PURPOSE OF MEETING· The Muskingum Township Trustee held the regular monthly meeting on January 8, 2019 at 7:00 P.M. in the Fire Building.

OLD BUSINESS
ZANESVILLE COMMUNITY DEVELOPMENT GRANT:
Mr. George Helbling was in attendance to discuss the Zanesville Community Development grant for the Brownfield Properties. The Zanesville Community Development has $600,000 of grant money available for Brownfield Properties. According to the definition, the Helbling property would qualify for the grant. Mr. Helbling indicated that the county commissioners office is working on the paperwork for this grant for Mr. Helbling property and will be submitted Friday. Mr. Helbling will get the trustees copies of the paperwork as soon as completed.
NEW BUSINESS
BACKFLOW TEST:
Maniaci motioned to approved the annual backflow testing. Fell seconded.
ANNUAL LETTER CINDY ROGERS:
Trustees received annual letter regarding requirement for zoning. Muskingum Township currently has no zoning.

PURPOSE OF MEETING:
· The Muskingum Township Trustee met in special session on January 8, 2019 at 7:00 P.M. in the Fire Building for the purpose of the 2018 Re-Organizational Meeting.
ATTENDANCE:
· Trustees: Mike Maniaci, Matt Hittle, Ed Fell.
· Fiscal Officer: Jason Baughman.
· Residents: 2 resident in attendance.
Nomination of President:
Maniaci nominated Matt Hittle for President, Fell seconded. Hittle ayed.
Nomination of Burial Committee:
Hittle motion to have Mike Maniaci and Ed Fell on the Burial Committee. Maniaci seconded. Fell ayed.
Emergency Labor:
Hittle motion that emergency labor paid as following:$16.00 per hour with a CDL license and $12.00 per hour without. Fell seconded. Maniaci ayed. Roll Call: Hittle ayed, Maniaci ayed, Fell ayed.
Public Records Policy:
Maniaci made motion to adopt a change to our current township public records policy.Public records will be provided in a timely manner.Charge will be: first 10 copies free, $.10 per page, going rate of a flash drive or CD copy. Credit Card Policy:
Hittle made a motion to continue and accept our current credit card policy.All three trustees, fiscal officer, township maintenance workers will have access to the cards.The limits for all cards will be $150 per transaction. If over that amount, permission must be obtained by township trustees. Fell seconded. Maniaci ayed. Roll Call: Hittle ayed, Maniaci ayed, Fell ayed.
Township Equipment:
Hittle made the motion that the Township equipment can be operated by all road crew and trustees or any other person who has been authorized by the trustees or road crew to do so. Maniaci seconded. Fell ayed. Roll Call: Hittle ayed, Maniaci ayed, Fell ayed.
Annual Inventory:
Maniaci stated the inventory is complete and have received confirmation of receipt from County Engineer per O.R.C. 505.04. Hittle seconded. Roll Call: Hittle ayed, Maniaci ayed, Fell ayed.
Records Commission:
The Records Commission, according to O.R.C. 149.42 will consist of a Chairman of the Board; this being Matt Hittle and the Fiscal Officer, Jason Baughman will be the Records Commission. Hittle made the motion, seconded by Fell. Maniaci ayed. Roll Call: Hittle ayed, Maniaci ayed, Fell ayed.




Mileage Reimbursement:
Hittle motion that employees/elected officials who are authorized to use their private vehicles for township business such as conferences, training, etc. will be reimbursed at the standard mileage reimbursement rate established by the I.R.S. of 58 cents per mile which is allowable under the O.R.C. Township Meetings:
Hittle moved to keep the regular monthly township meetings the first Thursday of every month.Notice will be posted in the newspaper once, on the website and posted monthly on the sign in the front of the township. Special meetings will be posted on the website, sign out in the front of the township hall and newspaper at least 24 hours before the meeting. Fell seconded. Maniaci ayed. Personal Files Policy:
Hittle motioned to appoint the fiscal officer to have control of all storage and distribution of personnel files and information.All personnel files will be in a locked filing cabinet maintain request log, if there is a question of what can or cannot be released, fiscal officer is to contact legal counsel. Violation may result in written reprimand issued from the prosecutor’s office and could lead to termination depending on the situation. Fell seconded. Fell ayed. 2019 Temporary Appropriations:
Hittle motioned adoption of the Annual Temporary Appropriations Resolution for fiscal year December 31, 2019 (per O.R.C. 5705.38) until the Amended Official Certificate of Estimated Resources is adopted and received from the Office of Budget Commission, Muskingum County, Ohio. Carryover of $209,260.18, 2019 Estimated Tax $625,174.62, other sources $210,350.11 for total budget of $1,044,784.81. Temporary appropriations of 25% for total of $208,956 until permanent appropriation approved. Maniaci seconded. Fell ayed. Roll Call: Hittle ayed, Maniaci ayed, Fell ayed.
Township Insurance:

PURPOSE OF MEETING:
· The Muskingum Township Records Commission met on January 8, 2019 following the 7 P.M. Re-organizational meeting held in the Fire Building.

ATTENDANCE:
· Chairman Matt Hittle and Fiscal Officer Jason T. Baughman were present.
BUSINESS:
· Fiscal Officer Baughman stated that he had no records at the present time to get rid of.
· Hittle made a motion, that the commission has no records to discuss at this time and no records to dispose of at this present time.
· Fiscal Officer Baughman seconded motion, all ayed.
· All other records will remain as they are at the present time.

FEBRUARY 7, 2019
PURPOSE OF MEETINGThe Muskingum Township Trustee held the regular monthly meeting on February 7, 2019 at 7:00 P.M. in the Fire Building.

THEN AND NOW PURCHASE ORDER:
Fiscal Officer presented then and now purchase order for Shelly Company for asphalt paving of $131,493 for Baabs, Georgia, Virginia and Harper Drive. Hittle made motion, Maniaci seconded. Roll Call: Hittle ayed, Maniaci ayed, Fell ayed.
OLD BUSINESS
SALT BIN:
Maniaci indicated he spoke to county engineer and reminded him about getting out to us regarding our salt bin drawings.
LISA KIM:
Fell stated that there was a resident on Lisa Kim that had some water issues. Hittle indicated that he would discuss with her about her drainage issues.
STONE:
Fell stated that Curtis gave an estimate on needing 67 tons of stone.
HICKORY HILLS:
Fell stated that he spoke with resident on Hickory Hills regarding cleaning the ditch out that he was responsible for filling in. Fell hasn't been able to reach him to discuss. The trustees indicated they would send him a letter instructing him to clean out the ditch that he filled in that was not approved to do. It is the resident’s responsibility, or the trustees would bill him for our service to clean it out.
GEORGE HELBLING:
Fell presented the application for the Brownfield property grant he received from Mr. George Helbling. The grant has been filed.
ST. MARY'S:
Hittle mentioned that there is dip on St. Mary's road to fix.




ROSELLEN JENKINS AND JON SHIRER:
Hittle stated that Mr. John Shirer now owns all the apartments on Baabs Road and wanted to put a swale on Mrs. Jenkins way to help with the water. Hittle told Mr. Shirer that he and Mrs. Jenkins would have to agree to this as it is more a personal property issue. Mr. Shirer also wanted to thank us for all the paving we did down near his properties.
HARPER DRIVE:
Hittle indicated that there has been water laying on road and ditches overflowing on Harper Drive that they need to take a look at what could be done.
SALT:
Hittle stated that we received another 23 tons of salt. We are at our max on the state bid contract for salt and need to explore our Salt Bin options.
ZONING AND TRUSTEE CONTACTS:
Mr. Scott Durst ask about zoning or any other requirements for building a pole barn. There is no zoning in Muskingum Township. They referred him to Jason Baughman from the county regarding any county requirements.
NEW BUSINESS
MOWING CONTRACT:
Twin Hills Landscaping LLC presented estimate for township hall and cemetery mowing. The estimate was 7 months from April 15 to October 30, 2019 at $460 per month for total of $3,220. This was no increase from 2018 contract. Hittle motioned to accept estimate. Fell seconded. Roll Call: Hittle ayed, Maniaci ayed, Fell ayed.

DRESDEN ROAD:
Mr. Jerry Miller ask trustees about chip seal on Dresden Road and the slip repair. The trustees will put in their plans to look at chip-sealing our Dresden Road portion for 2019. They will also look at and get Curtis to repair the slip.
STONE:
Maniaci and Hittle indicated that we got a good deal on pricing for stone this year.
DRUG TESTING:
Maniaci indicated that both Curtis and Mark were selected for testing. Both passed.
GAS BILL:
Fiscal Officer Baughman will call Diversified Energy about our unusually high gas bill for the past month.
ROAD MILEAGE:
Trustees approved road mileage of 47.627 miles for 2019 certified by the county engineer. Maniaci motioned, Fell seconded. Roll Call: Hittle ayed, Maniaci ayed, Fell ayed.
CREDIT CARD POLICY:
Due to new Ohio Revised Code for 2019 regarding credit card policy the Maniaci presented new detailed 8-page credit card policy. The new policy is on file if anyone would like to read it in its entirety. Maniaci motioned, Hittle seconded. Roll Call: Hittle ayed, Maniaci ayed, Fell ayed.
EXECUTIVE SESSION:
Maniaci moved motion to move from regular session and enter into executive session at 8:20pm for the discussion of township employee personnel and possible disciplinary action. Invited into executive session with the trustees was the Fiscal Officer. Fell seconded. Roll Call: Hittle ayed, Maniaci ayed, Fell ayed.
EXIT EXECUTIVE SESSION:
Maniaci moved motion to exit executive session into regular session at 8:28pm. Fell seconded. Roll Call: Hittle ayed, Maniaci ayed, Fell ayed.
EMPLOYEE DISCIPLINE:
Maniaci motioned to sign and approve discipline action for one of the township employees. Fell seconded. Roll Call: Hittle ayed, Maniaci ayed, Fell ayed.

OLD BUSINESS
GEORGE HELBLING:
Mr. Helbling said that the final paperwork for the Brownfield grant will be ready Wednesday and wait to see how to proceed. Helbling indicated that the engineer originally turned it down. After speaking with the engineer’s office in Cincinnati, the criminal division of the EPA, EPA district out of Chicago, and the Brownfield department out of Columbus, the engineer finally approved.
GAS BILL:
Fiscal Officer Baughman indicated he could not get contact with Diversified Energy and he indicated that the gas bill was for multiple months and not a one-month bill. He will try to get in contact with gas company to inquire.
SALT:
Mark Border indicated that we have about a dump truck load of salt remaining.
HICKORY HILLS DITCH:
Fell indicated he still needs to get in touch with the resident on Hickory Hills about the ditch clean out.
LISA KIM:
Hittle indicated that the neighbor of Ms. Jenkins on Lisa Kim is now stating they have water issues we need to take a look at.
FEMA GRANT:
The County engineer estimated the slip repair on Dresden Road to be approximately $64,000.
Maniaci indicated he would take some more pictures of some of the areas we had wash out on Fawn, Cyprus, Hickory Hills, Vroom, and Prior to include in the FEMA grant. We will have to get exact locations and sites we are claiming.
The Fema grant meeting is scheduled to be on March 15th between 8am and11:30am.
CYPRUS:
Maniaci indicated that he is waiting on Don Madden to get out to look at the water issues on our road. There is a new construction and sewer project going on that may have created the standing water or a water line break that we need to have Madden look at.

NEW CONSTRUCTION:
Hittle indicated we need to have these new construction homes and contractors contact us or get something out to them to let them know of the guidelines for driveways, culverts and drainage before they proceed.
TERRA SHORES:
Maniaci indicated that the engineer looked at the pipe on Terra Shores. The pipe is not on township property and we have no right of way. Maniaci ask the county engineer to give us some guidance on this as to what we can, can't, should or shouldn't do with this.
STOP SIGNS:
Maniaci indicated that we have until August this year to get our new stop signs installed.
SPRING BANQUET:
Maniaci motioned to approve two $25 gift certificates for the annual spring township banquet as we have in the past. Fell seconded. Roll Call: Hittle ayed, Maniaci ayed, Fell ayed.
GARAGE DOORS:
Mark ask about approval of the garage doors. The trustees indicated that they have already been approved and the fiscal officer already cut the check and waiting on completion.
NEW BUSINESSCLOVER KEY:
Ms. JaMey Graves, owner of Clove Key was in attendance to discuss her new restaurant and how to pursue a liquor permit for her restaurant. The trustees explained to her some steps involved with how to apply and get the liquor permit on the ballot for vote.
MARK BORDER:
Mark indicated that he has passed his CDL. The trustees agreed to reimburse him for the cost of his testing and CDL license. Mark also inquired about increase in pay as we had discussed when hired that once he passes the CDL we would give Mark a raise.
ENGINEER MEETING:
Maniaci indicated that we need to schedule our meeting with the county engineer to discuss our road projects for this year. Maniaci will get with the engineer to schedule our meeting.
OHIO DEPT. OF AGRICULTURE:
Maniaci indicated that a gentleman from the Ohio Dept. Of Agriculture stopped buy and per ORC a government entity must have premises inspected, pesticide books and records and have someone license to spray. Maniaci will get with gentleman to schedule time and get someone licensed.
OTARMA:
Maniaci indicated according to OTARMA should keep pre-trip records and keep training records. We currently do this. We also can assign training on the OTARMA website to our township workers. We currently do this. The one thing we need to do is complete forms when traveling our roads to document stop signs, conditions of road signs at least once per month on every road of our township.
MUSKINGUM COUNTY PLAN & COMMISSION:
Maniaci indicated Commissioner Molly Crooks is holding an annual kickoff meeting is at 5:30pm on March 12th in the welcome center for the Muskingum County Plan & Commission. The meeting is to work on and update a comprehensive plan for Muskingum County.
PERMANANT APPROPRIATIONS:
Fiscal Officer Baughman presented the 2019 Permanent Appropriation and the Auditors Official Certificate of Estimated Resources. The total carryover from 2018 is $263,901.48. The 2019 budget from tax estimate is $835,524.73. Revenues from other sources total $210,350.11. The total budget for 2019 is $1,099,426.21.

OLD BUSINESS
CYPRESS COURT/LISA KIM: Maniaci discussed with trustees if we should discuss with engineer about doing some ditching for us on Lisa Kim or Cypress Court due to the water issues and road breaking up.
DEPT. OF AGRICULTURE: Maniaci indicated we still need to set up time with the gentlemen from the Dept. of Agriculture regarding the new spray law and requirements.
NEW BUSINESS
TIM SANDS: Tim Sands from Southeastern Equipment to introduce himself as the new area sales representative for Southeastern Equipment.
TERRACE SHORES: Mr. Shawn Ross was from Terrace Shores was in attendance to discuss with the trustees about the exposed pipe on Terrace Shores. Maniaci indicated that there are no records with the GIS Department regarding it being located in a township right of way or recorded deed. The property was given to the neighborhood association back in 1998 however the association had never recorded it and the trustees cannot go by it without it being recorded. Maniaci discussed extending the pipe, tie into the river and covering it up. Before we can do anything, we will have to discuss with engineer about making it an easement. The trustees would have to draw up an agreement and record it before we could do any work to it and finish it. Maniaci motioned to have the proper paperwork drawn up to fix the pipe to what needs to be done to fix the exposed pipe problem. Fell seconded. Roll Call: Hittle ayed, Maniaci ayed, Fell ayed.
POWER TAMPER/DRIVER: Trustees discussed purchasing a power tamper for Curtis and Mark to install the new stop signs. Maniaci motioned to allow up to $1000 to purchase the power tamper. Fell seconded. Roll Call: Hittle ayed, Maniaci ayed, Fell ayed.

SAFETY GRANT: Fell indicated we need to take advantage of the safety grant this year.
CEMETARY GRANT: Fell indicated that there is also a cemetery grant we may need to look into. Maniaci indicated that he didn't think we could qualify.
CDL: Maniaci and trustees discussed Mark and Curtis CDL license renewals and reimbursement.
PAYROLL INCREASE: Trustees discussed wage increase for Curtis and Mark. Maniaci motioned to increase Mark hourly wage from $15 per hour to $16.50 beginning in March. Hittle seconded. Roll Call: Hittle ayed, Maniaci ayed, Fell ayed. Maniaci motioned to increase Curtis hourly wage from $18.45 to $19 per hour. Fell seconded. Roll Call: Hittle ayed, Maniaci ayed, Fell ayed.
SPECIAL ASSESSMENT FUNDS: Trustees and fiscal officer discussed special assessment funds from Oakwood North and Hickory Hills. These funds are special funds and restricted. They have been on books for years. The fiscal officer will look into how and if we can use these funds or make available since the assessments are over and we no longer receive any revenue on the tax bill.
JONES ROAD: Fell indicated that Mr. Kyle Hood of 7035 Jones Road is needing a culvert installed.
BEAGLE HILL: Maniaci indicated he spoke with gentlemen of Beagle Hill about culverts. They have 20'x12' culverts for $114. They will deliver for free if we are not in a rush. All culverts ODOT approved materials. We need to get them a W9 and tax exemption form to start purchasing culverts from them.
SLIP REPAIR BIDDING: Trustees discussed Dresden Road Slip Repair to be bid. Maniaci presented estimate form county engineer for $69,881. The engineer has provided the bid specifications for bidders to use when bidding. The estimated completion date should be May 6th. The trustees will advertise in newspaper accepting bids for the repair. We will advertise for bids in the paper on April 8th, April 15th and hold a special meeting on April 22nd to open sealed bids. The bid documents will be on the website and available from the fiscal officer.

BOARD OF MUSKINGUM TOWNSHIP TRUSTEES
APRIL 22, 2019
PURPOSE OF MEETINGThe Muskingum Township Trustee held a Special Meeting on April 22, 2019 at 7:00 P.M. in the Fire Building for the purpose of opening Sealed bids for the Dresden Road Slip Repair.
ATTENDANCETrustees: Matt Hittle, Mike Maniaci, Ed FellFiscal Officer: Jason Baughman.Residents: 5 residents in attendance.
Maniaci indicated to the bidders in attendance that before the bid proposal was put out for bid there was an informal meeting with FEMA. Since the repair job was put out to bid FEMA has came out with some other requirements. Due to the other requirements we will not be opening bids this evening and will have to resubmit the bid and accept sealed bids at a later date and time. Maniaci indicated that a some of the new requirements that need included in the bid proposal for the bid to be FEMA qualified include: specific language welcoming bids from women and minority owned companies, logging conversations with bidders including women and minority owned companies, and will be a non prevailing wage job. The county engineer also had to make changes to the estimate as the previous estimate was not accurate. The trustees returned the unopened sealed bids back to the bidders. The trustees will resubmit the bid documents in the newspaper on April 26th, and May 3rd and update the website with the new bid requirements. The next regular scheduled meeting will be held on May 10th at 7pm. At this time the sealed bids will be opened.

Mr. Miller stated that he was not sure what exactly we are going to do the slip repair. None of the trustees discussed with his dad about the project. The engineer’s estimate and bid documents not specific to exactly how it would be done but only the materials needed. Miller indicated that the trustees should get a contract with Mr. Miller for access to his property for the repair work. Maniaci asked why Mr. Miller wouldn’t have called the trustees instead of the engineer if he had concerns. Maniaci indicated that the best answer to those questions would come from county engineer and the contractors bidding and the engineer should have been able to explain the project better than any three of us could have. Hittle indicated that he was not sure what he could tell you how the repair would be done as the Engineer and contractor would know a lot more how it is to be done than me. Fell indicated that we were waiting on the bids from the contractors before we can proceed with the next steps. Maniaci indicated that the trustees will draw up a contract with Mr. Scurlock for the repair work and contract with Mr. Miller for access to his property for the repair work. The trustees, Mr. Scurlock, the county engineer and Mr. Miller will get together to discuss what specifically will be involved in the slip repair work.




OLD BUSINESS
JONES ROAD:
Mr. Chris Gerber discussed right away on his property on Jones Road. He indicated that back in 2004 the telephone company installed some fiber cable along his property on Jones Road. He indicated trustees at the time indicated that they had no right of way. He indicated that someone from the county engineer ended up cutting the fiber cable so he could put in his driveway. He indicated that the county came out and cut back the ditch with the grader 4’. Maniaci indicate that the county was supposed to bring out the Gradall instead of the grader. He was concerned about whether the township had a right of way or not and concerned about the ditch, road damage from the water issues running on the road and potential liability with the telephone fiber cable that was cut years ago. He indicated that with all the building that is going on it is matter of time before they come back. Maniaci indicated that his property was sloped causing water to run off on our township road. Maniaci indicated that the responsibility of township trustees to keep the water off our road. As for right away we don’t know what we would tell the phone company if they ask about how much right of way. Maniaci indicated that the right of way can be whatever we deem necessary. Mr. Gerber indicated that Mr. Steve Baldwin was the attorney at the time and indicated that Jones road is not an established road and not a township. Maniaci read an attorney generals response to Mr. Baldwin indicating that Jones road is a dedicated township road since 1938. Mr. Miller indicated that Jones is the same issue as with Stagecoach as there isn’t a right of way as the county engineer cannot determine the center of the road. Hittle indicated we should send guys over Monday to take a look at Wetzel’s property to see what can be done since he is getting a lot of the runoff due to the county grading out the ditches.
WILSON LANE DITCH:
Fell indicated that can’t figure out that ditch on Wilson Lane. Guy claims water running over ditch. Fell indicated ditch looks fine.
CEMETARY GRANT:
Fell indicated has nothing new to report on with cemetery grant to date.
NEW BUSINESS
DITCHES:
Hittle indicated county engineer has all the ditches we want them to do. Maniaci indicated that they drove around with the engineer identifying what ones we wanted.
OAKWOOD NORTH:
Fell asked about the new cul-de-sac on Oakwood North and if it was our road. Maniaci indicated that the engineer will decide what to do with it when they are done and dedicate to us when its inspected.
CULVERT POLICY:
Curtis asked trustees about our policy on installing culverts for new houses.
Maniaci indicated we have only put a few culverts in. Those people came to us, they paid for the culver and we put in for free. Maniaci indicated we need new/revised culvert policy. Maniaci motioned culvert policy to be (a) they have to request for culvert, complete a request form for culvert, (b) they pay for the culvert (c) if we deem necessary we will put in for free (d) we have right to inspect and dig up culvert if not installed correctly (e)size requirements. Maniaci will draw up culvert policy and have for next meeting to approve. Forms will be on website and keep records of culvert installs.

CEMETARY GRANT:
Maniaci and Fell indicated that the township doesn’t run the township’s cemeteries. The township only maintains them. The cemetery grants are for real estate replacement and professional licensing therefore we doubt that we would qualify for any type of cemetery grant.
SLIP REPAIR:
Maniaci indicated that the slip repair is complete, and the road is open. The asphalt will be added in the next couple of weeks.
CULVERTS:
Fell indicated that the Fulton Road culvert is complete.
NEW BUSINESS
MARK NAUER:
Maniaci motioned to reimburse Mark Nauer $50 for reimbursement for his lost insurance due to hours worked for the township. Fell seconded.
HEALTH INSURNCE:
Maniaci motioned to accept Anthem Blue Cross Blue Shield as our current insurance and accept the renewal plan as proposed by Anthem until we can find a better option. The monthly premium has increased $915 per month. Fell seconded. Roll Call: Maniaci ayed, Fell ayed.
ELLIS DAM ROAD:
Fell indicated that he would get with Curtis about patching some holes on Ellis Dam Road and look into how to improve the drainage on that road better.
FAMILY FARMDAY:
Fell indicated that Becky Vansickle ask if we could do some mowing before the Family Farm Day on July 20th.
CHIP SEAL:
Trustees indicated that they decided not to chip-seal Prior and Cranberry.
GREENS AT VISTA:
Maniaci indicated received a call from resident on Jacks Fairway about hole in front of resident’s driveway. Trustees will send Curtis out there to put some cold patch in there to repair for the time being.
WILSON LANE:
Maniaci indicated Curtis went over to repair a hole on Wilson Lane and is complete.
DRESDEN ROAD SLIP:
Maniaci indicated that there is another slip repair on Dresden Road that we need to look at. He is waiting on an estimate before Scurlock moves his equipment as we might be able to get it repaired also.

MR. FRANK CIGOLE:
Mr. Cigole of Cassies way thanked the trustees for the salt spreader this past winter instead of using sand and cinders.
Mr. Cigole ask about continued use of salt on Cassies Way. Hittle indicated we will continue to use salt on Cassies Way and we have discussed a new salt bin. We have looked into some estimates however we are waiting on the county engineer to draw up plans before we can proceed any further. Estimates for salt bin are approximately $75K-$80K.
Mr. Cigole ask about pot holes on Creamery Road. Hittle indicated that this is a county road and Matt Russell at the county engineers office would be best contact regarding this.
Mr. Cigole asks about patching some holes on Tunis. Hittle indicated that we would look into getting this repaired.
Mr. Gigole asks about Jones/Cassies Way on patching some holes. Hittle indicated that we would look into getting this repaired.
Mr. Cigole inquired about a 3 way stop due to all the traffic on Jones and Cassies way due to the temporary road closure of Northpointe for paving.

MR. LUKE DAVIS:
Mr. Luke Davis was in attendance and indicated to the trustees as he is running for Tri-Valley school board this November.
LOCAL GOVERNMENT MONEY 2020:
Hittle motioned to accept the county auditors official certificate of local government monies for 2020 of $9,036.60. Fell seconded. Roll Call: Hittle ayed, Fell ayed.
DITCH ON JONES ROAD:
There is a ditch on Jones Road that the trustees will have Curtis look at.
FAWN DRIVE DITCH:
Hittle indicated that Maniaci had a ditch to look at on Fawn Drive for a Mr. Houston. Hittle motioned to fill the ditch with rip rap and Mr. Houston would pay for the remaining cost to repair the ditch. Fell seconded. Roll Call: Hittle ayed, Fell ayed.
CURTIS INSURANCE:
Curtis expressed concern with our current health insurance provider Anthem Blue Cross Blue Shield. He indicated that the they pay nothing for him. There could be problems with them as to who is primary and secondary insurance for Mr. Salmons as his spouse also has insurance. The trustees indicated that at the present time that Anthem Blue Cross Blue Shield is our best options until further quotes for pricing and coverage can be obtained.
CURTIS OPERS:
Curtis expressed issues with his OPERS account that need fixed before OPERS will give him any retirement information. Fiscal Officer Baughman has not addressed the issue at the present time and will get with OPERS to fix the issue for Mr. Salmons.
MANCHESTER:

OLD BUSINESSFRAME ROAD:
Maniaci indicated he spoke to Curtis and Mark about extending the pipe on Frame Road. Maniaci suggested extending the pipe to the woods above ground just to see if it helps at all with the water issue and see if it dries up and if we can actually get in there to repair and bury the line.
BILL HOUSTON:
Maniaci indicated Mr. Houston purchased 3 18" pipes and ask if we would be ok with installing them and he would take it to the end. We have already approved the stone to put in instead of the pipes as originally talked about. Fell indicated if we do then it is his responsibility. Hittle indicated we don't want to set a precedent for this stuff. Maniaci indicated two options. Option 1 is to install just one pipe up to the first joint and Option 2 would be just install the stone. Mr. Houston claims that if we divert water on personal property it is our responsibility which Maniaci disputed. Maniaci indicated its not affecting our roads. He claims we have caused more water on his property. Maniaci argued and disputed Mr. Houston's argument. Maniaci motioned to approve one of the two options. Fell seconded. FEMA GRANT:
Maniaci indicated that the FEMA Grant application for reimbursement of the Dresden Road slip repair is ready to submit.
HOUSTON INSURANCE:
Maniaci spoke with Houston Insurance regarding Mr. Helbling and if we decided to do something with his property. They indicated no one can sue you for sending a letter. We are only requesting Mr. Helbling cutting down weeds. We have right to do that. They referred us to someone from OTARMA. We should send a 35 day notice to cut down noxious weeds to Mr. Helbling. Maniaci motioned to send letter. Hittle seconded.

SALT BIN:
Maniaci indicated that he spoke with Shawn Johnson about the salt bin. He is working on it. Apparently Cass Township also is looking at one with the engineer. They bid it out and got zero bids. Apparently it was too light. He indicated that we may get more bids if we bid the salt bins out at same time. The rough estimate is approximately $125K for foundation, concrete floor and metal top instead of the dome top. He indicated would have specs by October meeting and bid information. We can bid now and to be installed around April 2020. At the present time we are waiting on final plans. We can ask the commissioners to waive the fees for the building permits and fees on the salt building. Maniaci motioned to draft letter to waive all the applicable building code fees. Fell seconded.
SADDLEBROOK AND BRIDAL TRAIL:
Maniaci indicate that Crawmer estimated $28K for patching and estimated $86K for both Saddlebrook and Bridal Trail with us digging out all the bad spots and he coming in with 2 inch asphalt. Maniaci indicated regardless we will have to do patching ourselves and put out to bid.
FIRE DEPARTMENT BILLING:
Fell indicated that Falls is turning people in for collections for non paid bills. Fell presented proof of collection letters from Falls Township. Fell indicated that they aren't staffing as indicated. The trustees would address with Falls Fire Department.
NEW STOP SIGNS:
Maniaci indicated that the extension has been filed to get the new stop signs installed.
NEW BUSINESSCULVERTS:
Maniaci stated that he needs to talk with Curtis regarding Lisa Kim culvert and catch basin.
Fell indicated Hazen has not paved on the Brentwood where they cut the road. Fell will follow-up.
Hittle indicated Lisa Finnell ditch needs looked at.
FUTURE PAVING:
Maniaci indicated that he started process of trying to figure out how to pave all our paved roads. He is trying to figure out way to pave all our roads in 2 shots, taking loan and making payments on. The more mile would increase the amount of bidders and better pricing.

MR. GEORGE HELBLING:
Mr. Helbling was in attendance.

The Brownfield grant is for the buried property.
The trustees indicated that all we are asking Mr. Helbling to do is mow the grass.
Mr. Helbling indicated the township is responsible for the ditch.
The trustees disputed that the ditch is not the townships.
Mr. Fell indicate that the drainage ditch is the county ditch per the engineer.
Mr. Helbling indicate the park and playground is in the corporation name.
Mr. Helbling indicated the property is in his mothers estate name.
Mr. Helbling indicated that the mowing is the township problem even though he states the trustees cannot mow the property.
Mr. Helbling indicated that the county has the authority to turn property over to the township.
Maniaci indicated that they didn't.
Mr. Helbling said they don't have to because the township already owns it.
The trustees restated to Mr. Helbling that all we want is the grass mowed.
Mr. Maniaci indicate the law says he has to mow at least 2 times per year.
The trustees indicated that they will talk with Mr. Helbling's attorney.

OAKWOOD NORTH:
Fell indicated that the pipe on Oakwood North that was installed has now been paved/patched by Hazen and is complete.

Maniaci indicated that we have no new information or estimate for the salt bin.

Maniaci indicated we may bid this year for spring/summer 2020 installation.
SADDLEBROOK:
Maniaci indicated that we would get with Curtis about patching work on Saddlebrook.

LISA KIM:
Maniaci spoke to guy on Lisa Kim regarding catch basin. There is no catch basin there. Maniaci indicated we will have to install catch basin and run 40 feet of pipe. The resident Sean Denton will send $340 for the repair.
WELCH ROAD:
Lisa Finnel ditch on Welch Road is done.
FRAME ROAD:
Maniaci indicated not sure yet if the pipe on Frame Road is working since it's been so dry. We will send Mark down to check on to see if it's working and keep an eye on.
CEMETARY FENCE:
Maniaci ask about cemetery fence install. Trustees will follow up with Strauss.
MCCASSLIN ROAD:
Maniaci indicated we need to have guys look at McCasslin Road ditch.
FEMA:

NEW BUSINESSSCOTT AND BETSY RITCHIE:
Mr. Ritchie indicated that sign on Jones Road is missing. Mr. Ritchie wanted to thank the trustees for using salt on Cassies Way this past winter.
Mr. Ritchie ask about buying adjacent property and what his rights are as to putting in proper drainage. Hittle and Maniaci indicated that he has right to run drainage as long as not to interfere with neighbors property. Maniaci indicate there is no law to run drainage into our ditch. FALLS FIRE DEPT/CHIEF JOHNSON:
Chief Johnson provide update on various items.
Maniaci indicated that Ed has indicated that some members of our township is still receiving bills and turned into collection.
Mr. Johnson stated they use a third party billing company out of Granville.
Mr. Johnson indicated that as long as he is chief we do not turn people in to collection or will not turn into collection and will address the problem.
Mr. Johnson indicated that he is working on additional reports for us to indicate how much is insurance pay and how much is self pay in the Townships we serve.
Fell ask about a report that indicated how much staff and hours are being worked in our township.
Mr. Johnson indicated we are about 80-85 percent mark on staffing.
Mr. Johnson indicated that volunteers are down and it is hard to find new volunteers or payed employees.
Mr. Johnson indicated that there was a fire at club view apartments and there was 3 staffed here at Muskingum
Mr. Johnson indicated that he met with ISO insurance offices that gives our fire department a rating. He indicated that 5 years ago to today some changes that have been made include automatic aide, 5 or 6 different zones. They are looking at a rating of 5 to 5x rating which is good and helps with insurance cost.
Mr. Johnson will send a list of surplus, antiquated equipment for the trustees to review and see what we can do with it or dispose of it somehow. We can either dispose of it, donate it, or put up for public auction.
BEECH RUN ROAD:
Maniaci indicated that Matt from engineer office sent quote for Beech Run Road.
DURMEL ROAD:
Hittle indicated we need to have Curtis look at ditch on Durmel.
TAX BUDGET:
Fiscal Officer presented tax budget approved by budget commission and county auditor estimated tax rates for the tax year 2020 for approval. Amount approved inside 10 mil limitation $378,049.81. Hittle indicated that he received a nice compliment about our mowing of roads.

Hittle indicated that we should look into Ritchey Bros. auction for the salt bin canopy.
SADDLEBROOK:
Maniaci indicated that patching on Saddlebrook is complete.
LISA KIM:
Maniaci indicated Lisa Kim catch basin work is complete.
FRAME RD:
Maniaci indicated the Pipe on Frame road is complete.
CEMETERY FENCE:
Maniaci indicated Strauss Fence installed fence for $3,777.00.

NATIONAL GAS:
Hittle presented permit from the National Gas & Oil Cooperative to install 2" plastic gas main along Chardonn Road for the trustees approval. Maniaci seconded. Roll Call: Hittle ayed, Maniaci ayed, Fell ayed.
HITTLE ISSUES FROM RESIDENTS WHILE CAMPAIGNING:
-Culvert to look at on Snider and New Riley Road.
-Dr. Balogh - there is drop off on New Riley road to fix
-Culvert plugged up across from Andy McCarty on New Riley
-Vern Dor - was ask about when we were going to pave Vern Dor
-Slate Ridge Road - got questions about chip seal that road, Hittle stated that can't do anything until approved by engineer and commissioners and road turned over to township. Jamie Slate needs to discuss this with engineer before we can do anything. Maniaci indicated that the residents need to look at the deeds before they purchase these lots for language regarding the roads and chip seal and asphalt
-Welch Road - people asked why are we chip sealing road and not paving
-Richvale Road signs - Hittle spoke to county for them

OLD BUSINESS
MR. WASSON/PRIOR ROAD DITCH:
Mr. Wasson ask the trustees if they would clean out the ditch on Prior Road. Trustees indicated that we asked our workers to do it but apparently they haven't been out to clean it out. The trustees will get this taken care of for Mr. Wasson.
Mr. Wasson indicated that he has a CDL and may be interested in working if there was an opening or if we were looking for some additional help. Trustees will get Mr. Wasson an application.
FEMA GRANT:
Maniaci indicated that the delay in FEMA funds is because FEMA is stating that Dresden Road Slip repair was normal wear and tear. Maniaci is going through the prior minutes and will go through time cards and checks to detail out our maintenance history on Dresden Road so he can prepare a letter disputing FEMA's normal wear and tear claim and provide them with are maintenance history on Dresden road slip repair.
SALT BIN STORAGE:
Maniaci indicated that he turned in the letter for the salt bin fees and he is still waiting to hear back from the county engineer and Cass township about bidding out the salt bin storage building.
FALLS TOWNSHIP MEETING:
Maniaci indicated that Chief Brady stated his meeting on 11/25 was rescheduled to 12/16.
SAFETY GRANT:
Fiscal Officer provided Maniaci bills to use in applying for our 2019 $500 safety grant.
NEW BUSINESS
POWELSON ROAD:
Hittle indicated that Ed Kenily on Powelson Road had new driveway installed and culvert and concerned with water ponding up. ODNR is concerned with EPA issues and told Mr. Kenily to get with the township. Maniaci indicated it was a county road and not township road.


AUDIT EMAIL:
Fiscal officer indicted the email regarding the audit has been taken care of. The audit for 2018-2019 was awarded to Wilson, Phillips, Agin CPA's.
OTARMA INSURANCE vs. BONDED:
Maniaci indicated that newly elected officials can be bonded or sign up for insurance through OTARMA. Officials no longer need bonded and have these two options. Insurance provides more protection than the bond.
REVENUE BUDGET:
Fiscal Officer indicated that he submitted a supplemental revenue budget due to the increase in revenues received in 2019 and is waiting on county for another 2019 amended certificate of estimated resources.
MOWING BIDS:
Fell indicated that we need to look at advertising for mowing bids early in February.
END OF YEAR MEETING:
Trustees scheduled the End Of Year Meeting for December 30th at 7pm.
RE-ORG AND REGULAR MEETING:
Trustees scheduled the Re-organizational, records commission, and January regular meeting for Monday January 6th at 7pm.

Fiscal Officer Baughman presented the revised 2019 Permanent Appropriation and the Auditors Official Certificate of Estimated Resources. The revised revenue budget increased $99,517.21 The total 2019 budget as amended totaled 1,198,943.42. Hittle motioned to approve. Fell seconded, Maniaci ayed. POWELSON ROAD ED KINILY:
Hittle spoke with County Engineer, ODNR looked at issue, Kenily indicated that the culvert was installed too high and is going to take care of it in the spring.
FEMA:
Maniaci indicated that he was submitting evidence of our maintenance records to FEMA to support our argument.
SAFETY GRANT:
Maniaci submitted the $500 safety grant to OTARMA.
SALT BIN:
Maniaci indicated nothing new to report on salt bin.
FALLS FIRE/EMS BILLING:
Maniaci indicated that Chief Brown indicated after his meeting with the billing company that as of December 16th there should no longer be any verbiage on billing that indicates that non-payment will be turned into collection.
NEW BUSINESS
SECURITY CAMERAS:
Maniaci indicated that he is looking into estimates on security cameras for our township facility.
PRE-TRIP LOGS:
Maniaci indicated we need to make sure the guys are preparing and turning in the pre-trip logs. Fiscal Officer indicated that he receives these annually.
SAFETY TRAINING:
Maniaci indicated that we need the guys to do more training. He will put together training to get to the workers to do more frequent.
EQUIPMENT REPAIR TIME:
Maniaci indicated after looking through years of time-cards to support his argument to FEMA he indicated that we are spending too much time on equipment repairs. We need to change this going forward and look at getting estimates and sending these repairs out instead of our workers spending time on these repairs. We wouldn't have had to extend our stop sign installation two times if we weren't spending this time on equipment repairs.
RECORD KEEPING:
Maniaci indicated that the workers need to detail their work time better on their time cards. We need to get them a daily log books or a calendar to detail their time better.
WORK SCHEDULE:
Maniaci indicated that we need to be stricter regarding our guys work schedule. The workers need to have a mandatory schedule time with breaks and lunch time.
TIME OFF REQUEST:
Maniaci indicated we need better documentation and notice of time off request.
COMP TIME:
Maniaci indicated we need to look at and discuss comp time. We need to determine if we want to pay it out vs. allowing the guys to bank the time. Either way they earn it and will get paid but banking the time off affects our ability to get stuff done in the summer months.
CALL OUT:
Maniaci indicated we need to watch the call out time and the guys need to work independently and don't always need 2 guys on call out at same time.
CURTIS:
Maniaci indicated that we need to have Curtis give us an update on his retirement situation so we can plan for his replacement. All signs point to Curtis retiring. It doesn't look like he will be working as he has vacation and sick time coming the first of the year and he probably will be taking this up and to his retirement date and probably is done working. We just need to have him get us something firm so we can proceed with his back up and replacement.
EMPLOYEE DISHONETY INSURANCE THROUGH OTARMA:
Hittle motioned to approve Employee Dishonesty Insurance through OTARMA for newly elected trustee Hittle and Fiscal Officer Baughman for the new term. Maniaci seconded. Roll call: Hittle ayed, Maniaci ayed, Fell ayed.
BILL STIEL CONSTRUCTION:
