2 miles each that would be good crack-seal candidates: Lisa Kim, Chardon, Idlewood, Greens at Vista, and South View.
Maniaci made motion to accept bids for gravel and limestone used for chip-seal with right to accept or reject any and all bids. Fell seconded. Roll Call: Maniaci ayed, Fell ayed.
Maniaci stated that historically the county engineer department consistently beats any bids for chip-seal and made motion to keep the county engineer department for chip-seal of our roads. Fell seconded. Roll Call: Maniaci ayed, Fell ayed.

Maniaci stated he would talk with the county regarding the chip-seal roads and provide Fiscal Officer Baughman the bid notices and road specification for publication in the times recorder and include on the township website so sealed bids could be submitted and opened at or next regular monthly meeting on July 3rd.
Fell stated he would follow-up with Don Mattingly about the sewer department issue surrounding Melody Lane and sewer issues on Idlewood and Chardon road. Fell stated that the county has fixed the ditch issue on Bellevue.
Maniaci indicated he received a culvert request on Welch Road and would follow-up.
Maniaci indicated he followed up with Hittle about the culvert issue with Harper Road to Virginia Road property and issue of driveway vs. public right-away as designated by the county engineer. Maniaci didn't think the culvert would work and is a landscaping and grade issue. Fell agreed and didn't feel we should pay for since it is not a culvert issue.

Maniaci indicated that after meeting with Zack Helm from Strauser and looking at our roads good for onyx and crack seal have changed mind on the roads to consider onyx, crack seal, chip-seal or asphalt. Zack Helm indicated that Rollins, Oakwood North examples of best candidates for crack seal and onyx and others such as Virginia, Georgia, Carolina, Babes, are in bad shape, base problems, and just should chip seal them even if over asphalt.

Hittle indicated might want to talk with Chris Mitchell. He has a process where he re-uses/re-melts asphalt and each pack gets 10 times / 75% stronger and we may look at some areas to patch with this process.
Hittle stated that he had looked into the roller compact concrete option mentioned at a previous meeting and is just too expensive to consider at this time.

Maniaci wanted to state for the record that he mistakenly used the township Century National Bank card instead of his when getting gas the other day and is presenting a check to Fiscal Officer Baughman to reimburse the $50.91 gas charge.

Hittle confirmed with Fell that there was nothing we could do regarding the noise issue on Harper Drive.
Hittle indicated he spoke with Doug Davis in regards to Cliff Murphy on Harper Drive and Mr. Murphy wanting to grade his driveway and build in culvert or box drain outside of his garage.
Hittle indicated that there is a culvert caving in on Hampton Court and asked Curtis to take a look at to see if it is repairable.
Fell indicated that the culvert on Melody Lane was cut in half and it is thee and replaced by the Fire Dept.

Fell indicated Mr. Hershberger needs a culvert replaced and would get with Curtis on this.
Fell indicated that Mr. Cotterman, Glenn Willow, has a mud issue that is filling up next to his house and there is no vegetation to stop it and need to take a look at it.
Fell indicated he received a call from Mr. Richard Greiner, Vista Apt., stating that he has had 3 emergency calls with an A.R.T. of 15 minutes. Maniaci stated that we could verify it with the run reports.

Fell indicated that David Hittle of My Drive wants to extend his culvert and add a basin. Not sure if he wants to do it himself or hire someone. Maniaci indicated we don't typically put basins in and he can do it as long as it is done right and not in our policy to put basins in.
Maniaci indicated that the handbooks has been delivered to trustees, fiscal officer and employees and will be in place.
Maniaci presented and motioned the following resolution, 7-3-2014 Mailbox Policy, If damages occurring from Snow Removal and other mishap's during Muskingum Township authorize work, and determined Township responsibility, said policy will be that the Township will administer up to $50 towards the purchase of an acceptable mailbox, installation not provided unless determined and approved by the trustees. Maniaci indicated that Mr. Schleagal won his case to keep his road open adjacent to his property.
Maniaci indicated that he spoke with Chris Zemba about Jones/Rt 60 culvert Mrs. Cohagen had addressed. Zemba is taking care of this by replacing the culvert.
Maniaci addressed Gorsuch Road guard rail issue. The right hand side of the guard rail came off. Trustees will look at the options and discuss with Curtis.
Maniaci indicated Stagecoach Road/Fulton Road prep work for chip-seal is half done.
Maniaci presented National Gas Easement. Hittle stated we just need to approve and is no rush as they are still waiting on Mr. Moore to release easement on his end. Maniaci motioned to approve easement. Fell seconded. Roll Call: Maniaci ayed, Hittle ayed, Fell ayed.
Maniaci spoke with Troy Balderson about getting some grant money to pave Ellis Dam Road. The estimate is about $43,000 and presented trustees with email correspondence requested from Troy.
Maniaci asked trustees if we want to decide on asphalt estimate of $110, 000 or any crack seal tonight if we can afford it and asked Fiscal Officer Baughman about funds available. Baughman indicated that he would have to look into it more but initial thoughts are that asphalt not in budget without reductions to other fund appropriations.
Maniaci stated that we could re-submit the bids for crack seal and have a special meeting to open the bids and accept or reject. Trustees agreed to hold Special Meeting to open and accept or reject crack seal bids on July 21, 2014 at 6pm.

OLD BUSINESS:
Hittle opened floor to residents in attendance; Mr. Jeff Schlaegel and James and Jody Fleming. Mr. Fleming stated he was owner of the Shannon Road property at end of Fawn Drive. Mr. Fleming indicated that they believe and have map that it is a township road. The home they purchased was built on the right away of the road that Mr. Schlaegel is wanted to use as an access road. Mr. Schlaegel indicated that the ruling by the court was reversed and the road is now back open. Mr. and Mrs. Fleming indicated that Mr. Schlaegel address/access road is Dutch School Road and concerned with maintenance of the road and responsibility of maintaining the road. Mr. Schlaegel wants to build an access/driveway road to his property. There is also an issue and dispute whether or not it is a township property, public road and a home built on a right away where in order for Mr. Schlaegel to build an access road to his property involves removal of a propane tank and a basketball court and retaining wall which is Mr. and Mrs. Fleming’s home. Hittle and Fell indicated that they would have to address with the commissioners and prosecuting attorney to see what can or can't be done and how to proceed and how Mr. Schlaegel and Mrs. and Mrs. Fleming to proceed with the road.
NEW BUSINESS:
Hittle stated 7.1 miles of chip-seal has been completed.
Hittle and Fell reviewed asphalt paving bids. Fiscal officer Baughman indicated that with the second half property tax and monthly revenues we have approximately $110K available. Fell motioned to accept Shelly Company asphalt bid of $34,626.10 for Melody Lane. Hittle seconded. Roll Call: Hittle ayed, Fell ayed.
Hittle read resolution 8-07-2014 Vista Drive, the board of trustees approve a letter of acceptance for Vista Drive and will accept as a plated road when all county road specifications have been met and presented to the board of Muskingum Township Trustees for approval. Baughman indicated that the easement for National Gas was notarized and mailed.

Fell addressed a call received about culverts on Gorsuch to Fawn Drive. Fell indicated that none of the homes have culverts. Fell indicate that the left side of the road has nice ditches however there is too much space between the road and ditches. Fell indicated that he would look into the issue some more and follow-up and discuss more with the trustees at the next meeting.
Fell indicated that he was looking into another culvert/road issue with resident on Weaver Road and would follow-up.
Hittle stated that the Hickory Hills Road issue with Mr. Cotterman and the homeowner wanting to put in a culvert was more of an issue with the 3 neighbors. Hittle and Fell indicated that they would get with Doug Davis about a resolution to this issue and discuss some options.
Hittle stated that he would get some estimates from Camm Construction and the infrared asphalt patching for the next meeting. Hittle also indicated that Brett Sidwell was interested in bidding our asphalt patching.

Maniaci opened discussion regarding the slip repair project on Dresden Road. BOARD OF MUSKINGUM TOWNSHIP TRUSTEES
September 4, 2014
PURPOSE OF MEETING:
The Muskingum Township Trustee met in regular session on September 4, 2014 at 7:00 P.M. in the Fire Building.
ATTENDANCE:
Trustees Mike Maniaci, Matt Hittle, Ed Fell and Fiscal Officer Jason Baughman were in attendance.
There were 3 residents in attendance. Commissioner Porter was in attendance.

OLD BUSINESS:
Mr. Schlaegel addressed the trustees and Commissioner Porter regarding the Shannon Road property issue.
Mr. Schlaegel, the trustees and Porter reviewed the map of the Shannon Road and the property lines in question.
Mr. Porter indicated that the recent Shannon Road ruling by the commissioners was reversed as it was determined that as all adjourning parties involved were not properly notified. Mr. Schlaegel indicated that his attorney indicated the road on the property can be used as needed. Mr. Porter and Maniaci referred to O.R.C. 5547.01.03 – whereas the County Commissioners can rule on obstructions to a road if determined. Mr. Porter stated this is not a road or considering it a road at this time. Mr. Porter indicated since the road on the property has not been maintained, or by the Township, for a long time, a legal easement may be needed. Mr. Porter indicated the before any maintenance agreement is decided, the road on the property would have to meet county road specifications. An option to consider would be for the road to be abandoned and a maintenance agreement signed by the adjourning parties including Mr. Schlaegel. The Trustees and Mr. Porter stated that unfortunately at this time there is nothing that they can specifically do or rule on and although not responsible for arranging, they recommended Mr. Schlaegel to work on a compromise with the property owners and offered to assist Mr. Schlaegel with working on a compromise with him and the other property owners when they’re available.
NEW BUSINESS:
Commissioner Porter asked the trustees about Schneider Lane motor pavement. Mr. Schneider expressed concerns with the road and requested a burn be put in. Mr. Porter and the trustees indicated that part of the road was Cass Township and would arrange a meeting with everyone to discuss the options.
Ms. Everson indicated she was opening a recycling business and inquired about zoning issues. Maniaci stated there were no zoning currently in Muskingum Township. Commissioner Porter indicated that the county was having issues with getting rid of their recycling due to the Marietta recycling center that was burned down recently.
Fiscal Officer Baughman presented “Then and Now” purchase order to the trustees for approval for the Fire Truck Payment of $42,722.67. Maniaci motioned to accept. Hittle seconded. Roll Call: Maniaci ayed, Hittle ayed, Fell ayed.
Maniaci indicated that the previously approved Vista Drive Resolutions 8-7-2014 from the July meeting required 3 signatures therefore Maniaci also approve the resolution, in addition to the previous trustee’s approval, and add his signature
Fiscal Officer Baughman presented the trustees with the 2015 Tax Budget for approval. Maniaci moved the adoption of the 2015 Tax Budget accepting amounts and rates determined by the Budget Commission in its certification and authorizing the necessary tax levies to the county Auditor.
Inside the 10 Mill Limitation $279,609.
Outside 10 Mill Limitation $103,618.

Hittle stated that Camm Construction Asphalt Restoration agreed to the $3.75 counter proposed from the trustees and would like to look at Jacks Fairway with the trustees.
Fell indicated he spoke with Doug Davis regarding Fawn Drive property issue. Davis indicated and recommended chip seal options instead of installing a catch basin.
Maniaci stated he called Stubbins regarding the Eagle Point Drive properties mowing and was still waiting for returned call from Mr. Stubbins regarding getting these properties mowed again.
Maniaci indicated that the trustees would look at Melody Lane and the other roads to discuss the linear feet areas for Camm Construction Asphalt Restoration to begin work on.
Maniaci stated that Mr. Auchmyer, of Gregory Lane-Terra Shores, indicated the township buried a ditch and inquired on who was responsible for replacing the culvert. Maniaci stated he would look into the property address and discuss with the bank or owner of this property before proceeding with approval for any installation of the culvert.
Maniaci stated that he had no additional information on the Bunting Cemetery fence post issue. Maniaci and trustees were in agreement to proceed with fixing the fence post.
Hittle inquired about Winfield Circle pipe. Maniaci stated the pipe has already been pulled out and installed.

Maniaci indicated Curtis would be off for approximately 6 weeks due to rotator cuff surgery.
Hittle indicated that the trustees will look into options on some additional help to fill in with Curtis being out and in preparation of the plowing season and uncertainty of Curtis’s recovery time.

The Muskingum Township Trustee met in regular session on October 2, 2014 at 7:00 P.M. in the Fire Building.

Mrs. Cohagen asked about check to Zemba discussed. Maniaci indicated it was for dirt and not a culvert.
Maniaci introduced Linda Reggula, candidate for Muskingum County Commissioner. Mrs. Reggula has been resident of Zanesville for eleven years. She is president of the Zanesville Downtown Artist Colony. She indicated that there is a lot of grant money available that our county rarely takes advantage of. She is holding a free grant workshop that will show how to write and apply for these grants. She would like to see a wider distribution of tax dollars in our county and would have open round table meetings to allow townships to share ideas if elected.
OLD BUSINESS:
Maniaci indicated that he left a message with James Fleming and Mr. Schlaegel and has not received a return call from Mr. Schlaegel. Mr. James Fleming was ok with getting the property surveyed at their cost. Commissioner Porter presented and discussed a map of the property lines with the trustees he received from GIS. Mr. Porter indicated that other than the map he presented no other documentation from Mr. Schlaegel or his attorney could be found. In response to Mrs. Cohagen, Mr. Porter stated the Commissioners asked the court to reverse the previous court decision as Mr. Schlaegel was not properly notified. Porter indicated Mr. Schlaegels road idea would have to go before the planning commission and doubted that it would get approve without road frontage. Porter stated it would be difficult to move the easement unless a "public benefit" could be determined. The intent is to abandon the property and the township would have no responsibility. Porter deferred to Bud Chess to determine if this would be a new road or revised easement. Hittle indicated that the 3 landowners just need to compromise and agree to abandon and deed between themselves with a road maintenance agreement. In response to Maniaci, Porter felt getting an agreement from the 3 parties in writing before it is abandoned would be difficult. Porter stated hearings would have to be made available with the 3 parties to discuss. Maniaci indicated we need to remind Mr. Schlaegel of these options and that he is not landlocked, he may or may not get any access if a compromise can’t be reached with the parties and ultimately in the end we want nothing to do with the property and can just abandon it.
Maniaci spoke with Mr. Gary Miller regarding the slip repair on Dresden Road. Mr. Gary Miller didn't agree with the opinion of the trustees on how they were going to repair the slip by taking some trees out and tearing it all back. Maniaci asked Mr. Jerry Miller his opinion. Mr. Jerry Miller wasn't in agreement with it and not involving Gary in the planning of the repair and having Sidwell show up without representation of a trustee after four months since first bidding the repair. Mr. Jerry Miller stated another alternative would have to be determined without removing any trees on the property. Maniaci indicated without access to the property we will have to keep the ditch clean and do what we can from the side of the road. Hittle stated adding some pilings to help lock in the slip may be an option.
Hittle stated that CAMM Restoration asphalt repair work was in progress Maniaci presented additional estimates from CAMM for repairs to Jacks Fairway and Frame Road and asked about availability of resources to proceed. Fiscal Officer Baughman indicated we received our second half taxes last month and get another $10k to $12k per month in other funding and would look into and forecast available resources for remainder of year and follow-up with the trustees.
Hittle indicated that he did not see us on a list of approved salt bids in Muskingum County from Cargill. Muskingum County rate $72. Maniaci stated that we completed the paperwork during a meeting and approved it in the minutes earlier this year already.
Mrs. Cohagen stated that she noticed the Rt. 60 property was mowed again and inquired about the status of the property. Fell indicated he didn't see it come through the sheriff’s sale and other than being bank owned and lien on it from Medicaid would have to inquire on it.
Mrs. Cohagen asked about follow-up on our township Emergency Shelter and grants available we discussed several months ago. Maniaci indicated he was going to Mrs. Reggula's grant workshop and everything has been done with getting approved as a shelter and would look into it more including looking into a generator for the shelter.
NEW BUSINESS:
Mrs. Cohagen inquired about any requirements involving water lines and power lines being buried in a ditch. Mrs. Cohagen stated that a new water line up on a Jones Road property had been installed in the ditch. Hittle stated that the county did agree to it with Zemba including the proper depth of the lines to be installed.
Hittle stated he has a culvert/catch basin to look at on 5130 Manchester Drive.
Fell stated he received a call from Mark Neal about installing a culvert and inquiry about the project going on above the IBEW. Hittle indicated he heard it was going to be Lock n Store and unfortunately nothing we can do without zoning.
Fell indicated Troy mentioned we need to order some hydraulic fluid and that we were ok with it getting it ordered.
Maniaci indicated Curtis asked about the new employee handbook revisions and thought we had cut back sick days to much. He felt he should be grandfathered in and there be a reward for longevity and asked us to reconsider. Maniaci indicated he would make the revisions for the trustees to review and approve at our next meeting.

OPENING:
The Muskingum Township Trustee met in Special session on October 29, 2014 at 6:00 P.M. in the Fire Building for the specific purpose of asphalt road repair projects.

Maniaci opened discussion of road repair projects on Frame Road and Jacks Fairway.
Maniaci stated the trustees received an email follow-up from our Fiscal Officer Baughman indicating that we had available funds to proceed with the Frame and Jacks Fairway projects that we discussed at our last regular meeting.
Maniaci motioned to accept the following estimates from Camm Asphalt Restoration for asphalt rework and repairs:
Frame Road $5,036.25 (1,343sqft $3.75)
Jack's Fairway $7,890.00 (2,104 sqft $3.75)

Maniaci and Hittle indicated that Camm made a mistake when estimated the square foot work for Saddlebrook and ask for us to agree to the revised amount of 5,229 sqft vs. 4,900. The price per square foot remains the same as we agreed to at $3.75 per square feet. The difference is approximately $1,113.75. Maniaci motioned to accept the proper square footage from Camm Ashpalt Restoration. Hittle seconded. All ayed. Roll Call: Maniaci ayed, Hittle ayed, Fell ayed.
Mrs. Cohagen asked if this repair would hold with the current temperatures we are experiencing now. Hittle indicated that the rolled, compacted asphalt would set well into temperatures of 20's or 30's and we wanted to have this meeting to get approved and let Camm get started now.

NEW BUSINESS:
Chardon Road Construction: Maniaci opened floor to 3 residents in attendance from Chardon Road. Mr. Turner, Mr. Radcliff, and Mr. Dannemiller discussed the new construction of lock and store storage units taking place along Rt. 60 and Chardon Road and inquired with the trustees about zoning, prior approvals and indicated that their sub-division was part of an association and no one notified the association and residents of their association about this or for prior approval. The residents asked about any EPA rules as they expressed concerns about the installation of water waste and sewer installation and potential damage to the roads as they indicated that the residents and of the association had paid to have the roads asphalted of the subdivision.
OLD BUSINESS:
CAMM Asphalt Restoration: Maniaci indicated that the asphalt restoration is moving along and looks good. Curtis: Maniaci indicated Curtis has returned to work from his surgery. Generator Grant: Maniaci stated he has left messages and have not received returned call from Brian Hill regarding the generator grant. Dresden Road Slip Repair: Maniaci asked Hittle and Fell about pursuing the pylons on the Dresden Road slip or just keep it cleaned out for now and through the winter. The trustees agreed to continue to keep cleaned out. Salt Bids: Hittle indicated at the October meeting he didn't see us on a list he received of approved salt bids for Muskingum County. Maniaci contacted the guy and indicted we had submitted the completed bid paper work, approved resolution and proof of the emailed documents. The gentlemen stated he believed him however did not get the information and unfortunately all orders have been submitted and are closed. Maniaci contacted Cargill but they indicated they could not sale it to us directly either. Maniaci contacted other suppliers and
proposed we decide an amount to pursue now due to the first come, first serve basis. Fell motioned that we approve acquiring 200 ton at maximum price of $132 per ton. Hittle seconded. Maniaci ayed. Roll Call: Maniaci ayed, Hittle ayed, Fell ayed.
Maniaci indicated that he nor any of the trustees were notified prior to the start of construction nor would have any authority to do anything to prevent it due to the township having no zoning restrictions. Maniaci indicated that years ago, before any of the present board members time, a zoning committee was formed and the issue was discussed around the township. The zoning idea was rejected and never made it to ballot. Maniaci, Hittle, and Fell indicated that the association would have to pursue their legal options if so desired and the EPA issues would be handled by the BVA and may be a good route for their association to pursue.

Fire and EMS Run: No reports have been received at the time of this meeting. Falls Difibulator Grant: Maniaci indicated that Mark Brown of Falls Fire Department received a grant through FEMA for new difibulators. They can receive a $500 credit for exchange of old difibulator equipment and requested release of our used difibulator to them toward the credit. Maniaci motioned to approve the difubulator release to Falls for the $500 credit. Hittle seconded. Roll Call: Maniaci ayed, Hittle ayed, Fell ayed. Kenlo Woods Road: Maniaci indicated he received a call about Kenlo Road. Maniaci stated that we were looking at chip-seal this spring but would send Curtis to look at what repairs can be done at this time. Township Association gift: Maniaci indicated that in the past we have provided a gift for the meeting. Maniaci motioned to donate a $50 gift card from Bills BBQ. Fell seconded. Hittle ayed. Saddlebrook Patch work: Fell asked about status of Saddlbrook patch work. Maniaci stated Curtis and Troy was going to take care of this week. North Vista Road: Maniaci indicated a received call from disgruntled resident about damage to their car due to the bad road conditions of North Vista Drive. Chugg Run Road: Fell received a call from residents of and concern about Fire and EMS locating residents on Chugg Run Road and wanting to change the name. The Muskingum Township Trustee met in regular session on December 4, 2014 at 7:00 P.M. in the Fire Building for the purpose of the 2014 End of Year Meeting.
ATTENDANCE:

December 4, 2014 Regular meeting minutes read. Hittle motioned to approve as read. Fell second. Maniaci ayed.

Fiscal Officer Baughman discussed with trustees the current month’s payroll as it relates to the revised township employee handbook.
Trustees and fiscal officer discussed and defined regular 40 hour work week, overtime hours, and call-out pay.
Fiscal Officer and trustees agreed that the policy we revised and adopted states call out pay is paid at time and one half with a minimum of 3 hours. Overtime is paid on hours in excess of 40 hours and holiday, sick, vacation hours do not count in determining the 40 hours worked and in calculating overtime hours.
FALLS CONTRACT AND MARK BROWN:
Maniaci stated he spoke with Mark Brown of Falls Fire as a follow-up to Mrs. Cohagen’s inquiry at the previous meeting.
Mark indicated that there was no truth to comment about wanting to drop out of our existing contract.
There was no truth to the board being split on this issue.
Mark did confirm that there have been steps made and surveys regarding a fire district.
Fell stated that there would be no benefit for Falls to back out or even consider dropping us from the contract.
LOWES GENERATOR GRANT:
Maniaci stated he stopped at Lowes to discuss with manager about looking into grants for a generator for our township. The manager told him that the main person there that handles these types of grants was off. Maniaci stated he would have to follow-up with him when he returns.
ANNUAL YEAR END INVENTORY:
The annual year-end inventory is complete. Fiscal Officer Baughman was updating our electronic copies and would forward to Maniaci to be filed with the county engineer.
TOWNSHIP WEB SITE AND FINANCIALS:
Hittle indicated that as was discussed and stated at the last meeting, financially we are in a good position and ahead of the years before and recommended we look at including more of this sort of good information on our website for our township to see our progress, that we are being diligent with our uses of funds and the trustees and fiscal officer have been working well as a team over the last few years. Maniaci and Fell also agreed and felt good at where we are financially versus what has been done versus what resources we have available to us.
$500 SAFETY (MORE) GRANTS:
Maniaci stated that the application for the MORE grant of $500 has been submitted and confirmation of and return receipt of the filing has been received.
DELTA DENTAL RENEWAL:
Fiscal Officer Baughman presented a renewal form from Delta Dental to be authorized to continue with Delta Dental insurance as our provider of the policy we procure for the township employees that are on the insurance.

Muskingum Twp. 2014 Re-Organizational Meeting

PURPOSE OF MEETING: 2014 Re-Organizational Meeting
OPENING: Muskingum Township Trustees met in special session at 7 p.m. on January 2, 2014 for the re-organizational meeting in the Fire Building. All Trustees and Fiscal Officer were present. There were 2 residents present.
Hittle nominated Mike Maniaci for President, Fell seconded. All ayed.
Maniaci made the motion to have Matt Hittle and Ed Fell on the Burial Committee. Hittle seconded. Fell ayed.
Maniaci made the motion to keep the emergency labor at $8.00 per hour unless they have a CDL and then they would be paid $10.00 per hour. Hittle seconded. Fell ayed.
Maniaci made motion to keep public records policy the same for this year, public records will be provided in a timely manner/or the next regularly scheduled meeting. That there will be an optional written request advising what records is requested. The charge will be $.05 per page and $2.50 for cassette tape copies or going rate of a flash drive if preferred method. Fell seconded. Hittle ayed.
Mrs. Cohagen asked if this had changed from $.05 per page in excess of x amount of copies. Maniaci stated the policy is the same as it was before and we had changed to this in 2012.
Maniaci made a motion to continue and accept our current credit card policy. All three trustees and fiscal officer will have access to the Capital one Visa Card, Tractor Supply and Lowes cards. Township Maintenance workers will have access to all credit cards. The limits for all cards will be $150 per transaction. If purchase is over that amount, permission must be obtained by township trustees. Hittle seconded. Fell ayed.
Maniaci made the motion that the Township equipment can be operated by all road crew and trustees or any other person who has been authorized by the trustees or road crew to do so. Hittle seconded. Fell ayed.
Maniaci read and motioned the adoption of the Annual Temporary Appropriations Resolution for fiscal year December 31, 2014 (per O.R.C. 5705.38) until the Amended Official Certificate of Estimated Resources is adopted and received from the Office of Budget Commission, Muskingum County, Ohio. Hittle seconded. Fell ayed.
Maniaci stated the inventory is completed and be submitted to the County Engineer by second week per O.R.C. 505.04. Mrs. Cohagen asked if same inventory presented as prior year. Maniaci presented type written listing.
The Records Commission, according to O.R.C. 149.42 will consist of a Chairman of the Board; this being Mike Maniaci and the Fiscal Officer, Jason Baughman will be the Records Commission. Maniaci made the motion, seconded by Hittle. Fell ayed.
Maniaci made the motion that employees/elected officials who are authorized to use their private vehicles for township business such as conferences, training, etc. will be reimbursed at the standard mileage reimbursement rate established by the I.R.S. of 56 cents per mile which is allowable under the O.R.C. Hittle seconded. Fell ayed.
Maniaci moved to keep the regular monthly township meetings the first Thursday of every month at the township fire station at 7:00 p.m. That is will be posted in the newspaper once, on the website and posted monthly on the sign in the front of the township. Any changes or special meetings will be posted on the website, the sign out in the front of the township hall and newspaper at least 24 hours before the meeting. Hittle seconded. Fell ayed.
In regards to “Storage and distribution of personnel files and personal information”, Maniaci appointed the fiscal officer to have control of all files. Fell seconded. Hittle ayed. All personnel files will be in a locked filing cabinet at the township building. Fiscal Officer was informed that he/she is responsible for all the rules adopted in accordance with this section and shall maintain a written request log and show trustees requests made; they can sign off on the request which will show they are monitoring the accuracy of the requests. If there is a question of what can or cannot be released, fiscal officer is to contact legal counsel, Bud Chess. If above rules are not followed a written reprimand could be issued from the prosecutor’s office and could lead to termination depending on the situation. Maniaci made the motion to accept this procedure. Hittle seconded. Fell ayed.
Mrs. Cohagen asked about ORC 109.43(e) public records training. Maniaci stated it also indicates fiscal officer or a designee in place to take the training for them. Jerry Newell would have been, and in minutes, as designee during Maniaci and Fusners terms. Baughman came in with Hittle and designated to satisfy the training during his term. Public Records training is required once every 4 year term.

Maniaci called to order the special meeting and read the above mentioned resolution. The Board of Township Trustees of Muskingum Township, Muskingum County, Ohio met in Special session on January 28, 2014, at the office of the township, with the following members present: Michael G. Mr. Maniaci moved the adoption of the resolution to proceed with the submission to the electors of the question of levying a tax in excess of the ten-mill limitation, RC 5705.19, RC 5705.191, RC 5705.25, RC 5705.26; and WHEREAS, the County Auditor has certified to this Board that the total current tax valuation of Muskingum Township is $84,704,860 and the dollar amount of revenue that will be produced annually by the millage stated below would be $211,763.00.

Fiscal Officer stated that he received a call from Jeff Hardwick of Bryan & Snider Funeral Home and presented trustees with the follow-up letter, township duties with regards to indigent residents per O.R.C 5101.52, and an invoice from Mr. Hardwick for services rendered for a Mr. James H. Bayes, Jr., an indigent resident in our township, of 3175 Jacks Fairway Vista View, Zanesville, Ohio. Maniaci motioned to pay the $478 invoice for services rendered by Mr. Hardwick, upon verification of residency for the indigent resident Mr. Bayes, Jr. Hittle seconded, Fell ayed.

Maniaci provided an update on the salt supply. Charlie stated we have about 2-3 snows worth of salt after mixing. Maniaci stated he called around in Ohio and Indiana and there is just no salt supply available unless we want to spend $250 per ton to bring up from North Carolina. The county engineer indicated in our conference call last week that we are looking at 2-3 weeks before salt is available. The ODOT indicated that when salt becomes available, they would provide around 150,000 tons among various locations for distribution.
Maniaci stated that there has been some complaints regarding damage to our roads with all the snow and plowing.
Maniaci stated more snow equals more complaints and damage.
Maniaci indicated that we have a lot of mailboxes needing replacement due to all the snow and plowing of snow that clipped the mailboxes. There were also issues with snow blocking driveways. Unfortunately we do our best to clear the roads of snow somewhere and apologize for the inconvenience. Hittle stated you also have to consider the amount of snow we have got this year and we have to plow it somewhere clear of the roadways.
Hittle stated he has a list from the messages of mailboxes that need replaced. Maniaci stated we will fix or replace the mailboxes as soon as the weather breaks.
Maniaci wanted to address bidding of mowing township and cemeteries for this year. Last year we used Jerry Miller, Twin Hills Landscaping, and Jerry has indicated that he would hold the prices the same as last year if we wish to use him again. Maniaci stated that we are not required to bid this out if we don't want to and we would discuss more at our next meeting.
Maniaci indicated he would be attending the Ohio Township convention in Columbus on February 12th, 13th, 14th.
Maniaci stated we received a letter in mail from Frost Tree Service but trustees agreed that we would use someone locally if we need any tree services.
Maniaci stated he spoke with Ann Gildow regarding our new credit cards but she still hasn't responded. Maniaci is going to give her one more chance before we proceed elsewhere.
Maniaci presented and read 2013 Township Highway System Mileage Certification for Muskingum Township received from Ohio Department of Transportation. Total mileage for 2013 is 47.362 miles.
Maniaci stated that the annual back-flow test required by the health department has been completed.

Fiscal Officer presented trustees with 2014 Permanent Appropriation Budget based on the Amended Certificate of Estimated Resources from the County Auditor, as required by April 1, 2013, O.R.C. 5705.38.

Maniaci introduced Ms. Mollie Crooks, Muskingum County Commissioner candidate on the May primary election ballot. Ms. Crooks spoke to those on hand about her experiences, devotion to serving Muskingum County, leadership qualities, emphasis on like, trust and respect in your leaders, communication and working together with and among our leaders, jobs, grant funding, license taxes for bridge funding in response to questions from Mr. Dunfee and accessibility of Ms. Crooks, in comparison to our current officials, asked by Mrs. Cohagen. Ms. Crooks urged all to vote and emphasized her candidacy of committed to community and dedicated to service.
Maniaci opened for old business.
Mr. Dunfee, Licking Township, presented bill for an additional $96.98 for 2013 Vanderbark chip seal. The approved motion was made in the December 2013 meeting and waiting on documentation from Mr. Dunfee with the difference in what was applied from Matt Russell's calculation received.
Maniaci stated that we have procured another 50 ton of salt from Cargill and another 50 ton on stand-by if we need it and we have close to 300 ton of cinders and another 20 ton of salt available through the state. Maniaci motioned to approve $81 per ton of salt (up from $49 per ton) and another $1.50 per ton plus delivery for cinders. Hittle seconded, Fell ayed.
Maniaci made motion to accept Twin Hills Landscaping contract offer to keep current price of $464 per month for 7 months, $3,428 annual, for cemetery and township garage mowing for 2014. Fell expressed concern regarding mowing of other residences and Maniaci assured Fell that this contract and mowing is solely for said purposes and any other mowing would have to go through a separate bid and contract approval process. Hittle seconded the motion, Fell ayed. Roll Call: Maniaci ayed, Hittle ayed, Fell ayed.
Maniaci stated that our new credit cards from Century National Bank has finally arrived after the delay and shipping mix-up.
Maniaci addressed mail box replacement. Maniaci stated that after attending the state conference and sessions regarding mail box replacement policies, Maniaci recommended that the trustees look into proximity requirements by the post office, height, distance, dollar limit and developing and putting in place a policy within our own township policies.

Maniaci also wanted to state that his neighbor Chris Brauning's house was destroyed by fire and indicated that both the Zanesville Times Recorder and WHIZ reported that it took an extra 15 minutes to respond to the fire because the roads were impassible to his house and Maniaci went on record to say Chris's driveway was impassible and not our roads. Our township roads were clear and passable.
Maniaci indicated that Charles Mattingly will be retiring at the end of March and we will have a position opening. Maniaci presented copy of job description of maintenance worker for review and recommended that we should advertise the position out. Maniaci made a motion to advertise for the position and put out to bid in paper for maintenance worker. Hittle seconded, Fell ayed. Roll Call: Maniaci ayed, Hittle ayed, Fell ayed.
Maniaci presented to trustees a copy of old policies for review, prior proposed amendments that were not approved, and excerpts of a few specific policy changes that were approved in past minutes. Maniaci asked and to pay attention to the language, clarity and specific changes to propose that will be in place for current and future employees. Fiscal Officer Baughman indicated that the policies are not incorrect but vague and needs more clarity with trustees review.
Maniaci indicated after attending the state conference, in regards to emergency meeting situations, O.R.C. 121.22, there are exceptions to the need for an emergency meeting. The emergency meeting policy needs to be in the re-organizational meeting minutes. The re-organizational meetings and minutes are allowed to be amended any time during the year. Maniaci will present a resolution at the next meeting so we can amend and revise our re-organizational meeting to include an approved resolution covering our emergency meeting situation policy.
Maniaci also presented and discussed his discussions with micro seal for asphalt roads he received from the state conference and will discuss in more detail for all at our next monthly meetings.
Hittle indicated that while we discuss Charlie’s replacement we should look discuss the need for multiple part-time employees instead of one full-time employee, wage and benefit options and availability of the replacement during our most important times of need,
Mr. Dunfee asked trustees about Doug Davis utilizing motor paving and our township's interest. Maniaci stated we would have to look into it. Mr. Dunfee also asked if we dealt with any cemetery stone replacement issues. Mr. Dunfee also inquired as to who we used for our health and dental insurance. Fiscal Officer Baughman indicated we use Aetna for health under Rankin & Rankin and Dental insurance through Delta Dental under Wicert Insurance. Maniaci and Baughman also mentioned we explore for the best price and deal and are looking into Health Savings Account (HSA) which is very cost favorable for all.
County Commissioner Porter visited with the township and indicated that he has some opponents this year in his re-election bid as Muskingum County Commissioner stopped in to answer any questions, emphasized his 19 years experience as a township trustee and his current experiences as county commissioner. Mr. Porter answered questions regarding the license taxes proposed by Doug Davis. Mr. Porter stated he was not in favor of any new tax. The townships will get a portion of the $5 license fee. Mr. Porter stated that the county engineer department has a $4.9 million budget and only $200,000 has been going toward bridges. Mr. Porter also indicated that in regards to the license fee tax of $5, before any grant money is available from the state, we would have to utilize the full $10 license fee first before grant money would be available. The $5 license fee will get us closer to utilizing a full $10 license fee which would open up the availability of grant money for us.

OPENING: The Muskingum Township Trustees met in regular session April 3, 2014 at 7:00 p.m. in the Fire Building. All trustees and fiscal officer were present. There were 7 residents present.
The March 6, 2014 Regular Minutes were read and Maniaci motioned to approve as amended. Fell second, Hittle ayed.
Maniaci motioned that the trustees move to executive committee for the purpose of employee hiring. The following were invited to executive committee in addition to the trustees: Fiscal Officer Baughman. The following maintenance worker applicants were invited individually at a time: Bice, Jasper, Conkle, and Clements. Hittle seconded, Fell ayed. Roll Call: Maniaci ayed, Hittle ayed, Fell ayed.

Mrs. Cohagen indicated that she was glad to see progress being made on the 6415 Frazeysburg Property. Fell stated that the property was going up for sheriff’s sale and set for an auction sometime in May. Fell also stated that the prosecutor Jerry Earnhardt stated if we have any mowing claims on this property or any foreclosed properties to file the claims.
Maniaci stated that Mr. Charles Mattingly is retiring and last day was March 30th and wanted to thank Charles Mattingly for his years of services to our township and wish him a happy retirement. Hittle also reiterated the same sentiment and enjoyed working with him.
Maniaci read and motioned to adopt Resolution in accordance with ORC 122.22, to amend the Re-Organizational Policies for Muskingum Township. Emergency meetings can be held within 1 hour for emergency purposes only when immediate official action is necessary. In the event of an emergency, the member or members calling the meeting shall notify the news media that have requested notification immediately of the time, place, and purpose of the meeting. Jason Baughman, Fiscal Officer of the Township of Muskingum, Muskingum County, Ohio, certify that the foregoing is a true and correct copy of the resolution adopted by the township trustees on April 3rd, 2014. Mr. Ed Fell seconded the resolution with the roll being called upon its adoption the vote resulted as follows: Maniaci ayed, Hittle ayed, Fell ayed.
Maniaci stated we received a letter from ODOT regarding salt bids. The bids have to be turned in by April 8th. The old process was 80% of total tonnage. The new process is 90% total tonnage with 10% allowance for overage. Our minimum would be 180 tons now vs. 160 tons under the old process. Maniaci stated that in a year’s cycle we use about 220 tons. Hittle indicated the average per year is about 180 tons. Maniaci stated we have until December 31st to by 100% and then until May 31st to buy 90%/10% of the remaining tons. Hittle stated that of the 70 tons we currently have on hand we bought 50 tons with the other 20 tons we took from the state to be returned. The trustees agreed to go with a total of 180 tons for the ODOT bid.
Maniaci asked trustees about their follow-up with the township employee handbook. Fell inquired about full-time employee requirements and if we should identify full-time as 40 hours per week, 2080 hours per year or 30 hours per week, 1600 hours per year and in line with state of Ohio. Fell inquired regarding 8 hour work day that includes a half hour lunch vs. an 8 hour work day with a half hour unpaid lunch. Maniaci stated these revisions are made in the new draft presented to the trustees. Fell inquired about overtime rules and 40 hour work week. Maniaci indicated that he agree to the comp-time hours being included in determining overtime qualifications but not vacation, sick, and holiday time.
Mrs. Cohagen indicated that per federal labor laws that sick-time did not count in determining overtime hours and vacation and comp-time and even holiday are considered earned hours. As for accruals and carryover and paying out paid time leave upon termination of service is set forth by your policy. Hittle stated we can look at adjusting our policy accrual cap. Maniaci indicated that the draft presented to the trustees has most all of the revisions up for discussion and adoption.
Fell also identified defining call out pay. Baughman indicated that the policy states the work week of 40 hours includes Sunday through Saturday therefore there is no call-out pay and if so, this is unclear and needs defined differently.
Maniaci stated that one thing to think about moving forward regarding hiring additional drivers for our salt trucks is motivation and incentive such as better wage for perspective employees. Hittle stated that annually we are not going to have very many of these call out instances and should provide a good fair wage for these situations.
Fell inquired about safety, mileage, and fuel logs. Maniaci stated that when the trucks are take out the logs are performed. If they are sitting in the garage for the day they are not.
Maniaci stated once we put our notes together regarding the employee handbook we will incorporate the changes and finalize and approve the changes. We can consider a special meeting to finalize and put in place a soon as possible as we move forward to hiring the replacement maintenance workers.
Mrs. Cohagen asked about policies and procedures included in the handbook. This should be kept separate from the employee policy handbook.
Hittle stated that the Plunkett & Clooney case has been settled and the Township has no part further to play regarding this matter.

Maniaci stated that we did not receive a Fire and EMS run report at the time of the meeting and would provide at the next meeting.
Hittle stated that we have our new AEP badges for getting our own cinders.
In closing, Mrs. Cohagen thought the advertisement for maintenance worker effective start date April 1st and in the paper March 31st was interesting. Baughman indicated that he submitted the draft to CareerBuilder and the rep handling the account reduced the advertisement to it.

Jeff Schlaegel on Dutch School Road inquired about the Plunkett & Clooney Case with the trustees. Jeff's stated his property adjoins to the Dutch School Road property and he was not notified of the case. Maniaci stated we just received a letter indicated were listed as a party on the case and closing the road but we had nothing to do with it. Jeff stated that he was interested in the access and right away to his property. Hittle stated he would talk with Porter about this and see what can be done.

Mrs. Cohagen asked about call out pay and how it figured into the overtime hours in their forty hour week. Maniaci stated those 3 hours per the policy was outside of regular hours. Baughman clarified by stating that the call out pay is paid at whatever rate is in effect at the time they incur the 3 hours call out. However, the majority of the time the hours are earned outside of their regular eight hour day and falls into the overtime pay. Baughman indicated that this is one of the issues in the policy that he questions as the policy defines the work week as 40 hours beginning Sunday through Saturday and not per individual 8 hour days which conflicts with the definition of call out pay and how it is paid. This issue has been addressed and is defined in the new policy.
Mrs. Cohagen stated that she noticed that the Frazeysburg Road property has been cleaned up and the van is gone.
Fell asked about the Time Warner bills and why there was two separate billings and if we could get these combined. Baughman indicated that he met with Time Warner last year about the contracts and we are currently under separate contracts with different terms and periods. There is one bill for the Township and one bill for the Fire Department and is charged accordingly to the appropriate funds and has never been an audit issue.
Hittle stated that he spoke with Curtis and Mr. Bruce Russi at 3175 Fairview regarding replacement of his mailbox. Brock's Welding is repairing the mailbox and will be fixing it as soon as we can.
Maniaci stated that this instance and issues with mailbox replacement is an example of our need to develop a policy identifying what and how much is an reasonable amount that is allowed in replacement of mailboxes and that conforms with specific height, location, types allowed per state and federal regulations. Maniaci stated that the trustees would work on writing up a policy to put in place and adopted with a resolution.

Maniaci stated that we did not receive a Fire and EMS run report at the time of the meeting and would provide at the next meeting.
Mrs. Cohagen stated that Curtis has done an excellent job with patch work on Jones road, however at the end of Jones Road near Rt. 60 by the stop sign the road is caving in especially after this last rain we had and the trustees might want to take a look at it to see what can be done.
Fell indicated that he spoke with Curtis regarding a culvert on Melody Lane. The culvert wasn't draining and they can't find the end of the culvert and is needing fixed or replaced. Fell stated he spoke with the sewer department. The culvert was 60 feet from where it should be. Fell indicated to them it was there responsibility and cost and they should be replacing and not the township. Maniaci agreed.
Hittle stated that he spoke with gentlemen on Kenlo Woods about a plugged up culvert and we need to take a look at to fix.
Hittle stated with all the rain we have had here of late he has done a lot of checking of ditches around the township in particular Rollins, Vista and Northcrest and indicated that water looks to be flowing very good and has seen no signs of issues. Maniaci stated that this type of rain we have been having is not an issue and it's the heavy buckets of rain all at once that causes the problems with getting backed up and bigger culverts is not the solution but just keeping them clean and clear.
Maniaci stated he called the county regarding a damaged guardrail on Prior Road.
Hittle presented pictures he took of areas in the township with water flowing good with no signs of problems.
Maniaci stated that these pictures were areas of roads that we chip sealed and looks to be holding up very well.
Maniaci indicated that he spoke with Curtis about reducing our 400 ton of hot mix from last year to about 100 ton so we could focus more of our budget on chip seal and asphalt this year.
Maniaci indicated he believed that Schneider Lane is Cass Townships turn to chip seal this year and we did it the last time and it's their turn now.
Maniaci stated that we need to look at our miles for this year to chip seal and make a decision as to bidding it out or go with the county as they have historically came in better than anyone.
Mrs. Cohagen asked when the last time Schneider Lane was done with the culvert. Maniaci indicated 2 years ago and the road still looks good.
Mrs. Cohagen stated that the chip seal done last year on Jones Road has held up very well. Maniaci stated we patched about 100 ton which helped to hold up the chip seal.
Hittle stated that applying more patching on roads with slopes and hills helps with keeping the roads chip seal from breaking down.
Hittle stated he was looking at a product called rolled compacted concrete which is rated for 8000 PSI and is cheaper than asphalt. Muskingum Iron and Metal has it and is looking into some estimates.
Baughman stated he received a call from Bev Lamaster on Terra Shores and she indicated that she was in a near accident from another vehicle that tried to pass on Fairview Road and asked about dotted passing lines still on Fairview. I told her I would bring up to the trustees to get with Falls or the county about addressing Fairview Road. Hittle stated he needed to talk with the County about the sign on Creamery and would address Fairview also.
Fell stated he spoke to County regarding the ditch on Bellevue and they would look at it.

Maniaci stated the Employee Handbook Policy revisions and copies made. The definition of overtime & call out pay is addressed. Call-Out pay is time and a half with overtime pay paid for hours over 40 hour work week.
Maniaci stated the Fairview Road mailbox has been installed. The policy and resolution for mailbox replacement has not been completed to-date.
Maniaci stated that Hittle spoke with Commissioner Porter regarding the Clooney & Plunkett case for Mr. Schleagel and indicated the case is with the courts since the courts made the ruling.
Maniaci stated there is an issue with a slip in need of repair on Dresden Road due to a bank caving that they are working on and looking for estimates.
Mrs. Cohagen indicated due to the last rains the corner of Jones Road and Rt. 60 has caved even more since mention at the last meeting.
Mrs. Cohagen asked if Hittle had checked on culvert issue in Kenlo Woods. Fell indicated it was a clean out issue and Maniaci stated they would have to ask Hittle when he returns.
Mrs. Cohagen asked if any type of street sweeping agreement had been found regarding Fulton Lane and Schneider Lane. Maniaci indicated there was no agreement as for Fulton Lane. Mr. Jerry Miller stated in the past there was a winter agreement for these roads.
Fell indicated he spoke with sewer department regarding Melody Lane but hasn't heard back and is trying to get something in writing.
Maniaci stated he spoke with the county engineer’s office regarding the passing dotted lines on Fairview and they were not sure when and if solid non-passing lines would be done.
NEW BUSINESS:
Maniaci stated Fell and Hittle received call about a noise issue on Harper Drive. Per O.R.C. 505.172 the trustees can issue noise control only in the unincorporated areas of township, zoned areas or areas that have been issued a D liquor permit. Our township has none of these therefore there isn’t anything we can do.
Mrs. Cohagen asked how many and how insurance reimbursements were being paid; pre-tax or post-tax. Fiscal Officer Baughman indicated there are 2 on township insurance and he and Maniaci on reimbursement. Baughman indicated Mrs. Cohagen was referring to the Affordable Care Act and IRS notice 2013-54, O.R.C. 505.60 and stated the reimbursements were and have always been handled on a post-tax basis and in accordance with these provisions.
Maniaci introduced Zack Helm from Strauser Construction to discuss a new product called Onyx.
Onyx is a mixture of asphalt emulsion, fine aggregates, and polymers. Onyx is black in color and cost about $13,000 per mile or 1.25 square yard. Strauser is preservation experts in seals such as Micro Seal. Strauser manufactures the emulsion. Micro Seal is more expensive and has a 7 year life vs. Onyx which is a cost effective, low risk alternative that extends chip-seal road life approximately 30%, 3-5 years. Onyx can be applied to both asphalt and chip-seal roads. Approximately 5-6 miles of Onyx cost as much as 1 mile of asphalt. Onyx will hold up to salt, sand and cinders and not affect its life or wear. Onyx is applied on roads 2 sides at a time and has a 1 hour dry time in comparison to a fog seal that has a 23 hour dry time. Approximately 2-4 miles of Onyx is a typical spec to get the price to $13,000 per mile. Onyx has been in Ohio for about a year and mainly been applied in the Midwest. Mr. Helm indicated that he would be back in Muskingum County to talk more about the product to other local townships and county officials and look at our roads.

Mrs. Cohagen stated that she was disappointed the Fire Levy failed for the second time and lack of push from Falls Fire for the levy and stressed the need for the additional levy and for an emergency shelter for our township. In response to Mrs. Cohagen comments and question by resident in attendance, Maniaci stated we contract with Falls Fire & EMS to guard our township. We get a really great bargain for what we pay. Falls Fire & EMS is independent and not owned or operated by Falls Township. Falls Fire & EMS has 2 stations with 2 full-time staff at both Ritchie and Dillon stations. About 10-15 of our residents are on Falls Fire & EMS roster and with the levy we would have 2 full-time staff at our fire station.
Maniaci discussed roads for chip-seal, asphalt and putting it out for bid again. Maniaci identified the following roads having 10-11 miles each in need of repairs, chip-seal or asphalt: Squirrel, Dutch School, Stagecoach, Dresden Ct., Tiffany, McCassin, Applo, Harper, Saddlebrook, Virginia, Carolina, Saddlebrook, Tunis, Conn, Fawn, Stonehenge, and Melody Lane.
Maniaci indentified the following roads having 1-2 miles each that would be good crack-seal candidates: Lisa Kim, Chardon, Idlewood, Greens at Vista, and South View.
Maniaci made motion to accept bids for gravel and limestone used for chip-seal with right to accept or reject any and all bids. Fell seconded. Roll Call: Maniaci ayed, Fell ayed.
Maniaci stated that historically the county engineer department consistently beats any bids for chip-seal and made motion to keep the county engineer department for chip-seal of our roads. Fell seconded. Roll Call: Maniaci ayed, Fell ayed.

Maniaci stated he would talk with the county regarding the chip-seal roads and provide Fiscal Officer Baughman the bid notices and road specification for publication in the times recorder and include on the township website so sealed bids could be submitted and opened at or next regular monthly meeting on July 3rd.
Fell stated he would follow-up with Don Mattingly about the sewer department issue surrounding Melody Lane and sewer issues on Idlewood and Chardon road. Fell stated that the county has fixed the ditch issue on Bellevue.
Maniaci indicated he received a culvert request on Welch Road and would follow-up.
Maniaci indicated he followed up with Hittle about the culvert issue with Harper Road to Virginia Road property and issue of driveway vs. public right-away as designated by the county engineer. Maniaci didn't think the culvert would work and is a landscaping and grade issue. Fell agreed and didn't feel we should pay for since it is not a culvert issue.

Maniaci indicated that after meeting with Zack Helm from Strauser and looking at our roads good for onyx and crack seal have changed mind on the roads to consider onyx, crack seal, chip-seal or asphalt. Zack Helm indicated that Rollins, Oakwood North examples of best candidates for crack seal and onyx and others such as Virginia, Georgia, Carolina, Babes, are in bad shape, base problems, and just should chip seal them even if over asphalt.

Maniaci stated the mailbox referenced was on Jacks Fairway and not Fairview.

Hittle indicated might want to talk with Chris Mitchell. He has a process where he re-uses/re-melts asphalt and each pack gets 10 times / 75% stronger and we may look at some areas to patch with this process.
Hittle stated that he had looked into the roller compact concrete option mentioned at a previous meeting and is just too expensive to consider at this time.

Maniaci wanted to state for the record that he mistakenly used the township Century National Bank card instead of his when getting gas the other day and is presenting a check to Fiscal Officer Baughman to reimburse the $50.91 gas charge.

Hittle confirmed with Fell that there was nothing we could do regarding the noise issue on Harper Drive.
Hittle indicated he spoke with Doug Davis in regards to Cliff Murphy on Harper Drive and Mr. Murphy wanting to grade his driveway and build in culvert or box drain outside of his garage.
Hittle indicated that there is a culvert caving in on Hampton Court and asked Curtis to take a look at to see if it is repairable.
Fell indicated that the culvert on Melody Lane was cut in half and it is thee and replaced by the Fire Dept.

Fell indicated Mr. Hershberger needs a culvert replaced and would get with Curtis on this.
Fell indicated that Mr. Cotterman, Glenn Willow, has a mud issue that is filling up next to his house and there is no vegetation to stop it and need to take a look at it.
Fell indicated he received a call from Mr. Richard Greiner, Vista Apt., stating that he has had 3 emergency calls with an A.R.T. of 15 minutes. Maniaci stated that we could verify it with the run reports.

Hittle indicated that John Williams, Brother Brian Williams, wants to extend his culver with a piece of existing culvert he has. Curtis stated that the culver is rusted out. Hittle will contact Mr. Williams about the culvert options.
Fell indicated that David Hittle of My Drive wants to extend his culvert and add a basin. Not sure if he wants to do it himself or hire someone. Maniaci indicated we don't typically put basins in and he can do it as long as it is done right and not in our policy to put basins in.
Maniaci indicated that the handbooks has been delivered to trustees, fiscal officer and employees and will be in place.
Maniaci presented and motioned the following resolution, 7-3-2014 Mailbox Policy, If damages occurring from Snow Removal and other mishap's during Muskingum Township authorize work, and determined Township responsibility, said policy will be that the Township will administer up to $50 towards the purchase of an acceptable mailbox, installation not provided unless determined and approved by the trustees. Maniaci indicated that Mr. Schleagal won his case to keep his road open adjacent to his property.
Maniaci indicated that he spoke with Chris Zemba about Jones/Rt 60 culvert Mrs. Cohagen had addressed. Zemba is taking care of this by replacing the culvert.
Maniaci addressed Gorsuch Road guard rail issue. The right hand side of the guard rail came off. Trustees will look at the options and discuss with Curtis.
Maniaci indicated Stagecoach Road/Fulton Road prep work for chip-seal is half done.
Maniaci presented National Gas Easement. Hittle stated we just need to approve and is no rush as they are still waiting on Mr. Moore to release easement on his end. Maniaci motioned to approve easement. Fell seconded. Roll Call: Maniaci ayed, Hittle ayed, Fell ayed.
Maniaci spoke with Troy Balderson about getting some grant money to pave Ellis Dam Road. The estimate is about $43,000 and presented trustees with email correspondence requested from Troy.
Maniaci asked trustees if we want to decide on asphalt estimate of $110, 000 or any crack seal tonight if we can afford it and asked Fiscal Officer Baughman about funds available. Baughman indicated that he would have to look into it more but initial thoughts are that asphalt not in budget without reductions to other fund appropriations.
Maniaci stated that we could re-submit the bids for crack seal and have a special meeting to open the bids and accept or reject. Trustees agreed to hold Special Meeting to open and accept or reject crack seal bids on July 21, 2014 at 6pm.

OLD BUSINESS:
Hittle opened floor to residents in attendance; Mr. Jeff Schlaegel and James and Jody Fleming. Mr. Fleming stated he was owner of the Shannon Road property at end of Fawn Drive. Mr. Fleming indicated that they believe and have map that it is a township road. The home they purchased was built on the right away of the road that Mr. Schlaegel is wanted to use as an access road. Mr. Schlaegel indicated that the ruling by the court was reversed and the road is now back open. Mr. and Mrs. Fleming indicated that Mr. Schlaegel address/access road is Dutch School Road and concerned with maintenance of the road and responsibility of maintaining the road. Mr. Schlaegel wants to build an access/driveway road to his property. There is also an issue and dispute whether or not it is a township property, public road and a home built on a right away where in order for Mr. Schlaegel to build an access road to his property involves removal of a propane tank and a basketball court and retaining wall which is Mr. and Mrs. Fleming’s home. Hittle and Fell indicated that they would have to address with the commissioners and prosecuting attorney to see what can or can't be done and how to proceed and how Mr. Schlaegel and Mrs. and Mrs. Fleming to proceed with the road.
NEW BUSINESS:
Hittle stated 7.1 miles of chip-seal has been completed.
Hittle and Fell reviewed asphalt paving bids. Fiscal officer Baughman indicated that with the second half property tax and monthly revenues we have approximately $110K available. Fell motioned to accept Shelly Company asphalt bid of $34,626.10 for Melody Lane. Hittle seconded. Roll Call: Hittle ayed, Fell ayed.
Hittle read resolution 8-07-2014 Vista Drive, the board of trustees approve a letter of acceptance for Vista Drive and will accept as a plated road when all county road specifications have been met and presented to the board of Muskingum Township Trustees for approval. Baughman indicated that the easement for National Gas was notarized and mailed.
Fire Run reports were not available at the time of the meeting and would provide at the next regular meeting.
Fell addressed a call received about culverts on Gorsuch to Fawn Drive. Fell indicated that none of the homes have culverts. Fell indicate that the left side of the road has nice ditches however there is too much space between the road and ditches. Fell indicated that he would look into the issue some more and follow-up and discuss more with the trustees at the next meeting.
Fell indicated that he was looking into another culvert/road issue with resident on Weaver Road and would follow-up.
Hittle stated that the Hickory Hills Road issue with Mr. Cotterman and the homeowner wanting to put in a culvert was more of an issue with the 3 neighbors. Hittle and Fell indicated that they would get with Doug Davis about a resolution to this issue and discuss some options.
Hittle stated that he would get some estimates from Camm Construction and the infrared asphalt patching for the next meeting. Hittle also indicated that Brett Sidwell was interested in bidding our asphalt patching.

Maniaci opened discussion of road repair projects and presented estimates from CAMM Ashpalt Restoration, LLC for the following road repairs:

Clean all areas of debris, heat and rework existing asphalt, add rejuvenator and bring grade with fresh asphalt, roll and compact asphalt with vibrator roller for a welded seamless repair.

OLD BUSINESS:
Mr. Schlaegel addressed the trustees and Commissioner Porter regarding the Shannon Road property issue.
Mr. Schlaegel, the trustees and Porter reviewed the map of the Shannon Road and the property lines in question.
Mr. Porter indicated that the recent Shannon Road ruling by the commissioners was reversed as it was determined that as all adjourning parties involved were not properly notified. Mr. Schlaegel indicated that his attorney indicated the road on the property can be used as needed. Mr. Porter and Maniaci referred to O.R.C. 5547.01.03 – whereas the County Commissioners can rule on obstructions to a road if determined. Mr. Porter stated this is not a road or considering it a road at this time. Mr. Porter indicated since the road on the property has not been maintained, or by the Township, for a long time, a legal easement may be needed. Mr. Porter indicated the before any maintenance agreement is decided, the road on the property would have to meet county road specifications. An option to consider would be for the road to be abandoned and a maintenance agreement signed by the adjourning parties including Mr. Schlaegel. The Trustees and Mr. Porter stated that unfortunately at this time there is nothing that they can specifically do or rule on and although not responsible for arranging, they recommended Mr. Schlaegel to work on a compromise with the property owners and offered to assist Mr. Schlaegel with working on a compromise with him and the other property owners when they’re available.

Commissioner Porter asked the trustees about Schneider Lane motor pavement. Mr. Schneider expressed concerns with the road and requested a burn be put in. Mr. Porter and the trustees indicated that part of the road was Cass Township and would arrange a meeting with everyone to discuss the options.
Ms. Everson indicated she was opening a recycling business and inquired about zoning issues. Maniaci stated there were no zoning currently in Muskingum Township. Commissioner Porter indicated that the county was having issues with getting rid of their recycling due to the Marietta recycling center that was burned down recently.
Fiscal Officer Baughman presented “Then and Now” purchase order to the trustees for approval for the Fire Truck Payment of $42,722.67. Maniaci motioned to accept. Hittle seconded. Roll Call: Maniaci ayed, Hittle ayed, Fell ayed.
Maniaci indicated that the previously approved Vista Drive Resolutions 8-7-2014 from the July meeting required 3 signatures therefore Maniaci also approve the resolution, in addition to the previous trustee’s approval, and add his signature
Fiscal Officer Baughman presented the trustees with the 2015 Tax Budget for approval. Maniaci moved the adoption of the 2015 Tax Budget accepting amounts and rates determined by the Budget Commission in its certification and authorizing the necessary tax levies to the county Auditor.

Hittle stated that Camm Construction Asphalt Restoration agreed to the $3.75 counter proposed from the trustees and would like to look at Jacks Fairway with the trustees.
Fell indicated he spoke with Doug Davis regarding Fawn Drive property issue. Davis indicated and recommended chip seal options instead of installing a catch basin.
Maniaci stated he called Stubbins regarding the Eagle Point Drive properties mowing and was still waiting for returned call from Mr. Stubbins regarding getting these properties mowed again.
Maniaci indicated that the trustees would look at Melody Lane and the other roads to discuss the linear feet areas for Camm Construction Asphalt Restoration to begin work on.
Maniaci stated that Mr. Auchmyer, of Gregory Lane-Terra Shores, indicated the township buried a ditch and inquired on who was responsible for replacing the culvert. Maniaci stated he would look into the property address and discuss with the bank or owner of this property before proceeding with approval for any installation of the culvert.
Maniaci stated that he had no additional information on the Bunting Cemetery fence post issue. Maniaci and trustees were in agreement to proceed with fixing the fence post.
Hittle inquired about Winfield Circle pipe. Maniaci stated the pipe has already been pulled out and installed.

Maniaci stated that we need to discuss and make a decision on our new employee Troy Clements since the 90 day probationary period is done. Maniaci indicated Curtis would be off for approximately 6 weeks due to rotator cuff surgery.

BOARD OF MUSKINGUM TOWNSHIP TRUSTEES
October 2, 2014
PURPOSE OF MEETING:
The Muskingum Township Trustee met in regular session on October 2, 2014 at 7:00 P.M. in the Fire Building.
ATTENDANCE:
Trustees Mike Maniaci, Matt Hittle, Ed Fell and Fiscal Officer Jason Baughman were in attendance.
There were 3 residents in attendance.

The September 4, 2014 Regular minutes were read and approved.

Mrs. Cohagen asked about check to Zemba discussed. Maniaci indicated it was for dirt and not a culvert.
Maniaci introduced Linda Reggula, candidate for Muskingum County Commissioner. Mrs. Reggula has been resident of Zanesville for eleven years. She is president of the Zanesville Downtown Artist Colony. She indicated that there is a lot of grant money available that our county rarely takes advantage of. She is holding a free grant workshop that will show how to write and apply for these grants. She would like to see a wider distribution of tax dollars in our county and would have open round table meetings to allow townships to share ideas if elected.
OLD BUSINESS:
Maniaci indicated that he left a message with James Fleming and Mr. Schlaegel and has not received a return call from Mr. Schlaegel. Mr. James Fleming was ok with getting the property surveyed at their cost. Commissioner Porter presented and discussed a map of the property lines with the trustees he received from GIS. Mr. Porter indicated that other than the map he presented no other documentation from Mr. Schlaegel or his attorney could be found. In response to Mrs. Cohagen, Mr. Porter stated the Commissioners asked the court to reverse the previous court decision as Mr. Schlaegel was not properly notified. Porter indicated Mr. Schlaegels road idea would have to go before the planning commission and doubted that it would get approve without road frontage. Porter stated it would be difficult to move the easement unless a "public benefit" could be determined. The intent is to abandon the property and the township would have no responsibility. Porter deferred to Bud Chess to determine if this would be a new road or revised easement. Hittle indicated that the 3 landowners just need to compromise and agree to abandon and deed between themselves with a road maintenance agreement. In response to Maniaci, Porter felt getting an agreement from the 3 parties in writing before it is abandoned would be difficult. Porter stated hearings would have to be made available with the 3 parties to discuss. Maniaci indicated we need to remind Mr. Schlaegel of these options and that he is not landlocked, he may or may not get any access if a compromise can’t be reached with the parties and ultimately in the end we want nothing to do with the property and can just abandon it.
Maniaci spoke with Mr. Gary Miller regarding the slip repair on Dresden Road. Mr. Gary Miller didn't agree with the opinion of the trustees on how they were going to repair the slip by taking some trees out and tearing it all back. Maniaci asked Mr. Jerry Miller his opinion. Mr. Jerry Miller wasn't in agreement with it and not involving Gary in the planning of the repair and having Sidwell show up without representation of a trustee after four months since first bidding the repair. Mr. Jerry Miller stated another alternative would have to be determined without removing any trees on the property. Maniaci indicated without access to the property we will have to keep the ditch clean and do what we can from the side of the road. Hittle stated adding some pilings to help lock in the slip may be an option.
Hittle stated that CAMM Restoration asphalt repair work was in progress Maniaci presented additional estimates from CAMM for repairs to Jacks Fairway and Frame Road and asked about availability of resources to proceed. Fiscal Officer Baughman indicated we received our second half taxes last month and get another $10k to $12k per month in other funding and would look into and forecast available resources for remainder of year and follow-up with the trustees.
Hittle indicated that he did not see us on a list of approved salt bids in Muskingum County from Cargill. Muskingum County rate $72. Maniaci stated that we completed the paperwork during a meeting and approved it in the minutes earlier this year already.
Mrs. Cohagen stated that she noticed the Rt. 60 property was mowed again and inquired about the status of the property. Fell indicated he didn't see it come through the sheriff’s sale and other than being bank owned and lien on it from Medicaid would have to inquire on it.
Mrs. Cohagen asked about follow-up on our township Emergency Shelter and grants available we discussed several months ago. Maniaci indicated he was going to Mrs. Reggula's grant workshop and everything has been done with getting approved as a shelter and would look into it more including looking into a generator for the shelter.
NEW BUSINESS:
Mrs. Cohagen inquired about any requirements involving water lines and power lines being buried in a ditch. Mrs. Cohagen stated that a new water line up on a Jones Road property had been installed in the ditch. Hittle stated that the county did agree to it with Zemba including the proper depth of the lines to be installed.
Hittle stated he has a culvert/catch basin to look at on 5130 Manchester Drive.
Fell stated he received a call from Mark Neal about installing a culvert and inquiry about the project going on above the IBEW. Hittle indicated he heard it was going to be Lock n Store and unfortunately nothing we can do without zoning.
Fell indicated Troy mentioned we need to order some hydraulic fluid and that we were ok with it getting it ordered.
Maniaci indicated Curtis asked about the new employee handbook revisions and thought we had cut back sick days to much. He felt he should be grandfathered in and there be a reward for longevity and asked us to reconsider. Maniaci indicated he would make the revisions for the trustees to review and approve at our next meeting.

OPENING:
The Muskingum Township Trustee met in Special session on October 29, 2014 at 6:00 P.M. in the Fire Building for the specific purpose of asphalt road repair projects.
ATTENDANCE:

Maniaci opened discussion of road repair projects on Frame Road and Jacks Fairway.
Maniaci stated the trustees received an email follow-up from our Fiscal Officer Baughman indicating that we had available funds to proceed with the Frame and Jacks Fairway projects that we discussed at our last regular meeting.
Maniaci motioned to accept the following estimates from Camm Asphalt Restoration for asphalt rework and repairs:
Frame Road $5,036.25 (1,343sqft $3.75)
Jack's Fairway $7,890.00 (2,104 sqft $3.75)

Maniaci and Hittle indicated that Camm made a mistake when estimated the square foot work for Saddlebrook and ask for us to agree to the revised amount of 5,229 sqft vs. 4,900. The price per square foot remains the same as we agreed to at $3.75 per square feet. The difference is approximately $1,113.75. Maniaci motioned to accept the proper square footage from Camm Ashpalt Restoration. Hittle seconded. All ayed. Roll Call: Maniaci ayed, Hittle ayed, Fell ayed.
Mrs. Cohagen asked if this repair would hold with the current temperatures we are experiencing now. Hittle indicated that the rolled, compacted asphalt would set well into temperatures of 20's or 30's and we wanted to have this meeting to get approved and let Camm get started now.

NEW BUSINESS:
Chardon Road Construction: Maniaci opened floor to 3 residents in attendance from Chardon Road. Mr. Turner, Mr. Radcliff, and Mr. Dannemiller discussed the new construction of lock and store storage units taking place along Rt. 60 and Chardon Road and inquired with the trustees about zoning, prior approvals and indicated that their sub-division was part of an association and no one notified the association and residents of their association about this or for prior approval. The residents asked about any EPA rules as they expressed concerns about the installation of water waste and sewer installation and potential damage to the roads as they indicated that the residents and of the association had paid to have the roads asphalted of the subdivision.
OLD BUSINESS:
CAMM Asphalt Restoration: Maniaci indicated that the asphalt restoration is moving along and looks good. Curtis: Maniaci indicated Curtis has returned to work from his surgery. Generator Grant: Maniaci stated he has left messages and have not received returned call from Brian Hill regarding the generator grant. Dresden Road Slip Repair: Maniaci asked Hittle and Fell about pursuing the pylons on the Dresden Road slip or just keep it cleaned out for now and through the winter. The trustees agreed to continue to keep cleaned out. Salt Bids: Hittle indicated at the October meeting he didn't see us on a list he received of approved salt bids for Muskingum County. Maniaci contacted the guy and indicted we had submitted the completed bid paper work, approved resolution and proof of the emailed documents. The gentlemen stated he believed him however did not get the information and unfortunately all orders have been submitted and are closed. Maniaci contacted Cargill but they indicated they could not sale it to us directly either. Maniaci contacted other suppliers and
proposed we decide an amount to pursue now due to the first come, first serve basis. Fell motioned that we approve acquiring 200 ton at maximum price of $132 per ton. Hittle seconded. Maniaci ayed. Roll Call: Maniaci ayed, Hittle ayed, Fell ayed.
Maniaci indicated that he nor any of the trustees were notified prior to the start of construction nor would have any authority to do anything to prevent it due to the township having no zoning restrictions. Maniaci indicated that years ago, before any of the present board members time, a zoning committee was formed and the issue was discussed around the township. The zoning idea was rejected and never made it to ballot. Maniaci, Hittle, and Fell indicated that the association would have to pursue their legal options if so desired and the EPA issues would be handled by the BVA and may be a good route for their association to pursue.

Fire and EMS Run: No reports have been received at the time of this meeting. Falls Difibulator Grant: Maniaci indicated that Mark Brown of Falls Fire Department received a grant through FEMA for new difibulators. They can receive a $500 credit for exchange of old difibulator equipment and requested release of our used difibulator to them toward the credit. Maniaci motioned to approve the difubulator release to Falls for the $500 credit. Hittle seconded. Roll Call: Maniaci ayed, Hittle ayed, Fell ayed. Kenlo Woods Road: Maniaci indicated he received a call about Kenlo Road. Maniaci stated that we were looking at chip-seal this spring but would send Curtis to look at what repairs can be done at this time. Township Association gift: Maniaci indicated that in the past we have provided a gift for the meeting. Maniaci motioned to donate a $50 gift card from Bills BBQ. Fell seconded. Hittle ayed. Roll Call: Maniaci ayed, Hittle ayed, Fell ayed. Zoning: Fell received a call from Robinson Trucking inquiring about any zoning. Gorsuch Debris Removal: Fell received call about the house destroyed by fire on Gorsuch and debris removal. Fell indicated they should look at contacting the EPA for proper removal. Saddlebrook Patch work: Fell asked about status of Saddlbrook patch work. Maniaci stated Curtis and Troy was going to take care of this week. Employee Policy and Handbook: Maniaci read and motioned to accept the following resolution: #11062014 Employee Sick Hour Benefits (retroactive to June 1st, 2014):

North Vista Road: Maniaci indicated a received call from disgruntled resident about damage to their car due to the bad road conditions of North Vista Drive. Maniaci indicated this was a county road and not the Township. Chugg Run Road: Fell received a call from residents of and concern about Fire and EMS locating residents on Chugg Run Road and wanting to change the name. ATTENDANCE:

Fiscal Officer Baughman discussed with trustees the current month’s payroll as it relates to the revised township employee handbook.
Trustees and fiscal officer discussed and defined regular 40 hour work week, overtime hours, and call-out pay.
Fiscal Officer and trustees agreed that the policy we revised and adopted states call out pay is paid at time and one half with a minimum of 3 hours. Overtime is paid on hours in excess of 40 hours and holiday, sick, vacation hours do not count in determining the 40 hours worked and in calculating overtime hours.
FALLS CONTRACT AND MARK BROWN:
Maniaci stated he spoke with Mark Brown of Falls Fire as a follow-up to Mrs. Cohagen’s inquiry at the previous meeting.
Mark indicated that there was no truth to comment about wanting to drop out of our existing contract.
There was no truth to the board being split on this issue.
Mark did confirm that there have been steps made and surveys regarding a fire district.
Fell stated that there would be no benefit for Falls to back out or even consider dropping us from the contract.
LOWES GENERATOR GRANT:
Maniaci stated he stopped at Lowes to discuss with manager about looking into grants for a generator for our township. The manager told him that the main person there that handles these types of grants was off. Maniaci stated he would have to follow-up with him when he returns.
ANNUAL YEAR END INVENTORY:
The annual year-end inventory is complete. Fiscal Officer Baughman was updating our electronic copies and would forward to Maniaci to be filed with the county engineer.
TOWNSHIP WEB SITE AND FINANCIALS:
Hittle indicated that as was discussed and stated at the last meeting, financially we are in a good position and ahead of the years before and recommended we look at including more of this sort of good information on our website for our township to see our progress, that we are being diligent with our uses of funds and the trustees and fiscal officer have been working well as a team over the last few years. Maniaci and Fell also agreed and felt good at where we are financially versus what has been done versus what resources we have available to us.
$500 SAFETY (MORE) GRANTS:
Maniaci stated that the application for the MORE grant of $500 has been submitted and confirmation of and return receipt of the filing has been received.
DELTA DENTAL RENEWAL:
Fiscal Officer Baughman presented a renewal form from Delta Dental to be authorized to continue with Delta Dental insurance as our provider of the policy we procure for the township employees that are on the insurance.
