BOARD OF MUSKINGUM TOWNSHIP TRUSTEES
DATE: January 1, 2012
PURPOSE OF MEETING: Re-Organizational Meeting
OPENING: Muskingum Township Trustees met in special session at 9:00 a.m. on January 1, 2012 for the re-organizational meeting in the Fire Building. Trustees Mike Maniaci and Steve Fusner and Fiscal Officer Jerri Salmons were present. Matt Hittle was absent due to being out of town. There were 5 residents present.
Steve Fusner nominated Mike Maniaci for Chairman, Maniaci seconded. All ayed. Maniaci nominated Steve Fusner for Vice-President, seconded by Fusner, all ayed.
Maniaci made the motion to have Matt Hittle and Steve Fusner on the Burial Committee. Seconded by Fusner. All ayed.
Maniaci made the motion to keep the emergency labor at $8.00 per hour unless they have a CDL and then they would be paid $10.00 per hour. Seconded by Fusner. All ayed.
Trustees Maniaci and Fusner tabled the cemetery mowing discussion until February since they have no estimates at this time.
Steve Fusner made a motion to increase the road crew workers Curtis Salmons and Charles Mattingly’s pay rate by $.25 per hour. Salmons would increase to $15.50 and Mattingly to $13.50. Maniaci seconded. All ayed.
Mike Maniaci stated that according to the public records policy, public records will be provided in a timely manner/or the next regularly scheduled meeting. That there will be a written request advising what records is requested. The charge will be $.05 per page and $2.50 for cassette tape copies. There will be no free copies made. The handbook will be amended at the next meeting. Fusner seconded. All ayed.
Maniaci passed a credit card resolution stipulating who has township credit cards, who uses them and how much can be spent.

All three trustees and Fiscal Officer will have access to the Capital One Visa Card, Tractor Supply and Lowes. The limits for all cards would be $150.00. If over that amount, permission must be obtained by trustees. Fusner seconded.
Maniaci made the motion that the Township equipment can be operated by all road crew and trustees or any other person who has been authorized by the trustees or road crew to do so. Fusner seconded. All ayed.
Maniaci made a resolution to have the health insurance premiums and trustees salaries taken from the road and bridge fund and also the general fund. The trustees will use the new “Payroll Certification” form which indicates a percentage of how much time was spent in the service of the Road and Bridge Fund and the General Fund. This resolution allows for the health insurance premiums and salaries to be partially taken out of the road and bridge and general fund. Fusner seconded. All ayed.
Trustees were also in agreement to approve the temporary appropriations until the permanent appropriations come into effect.
Maniaci stated that the public records policy is posted in the township hall, the township garage and both fire stations.
Mike Maniaci made a resolution to nominate J.D. Johnson as the Fire Prevention Officer for our township. He would assume all official duties according to O.R.C.505.38. Fusner seconded. All ayed.
Maniaci stated the inventory will be completed next month and then submitted to the County Engineer within the next two weeks.
The Records Commission, according to O.R.C. 149.42 will consist of a Chairman of the Board; this being Mike Maniaci and the Fiscal Officer, Jerri Salmons will be the Records Commission. Maniaci made the motion, seconded by Fusner. All ayed.
Maniaci made the motion that employees/elected officials who are authorized to use their private vehicles for township business such as conferences, training, etc. will be reimbursed at the standard mileage reimbursement rate established by the I.R.S. of $.50 per mile which is allowable under the O.R.C. Fusner seconded. All ayed.
Trustees agreed to keep the record keeping policies that are in place now, the same as in the past. Which are according to the handbook we have. Fusner seconded.
Maniaci moved to keep the regular monthly township meetings the first Thursday of every month at the township fire station at 7:00 p.m. That is will be posted in the newspaper once, on the website and posted monthly on the sign in the front of the township. Any changes or special meetings will be posted on the website, the sign out in the front of the township hall at least 24 hours before the meeting. Fusner seconded.
In regards to “Storage and distribution of personnel files and personal information”, Maniaci appointed the fiscal officer to have control of all files. Fusner seconded. All personnel files will be in a locked filing cabinet at the township building. There is to be a written request specifying what type of personal information people want. Fiscal Officer was informed that he/she is responsible for all the rules adopted in accordance with these section and will show trustees the requests made; they can sign off on the request which will show they are monitoring the accuracy of the requests. If there is a question of what can or cannot be released, fiscal officer is to contact legal counsel, Bud Chess. If above rules are not followed a written reprimand could be issued from the prosecutor’s office and could lead to termination depending on the situation. Maniaci made the motion to accept this procedure. Fusner seconded.
Maniaci made the motion that the Fiscal Officer will keep a copy of all records requests. Fusner seconded.

FEBRUARY 2012 Regular Meeting.

DATE: February 2, 2012
PURPOSE OF MEETING: Regular Meeting.
OPENING: The Muskingum Township Trustees met in regular session on February 2, 2012 at 7:00 p.m. in the Fire Building. All trustees and fiscal officer were present. There were 18 residents present.
The minutes of the December 27, 2011 meeting, Re-Organizational Meeting Minutes of January 1, 2012 and the Records Commission meeting minutes were read and approved.
Checks approved and signed for payment.
Todd Sands who is a candidate for County Commissioner and Carol Friel candidate for County Treasurer were present at the meeting and also spoke briefly.
Maniaci made the motion to go into executive session for item #4 which reads: Reason for executive session preparing for conducting or reviewing negotiations or bargaining sessions with public employees concerning their compensation or other terms and conditions of their employment. He also wanted to invite the two township workers, Curtis Salmons and Charles Mattingly to go into executive session with the trustees. Steve Fusner seconded. All ayed. Roll Call: Maniaci ayed. Hittle ayed. Fusner ayed.

Maniaci motioned to put into place the Annual Appropriation Resolution by reading the resolution.

Lynn Sellars asked about the closing of the Muskingum Township Fire Department mentioned in previous minutes. Maniaci stated he thought it was mentioned in previous minutes and he was wrong.
Thelma Cohagen asked about filing charges of the fire department missing equipment. Maniaci advised we are waiting for Falls Twp Fire Chief to provide him an accurate list.
Thelma Cohagen also inquired about the letters to homeowners when debris needs to be cleaned up around their residence. A certified letter was sent out to the resident on Creamery Road and it was received on February 1st. He has 7 days to comply before we can clean it up and assess his taxes.
Cohagen asked about the status of Northern Place. Maniaci advised that Mr. Tanner will be taking care of it himself.
Lynn Sellars had questions about the 2008 fire truck. Also about minutes being recorded correctly when they have been said in the meeting. Maniaci informed her that he spoke to the prosecutor’s office in regards to everything being put into the minutes and Maniaci was informed that basically what the township trustees say needs to be recorded accurately and put into the minutes and what the people in the audience say can be summed up and does not need to be printed word for word. In the future if we do not believe it needs to be done word for word we are just going to make mention of it that it was brought up in a meeting and not print things word for word.
Tom Huey wanted to say Thank you for putting the meeting dates and times in the paper. Maniaci advised he would come to Mr. Huey’s house and discuss the old fire department.
A female resident thought it should be put on the ballot where we want our tax dollars to go in regards to the fire department.
Maniaci asked for a vote of who were for and against the fire department:

Maniaci had a print of the truck signs which will be in the shape of our township and 10 x 20. Maniaci made the motion to purchase six signs at $24.00 each. Hittle seconded. All ayed.
Maniaci did accept for Zemba Brothers to work on the slippage on Dresden Road. Work is done and looks good.
The telephone line on Chug Run Road has been taken care of. The phone line pole has been fixed.
Fusner asked if Maniaci had talked to the resident on Gorsuch Road about his culvert that is up out of the ground. Maniaci advised he had not done that yet.
Maniaci asked about anything from the R&L Trucking. Fusner advised he has not heard anything back from them yet.
Thelma Cohagen asked why the minutes were removed from the website. Maniaci stated they are still available like always, and a lot of people were taking information off of them for the wrong reasons to use against the trustees so it was decided to remove them.
Cohagen asked about a newsletter to the residents. Trustees stated yes they are, but will review the O.R.C. before doing so.
Maniaci read the run sheet for the month of January from Falls Township Fire Department.

Thelma Cohagen inquired about the pavement on Jones Road breaking up.
Maniaci stated there is culvert that is sinking on Welsh Road. Encased in concrete on both ends of it. It is heavier than our backhoe can handle by itself. Maniaci did have Zemba’s give an estimate to remove it. No reply back from Kendrick’s Excavating. Zemba’s bid was almost $4,500. Trustees did have a meeting with the County Engineer and they talked to him about having them work something out with their workers to take it out and our guys can replace it. Or if they could bust the headwalls off of it, our guys could take care of it. It should be able to be taken care of without outside help.
Maniaci advised that the salt bin roof is leaking on the back side. He spoke with Chris Mitchell, contractor and he asked if we had contacted our insurance company because it is due to wind damage. He stated for a very low price he would go up on the roof and repair it so it will quit dripping until we decide if we want to replace the roof. Matt Hittle advised he will look at it and take care of fixing it. Curtis Salmons said the whole roof does not need replaced, just the few shingles replaced. Hittle said he can do it.

MARCH 2012 Regular Meeting
BOARD OF MUSKINGUM TOWNSHIP TRUSTEES
DATE: March 1, 2012
PURPOSE OF MEETING: Regular Meeting.
OPENING: The Muskingum Township Trustees met in regular session on March 1, 2012 at 7:00 p.m. in the Fire Building. All trustees and fiscal officer were present. There were 11 residents present.
The minutes were read and approved.
Checks were approved and signed for payment.
Maniaci informed the residents that the Attorney fee for the lawsuit against Steve Fusner and Jerry Miller totaled over $44,000.00. Our portion of that fee due by the township is $6,688.00.
Thelma Cohagen asked about the property on Creamery Road. Trustees advised that the property owners are working on it at the time. Property owner did speak with Matt Hittle in regards to burning some items, and Hittle advised him that he could. Fusner stated there are other properties in our township that need attention. That he went to a class at the township conference in regards to “Abatement Control and Removal of Vegetation, Garbage Debris and Refuge”. Ohio Revised Codes 3767.41 and 505.87. They advised to take dated pictures and pass a resolution for this section.
Thelma Cohagen asked about the missing fire department equipment. Maniaci received a list from Chief Johnson. He informed Maniaci that all missing gear and radios have been turned in according to the list we had. The only thing he is pursuing at this time is the missing projector, door lock system and personnel files.
Thelma asked if the salt bin roof had been repaired yet. Hittle advised no it has not, but will be soon. Maniaci advised we do have insurance to cover damage to the roof.
Maniaci advised that the signs for the trucks are in and look good.
Maniaci stated in regards to the truck from R&L trucking that was in Kenlo Woods and did road damage, did reply back to our letter asking for reimbursement. They informed trustees they will not pay for road damage because drive was in a housing development making an in-home delivery and there was no other alternate route available. Fusner did call R&L back and left her a message advising we would be following up with our prosecuting attorney. He will also send a letter to R&L’s insurance company.
Maniaci also advised when we had our sub-driver working on Conn Road spreading salt, he was hit head on by another vehicle. No injuries. State Patrol came and a report was made. Insurance Companies have been contacted. Curtis did get estimates. There was damage to front bumper and fender. One quote he did get back was for $3,600. He is awaiting two additional quotes.
Maniaci spoke with Becky Mock Vansickle, Phil Mock’s daughter, in regards to Stagecoach Road. She stated the person on the other side of the road purposely planted pine trees on the edge of the road. And as they grow, every time we chip and seal or do something it is always being pushed over onto her property. She did cut the trees down on that bank. She thinks that he should be made to take those trees out and let the road go back over where it started out. They spoke to the engineer about it and they were going to send someone out to look at it. Maniaci did speak to him today, and they did send a guy out and they are questioning where the right-of-way line is and where the middle of the road belongs. They are pursuing it at this time.
Maniaci said in regards to culvert on Gorsuch Road that he did speak to the wife of Chris Luthi and she advised that one section of it is really bad. She stated her husband would take it out and put it back to a ditch. Maniaci will pursue this if he doesn’t see any action in the near future.
Brian Williams had an issue the trustees need to take care of dealing with lined fences. He was advised by the recorders office at the courthouse that one of his adjoining neighbor’s fences is reversed. Looking at your lined fence, your neighbor is responsible for the right had side. If he looks at his, it is the same way. It needs to be recorded in the courthouse, because as it stands right now it was just a gentleman’s agreement made many years ago. Williams’ neighbor is in agreement and will sign a paper stating this. Fusner advised it may have to be submitted to the trustees in writing. Fusner said he will get with Williams so they can go look at the fence.
Don Clark said the trustees need to contact Brady Johnson and see if they can get scored. His insurance agent said we are still at the old ISO rating. Maniaci said these are steps that Falls Township Fire Dept must take. Maniaci stated they must rate and evaluate all 3 stations at one time and he will find out how long before this can be done.

Thelma Cohagen and others advised they would like to have the minutes back on the website. All three trustees agreed. Maniaci will put them back on.
Don Clark asked about getting the end of Powellson Road swept. Maniaci will call the engineers office and check on this.
Maniaci discussed a new type of mixture called micro-seal, he thought might be good for our township that he seen while at the township conference. It is harder than asphalt and water doesn’t penetrate as well through it. It would be approximately $30,000 a mile. The cost of chip and seal is around about $7,000 a mile. So it would be around $37,000 for this type of road. He feels it is something we should look into this. This should last approximately 6-9 years and is only good on certain roads. Two representatives from this company will come to our township the week of March 12 and ride all of our roads and assess and rate them. At the meeting in April they will present us with a proposal as to what they can do for the budget that we give them.
Mike also spoke with a Company rep from HEI-WAY in regards to cold mix. They will deliver 22 tons for a minimum of $87.55 a ton. MarZane charge $90.00 a ton. Sidwells price is $110.00 a tone and we had to get it. This company did offer us 20% off our first load. All trustees agreed to try this company, they will deliver it. Maniaci made the motion to accept this bid. Hittle seconded. All ayed. Roll Call: Maniaci ayed, Fusner ayed, Hittle ayed.
Trustees had an open meeting in regards to roads, with the engineer at the Welcome Center. He gave them an agreement to sign in regards to roads because of the Shale Company and overweight permits. This agreement would allow them to monitor and use permit fees for their monitoring. It would be both theirs and our agreements when the roads got put back, that everybody would have to agree that the roads were in shape. Trustees are not signing tonight, because it is being re-written. It will be ready next Friday and will look at it at the April meeting for signing.
A letter was received from the County Engineers office stating that the amount of road our township must maintain is 47.175 miles.
Last year we did chip and seal with the county and Maniaci would like to make a motion to continue that again this year to let the county do our chip and seal. Hittle seconded. Roll Call: Maniaci ayed, Fusner ayed, Hittle ayed.
Maniaci said that last year we bought our own limestone for the chip and seal, which we bid out. He wanted to make a motion to put the stone, pea gravel and limestone, out for bid again. He will get a letter of requirements to the fiscal officer to put in the paper for up to 1,500 ton of gravel. Maniaci made the motion to bid out the stone for chip seal. Hittle seconded. All ayed. Roll Call: Maniaci ayed, Fusner ayed, Hittle ayed. We did approximately 11 miles of road last year and used 4 tanks of emulsion. We paid for 3 tanks and county paid for 1 tank from left over issue 1 money. Maniaci made the motion to do approximately 11 miles of chip and seal. Hittle seconded. All ayed. Roll Call: Maniaci ayed. APRIL 2012 Regular Meeting
BOARD OF MUSKINGUM TOWNSHIP TRUSTEES
DATE: April 5, 2012
PURPOSE OF MEETING: Regular Meeting.
OPENING: The Muskingum Township Trustees met in regular session on April 5, 2012 at 7:00 p.m. in the Fire Building. All trustees and fiscal officer were present. There were 8 residents present.
The minutes were read and approved.
Checks were approved and signed for payment.
Bids for gravel and limestone were opened. 1 bid received from Shelly Materials. $19.35 per ton for limestone and $13.75 per ton for gravel. Difference in cost based on 1200 tons bid was $5.60 per ton or $6,700.
Maniaci made a motion to accept bid for gravel at $13.75 per ton. Fusner seconded. Roll Call: Maniaci ayed, Fusner ayed, Hittle no.
Bids for lawn mowing were opened. 3 bids were received.
Twin Hills Landscaping bid was $3,710, $530 per month for 7 months. Muskingum River Lawncare, Colbie Kensie, Dresden, Ohio bid was $3,500, $500 per month for 7 months. One bid was thrown out due to not being received in non-sealed envelope as required per bid proposal requirements. Mrs. Sellars ask why trustees weren’t looking at the one bid. Maniaci stated due to not being sealed bid and risk of being tampered with we have to throw it out based on bid proposal requirements. Mrs. Sellars ask if we take the lowest bid. Maniaci indicated we take the lowest and best bid. Hittle made motion to accept the lowest bid. Maniaci second. Roll Call: Maniaci ayed, Fusner ayed, Hittle ayed.
Maniaci opened up for old business. Mrs. Sellars asked if we still have the following Township equipment: International, 1988 Chevy 4x4, 1994 Ford Tanker, 1979 Red Tanker and 2001 Yukon. Maniaci stated we still have this equipment. Mrs. Sellars ask if equipment was kept at Muskingum Township. Maniaci stated equipment is here and Yukon stays mostly at Falls Township. Fusner said Falls leaves squad at our township. Maniaci said Falls is allowed to use vehicles as they need.
A Female resident asked about clean up of properties and mentioned old shell station and if health department was contacted about the contents still remaining inside. Fusner stated this property was on our list and trustees weren’t aware of the contents still remaining inside. Mr. Benson stated it was owned now by Huntington Bank. Fusner stated he would follow-up on this property.
Mrs. Cohagen stated property on Creamery Road, owned by Mr. Hallack, was not much better and asked trustees if there was a time frame when property was to be cleaned and suggested another follow-up. Fusner stated next letter will indicate more specific nuisance and cite Ohio revised code pertaining to trash and vehicle clean-up.
Mrs. Cohagen asked about property next to Green Tea Room. Fusner stated prosecuting attorney recommended trustees contact sheriff’s department regarding removal of vehicles. Mrs. Cohagen also referred to the property South of Bogeys for clean-up.
Mrs. Cohagen asked about the salt bin roof repair. Maniaci stated insurance looked at it and we received the check. Maniaci has received one bid from Chris Mitchell, Camm Construction Services. The roof has 3 tab shingles, which are not the best and Camm recommended 3 dimensional shingles which are better. Bid was for $4,800. Mrs. Cohagen asked about getting bids for steel roof vs. asphalt shingles. Fusner stated Higgins previously talked us out of the steel vs. asphalt due to the sweating and salt. Maniaci stated we can look more into the asphalt shingles vs. the steel roof before decision is made.
Mrs. Cohagen asked about follow-up on the Kenlo woods property damage. Fusner stated he has not followed-up due to not knowing name or address to contact. Mrs. Cohagen stated to contact PUCO to obtain name and address to contact. Fusner stated he would do so.
Mrs. Cohagen asked about insurance claim and estimate on damaged truck from accident. Maniaci stated truck in process of being finished this week. Insurance had obtained 3 estimates which they settled on $3,600 estimate. $700 has been spent so far with this repair and will be finished this weekend.
Mrs. Cohagen asked about culvert on Gorsuch Road. Fusner stated we need to move on this as nothing has been done and Maniaci stated the resident has been given deadline of this meeting to get something done and if it wasn’t the Township would come and take it out for him.
Mrs. Cohagen asked about Brian Williams’s fence issue. Fusner stated Mr. Williams has not contacted him about this to-date. Fusner will get with Mr. Williams on this.
Mrs. Cohagen asked about contacting JD Johnson about fire department rating. Maniaci stated he has contacted JD Johnson and JD indicated Muskingum and Falls Township’s Fire Department are about 1 year apart on how they figure the rating and he is trying to get both somewhere in the middle so he can get both departments rated at same time. No exact time frame was given, maybe within 6-8 months, not guaranteeing it.
Mrs. Cohagen asked about minutes and updated Fiscal Officer Information on web-site. Maniaci said he would work on it this evening.
Mrs. Cohagen asked about Powelson Road. Maniaci stated he talked with Donny and he said it’s not something they are doing this time of year but would make a point when they get their brush out to brush off that corner for him.
Mrs. Cohagen asked about meetings on shale drilling. Mrs. Cohagen stated most township were present except ours. Maniaci stated Muskingum Township Trustees were present at the first meeting they were invited to. Mrs. Cohagen stated each meeting was different. Maniaci stated according to engineer first meeting was for the township officials to get on board and second were for businesses. Fusner stated he was at meeting in St. Clairsvile that was the same as one at welcome center. Mrs. Cohagen indicated a lot of good information presented about township roads and what county was doing about obtaining good contract and what state wasn’t doing. Fusner stated Ohio Township Association is working on RUMA (Road Use Maintenance Agreement) and everyone is working on putting these contracts together. Hittle stated the meetings were run by Steve Strauss. Maniaci stated commissioners are not involved with these meetings except for Steve Strauss. Fusner stated our secretary of Township Association is second Vice President of Ohio Township Association and keeps us updated.
Mrs. Cohagen asked about Vista View Road issue. No knowledge of a petition raised to-date. Maniaci stated he has not talked to Lepi but has talked with Dave Smith about it. Maniaci stated he would also try to make contact again. Maniaci said Zemba’s estimate was approx. $110-120K and county’s estimate was approx. $80K without double chip and seal. County revised estimate with asphalt for approx. $100K. Estimates were over year ago and will need to be revised. Maniaci stated a petition has to be obtained with 51% brought to trustees before we can proceed or obtain right-away agreement. Fusner stated South View has been most paved road since he has been trustee and is very bad and continues to roll. Maniaci stated a revised agreement has been received by county engineers with a sample of road repair/maintenance agreement. Maniaci presented it to trustees for review.
Fusner said Micro Seal was not present tonight due to wife illness and would be at May meeting.
Maniaci read letter from Muskingum county engineer’s office regarding Old Stage Coach Road. The letter indicated research regarding Old Stage Coach road has found no established right away with for this road. The existing right away is considered what is necessary to keep the road safe and efficient for the traveling public and does not allow for widening the road. Based on these finding and discussions with Muskingum County prosecutor office the only way to legally widen any portion of this road would be to acquire property or easement from adjoining land owners first. This can be accomplished with an easement document. Maniaci stated we are back to square one and need to talk with property owner who planted trees to chop them down.
Maniaci opened for new business.
Mr. Benson asked about missing equipment discussed in minutes and discussions with JD Johnson. Mr. Benson stated when department was dissolved the doors were locked and changed unbeknownst to the members and does not know what was there or not after the locks were changed. Mr. Benson stated he did not understand why trustees would take Mr. Johnson word and judgment instead of Mr. Benson’s staff regarding the inventory. Maniaci stated it wasn’t judgment. Maniaci stated minutes were meant to portray was a list of gear that we had record of and not accounted for. Maniaci asked Mr. Johnson for a list of inventory recovered and Maniaci compared this to his list of missing equipment. Maniaci stated only the projector and door lock system have not been returned but no gear. Maniaci didn’t ask Mr. Johnson about the projector and door lock and only about the missing gear.
Mr. Benson stated he received some anonymous information about Mr. JD Johnson. Mr. Benson stated Mr. Johnson had been terminated from his position of employment which is a private fire service entity and raises a question about Mr. Johnson receiving our township tax levy money, access to, and how used. Maniaci stated Falls has a board that makes these decisions and votes where money goes.
Mr. Benson stated he received a phone call from a person from same fire station regarding Mr. Johnson’s termination. Mr. Benson did a Google search on Mr. Johnson to follow-up with this information received. Mr. Benson Google search stated Mr. Johnson had been arrested for indecent exposure in Big Walnut Park in May 2008.
Mr. Benson mentioned that in the past as fire chief he had brought to Muskingum Township two names, Tyler Starling and Mark Lewis, to be approved. Their background check was clean but was denied joining fire department due to attitude and poor disposition. Mr. Benson asks if any investigation was done with any members of Falls Township fire department employees before contracting with them. Maniaci stated he can only speak for himself and said he did not. Fusner stated he did not. Mr. Benson stated he would have thought the trustees had done due diligence on Mr. Johnson and held Mr. Johnson to same standard as was done with our own members. Mr. Benson offered all paper work he has to trustees and recommended trustees to investigate Mr. Johnson public records and charges.
Mr. Benson stated he contacted trustees’ employers about policy regarding similar circumstances surrounding Mr. Johnson’s termination and employer’s stated circumstances would be grounds on termination. Mr. Maniaci asked Mr. Benson who he spoke to and Mr. Benson said he agreed to anonymity and Maniaci stated Mr. Benson statement is conjecture because Mr. Benson wouldn’t reveal names and no proof of the conversation.
Mrs. Cohagen stated she understand Mr. Benson’s concerns and motivation but doesn’t understand why he is bringing these questions to our trustees when this should be brought to is Falls Township’s Fire Department board who employs Mr. Johnson. Mr. Benson stated he is concerned with our fire levy money of $111K being given to Falls with a man in charge convicted with indecent exposure. Mr. Hittle asked Mr. Benson if Falls Fire Department board have a policy where background checks are done. Mr. Benson did not know. Mr. Maniaci asked Mr. Benson if he would turn his records over to trustees. Mr. Benson stated he found it strange that Mr. Johnson was convicted in 2008 and later terminated in 2012. Mr. Benson asked if trustees would do an investigation and have Mr. Johnson at next meeting for more answers.
Maniaci said he understand Mr. Benson’s reports in writing however Mr. Benson’s information regarding Mr. Johnson’s termination is what he heard from a friend of his in the fire department. No actual proof other than someone else’s word. Mr. Benson said he called human resources of rural metro, out of Tennessee, to confirm Mr. Johnson’s termination.
Maniaci stated the township did not hire JD Johnson personally to run matters but Falls Township Fire Department which is run by a board. Maniaci stated trustees would look into this matter and make a request for Mr. Johnson’s attendance. Hittle stated we can’t guarantee JD Johnson attendance. Maniaci thanked Mr. Benson and said trustees will look into this.
Mrs. Cohagen asked about competitive bidding threshold. Fusner stated this was increased September 2011 to $50K. Fusner said we still should get competitive bids and Maniaci stated we intend to bid strictly to keep amount we pay and get the best service we get.
Fusner indicated Shelly Company gave us estimate last year on McCasslin road and will still honor estimate. Maniaci stated trustees already accepted the bid last year for the $18,960 bid. Maniaci stated he spoke with Kevin West about the alternate bid for Harper Drive. The Harper Drive alternate for $5,400 was not decided at time and still will honor the price. Fusner stated Northern Place, when their ready, one of trustees or Curtis should be present to make sure soft spots are dug out to and taken care of.
Fusner stated he spoke to Rob Thompson about Oakwood 3 getting this done this year. Fusner stated he would follow-up.
Fusner stated the high grass on Vista View drive owned by Dot.com investments and another letter needs sent identifying nuisance law and Ohio revised code, vehicles 505.871 and 3767.41 for inhabitable places, public menace. They have 7 days to reply before we can decide on mowing. Fusner to get addresses for letters to send.
Fusner stated he received phone call regarding Woods Road. This road was changed to McCasslin road years ago and no one knows why. According to ODOT it should be Woods Road. Mrs. Sellars ask Fusner about previous discussions with resident not wanting road name changed. Mrs. Sellars stated there is an ORC regarding if one person doesn’t want changed it has to be left alone. Fusner stated all county maps and on our inventories indicate Woods Road. Bud Chess will let us know about this change and all details that will affect this.

Maniaci ask Mr. Benson follow-up question – do you have any idea where projector is? Mr. Benson stated he did not know. Maniaci stated sheriff will probably pursue the missing inventory.
Mr. Benson asked about Yukon being used by Falls Township. Is there any discretion on how they can use it since it was purchased by our township funds? Mr. Benson said he has seen it at Buffalo Wild Wings, West Pike McDonalds and all over their township. Mr. Benson stated it was purchased for our township and not Falls Township. Maniaci stated Falls is a subcontractor of our township. Mr. Benson asked for our township to contact Falls to be more discretionary about the use of our township’s vehicles and hold them to a higher standard. Maniaci stated Falls Township’s jurisdiction is Falls and Muskingum Township but would address Falls Township about the use of the vehicles when asking them about previously discussed issues.
Maniaci discussed the 1994 Ford Tanker and the 1988 GMC Rescue that were not in use and hasn’t been used since Falls took over Fire Department and proposes to offer them up for sealed bids. Fusner stated they are costing Township more in insurance than they’re worth. A male resident ask if we sold these would we replace them. Maniaci stated Falls will replace the tanker with another squad in our building. A male resident asked about the staffing Muskingum fire station because Falls Township response time was 9:45 minutes roughly and Muskingum Township previous was 8:18 minutes roughly. Maniaci and Fusner stated maybe down the road but there is not enough runs to warrant more staff paid to be in here on regular basis. Maniaci stated that fire districts are becoming more prevalent and more economical and will be coming soon in the near future. Fusner stated that other Townships are dealing with unemployment issues with a partial paid Fire Department staff.
Maniaci made a resolution, in accordance with ORC 505.10, resolution 4-2012 to put up for bid and accept sealed bids for the 1994 Ford Tanker and 1988 GMC Rescue due to vehicle no longer useful to Muskingum Township, Muskingum County of Ohio. Sealed bids will be advertised in Zanesville Times Recorder and Township website and any other means available to get the best bids possible. Hittle advised to add a reserve or an accept or reject clause to any and all bids to protect the Township on the bids. Fusner second. Roll Call: Maniaci ayed, Fusner ayed, Hittle ayed.
Maniaci asked Mr. Benson about a particular avenue to bid these vehicles. Mr. Benson stated local newspaper and recommended Ebay. Ebay would involve additional fees and cautioned about making sure equipment is specific to what we are bidding out with the truck, and no warranty implied.

MAY 2012 Regular Meeting.
BOARD OF MUSKINGUM TOWNSHIP TRUSTEES

PURPOSE OF MEETING: Regular Meeting.
OPENING: The Muskingum Township Trustees met in regular session on May 3, 2012 at 7:00 p.m. in the Fire Building. All trustees and fiscal officer were present. There were 9 residents present.
The minutes were read and approved.
Checks were approved and signed for payment.
Maniaci opened for old business.
Mrs. Sellars stated her research shows McCaslin Road previously was named route 1 and around 1974 or 1975 was changed to McCaslin Road. She provided a picture from Doug Davis that showed the road identified as McCaslin Road and not Woods Road. Mrs. Sellars also presented trustees with maps for their use. According to Doug Davis when the document was signed to change the name of the road to McCaslin it null-an-voided any previous document and road name.
Fusner stated the map presented by Mrs. Sellars was before GPS which was before 1975 and wouldn’t show the road as being Woods Road. Fusner stated he needs to get with Doug Davis about this so he can follow-up with Darryl Woods and let him know about the road name change issue.
Maniaci stated Fusner has done research on this and the prosecuting attorney stated that it is up to county engineer as to what the name of the road is since the county owns it and not the residents, post office or Muskingum Township Trustees. We (the trustees) have no say in the name. The county owns the roads and passes the roads to us (the township) to maintain them.
Hittle stated that he spoke with Mr. Benson and Mr. Benson wanted to let the trustees know he had a medical emergency to attend to and would not be able to attend this evenings meeting for follow-up to the April 5 meeting regarding issues surrounding Falls Township Fire Chief Mr. JD Johnson.
Maniaci stated he reported what was discussed at our April 5 meeting regarding Mr. Benson’s information regarding Mr. JD Johnson circumstances with Falls Township Board and they informed Maniaci that they are looking into this and has put Mr. JD Johnson on administrative leave without pay until a decision is made on what they will do about Mr. JD Johnson. A decision could be made by end of this month.
Maniaci introduced Michael Moses, Mr. JD Johnson’s attorney.
Mr. Moses stated that he represents Mr. Johnson and they are waiting on scheduling a hearing in front of Falls Township Fire Department and hopes to dispose of all the allegations. Mr. Moses is aware of our contract with Falls Township and our interest and offered to come back to the next meeting and report the outcome and resolutions decided. He will also copy Maniaci on any correspondence regarding Mr. JD Johnson.
Fusner stated in regards to Vista View Market, it has no food inside the premises. Jason Tilton from the Health Department visited Vista View Market and stated he has no jurisdiction with this building. Fusner stated we will proceed with the abatement notice. The owner is Vista View Drive Drive-Thru, LLC. The taxpayer is Todd Kaib and we will address the letter to him about the building and nuisance law. Fusner stated that Mr. Kaib is $61,484 behind in his taxes and we need to decide if the township wants to pursue this property with thousands of dollars without being able to recoup any back.
Fusner presented three (3) resolutions referencing ORC 505.87, Abatement, Control, or Removal of Vegetation, Garbage, Refuse and other Debris. The owners be and hereby are Ordered to abate such nuisance by removal of such vegetation, garbage, refuse and other debris on the property and if no compliance within seven (7) days after notice is given, this board will provide for abatement of the nuisance in accordance with Section 505.87 and 3767.41 of ORC.

Fusner stated as for junk motor vehicles, per the prosecuting attorney he has to contact Muskingum County Sheriff regarding properties with junk cars.
Fusner stated while the Sheriff is looking into the above mentioned properties he will have the Sheriff look into other such properties with junk cars; 6415 McCaslin and 6240 Rollins Drive.
Mrs. Cohagen asked about follow-up regarding Mr. Hallack property.
Fusner stated beside the notices sent to Mr. Hallack he is holding off any further action until he can get with the Sheriff on the other properties mentioned above and will address all the properties and resolutions all at once.
Maniaci asked Hittle about an estimate from Hittle roofing on salt bin roof. No estimate was given to date. Maniaci did get estimate from Camm Construction, 18 sqf metal roof replacement, all felt, drip, disposal and accessories for $4,670. The original estimate for an asphalt roof previously quoted was $4,800.
Maniaci made motion to accept Camm Construction bid for salt bin steel roof replacement. Fusner seconded. Roll Call: Maniaci ayed, Fusner ayed, Hittle ayed.
Maniaci gave an update on the accident involving township truck earlier this year, the girl went to court and denied claim, plead not guilty. Maniaci stated he talked with prosecuting attorney lawyers and they are trying to get back our deductible. The truck has been repaired. John Weyer did the body work costing us $700.
Maniaci discussed North Vista View Drive and indicated he talked with Jim Lepi and Lepi is in favor of doing something with this road. Jim Lepi would like to do the repairs but wants to be fair about it as he is concerned that one owner can’t pay the taxes on this repair.
Mrs. Cohagen asked Maniaci how we would take over North Vista View Drive without the same specification with every other subdivision. Maniaci stated that the township would not take it over without same specifications and Mr. Lepi understands that the township could not take it over without these same specifications. Maniaci said Mr. Lepi would like to look into some other ways to take care of this road other than assessing taxes.
Maniaci stated individual from Terry Asphalt could not come to meeting and has no report on when he would be attending.
Maniaci stated that township needs to get our Fiscal Officer, Jason Baughman on the banks signature card and a resolution authorizing Jason as a check signer. Maniaci made resolution to add Jason Baughman to signature card and presented signature cards for trustees to sign. Fusner seconded. Roll Call: Maniaci ayed, Fusner ayed, Hittle ayed.

Maniaci asked the trustees if they had chance to read permit deal with the county engineer. Maniaci stated the state is trying to pass a Road Use Agreement. The Road Use Agreement is for protection from the heavy equipment traveling on our township roads due to the shale drilling. If the state passes this before we sign ours with the county our township will have to file with the state.
Mr. Forrest Mendenhall asked the trustees if there has been any discussion in any of these shale meetings about bonding of our township roads for the use of the heavy equipment used on the roads. He had not heard anything about bonding in Ohio, only Pennsylvania. The bonds provide that these companies that use these roads will maintain and repair back to original these roads that have been specifically bonded.
Maniaci stated that the Road Use Agreement is not exactly a bond but a similar agreement with the county engineer to perform the work repair on our township roads from the use of heavy equipment on our roads. The engineer would get the money from these repairs and our roads would be restored back to original.
Mr. Mendenhall stated we (township) may be selling ourselves out by contracting with the county engineer. He referenced Pennsylvania townships as an example, townships that did their own repair work worked out better than letting someone else take care of their own roads.
Fusner stated that the Ohio Township Association was working on something regarding these agreements and he would have to ask our Secretary Connie Fink about this as they represent the county township.
Maniaci stated that the trustees meetings with the county engineer led us to believe Pennsylvania was a nightmare and learned the hard way as many roads did not get put back together due to not having an agreement in place.
Hittle stated that the county engineer wants an agreement in place so the townships don’t get left high and dry on these repairs.
Maniaci stated the county engineer agreement would allow to forgo a permit fee and for the county engineer to come out and inspect township roads, take pictures and rate the roads before any truck is traveled on the township roads. The agreement would also call for the roads to be put exactly back to the way it was before these trucks started traveling these roads. The money would go to the county engineer but the money would also go toward the specific township road the trucks are traveling and need of repair.
Mr. Mendenhall stated that if these roads were bonded, this would leave the county engineer out of this and call for these companies to have the road repair work done on their own dollars and not the taxpayer’s tax dollars. Mr. Mendenhall questioned the county ability to repair our township roads and referenced the problems our county has had with repairing North Point Road.
Mrs. Cohagen stated that another issue to take into consideration is the past flooding our township had with flooding on Tunis Road.
Mr. Jerry Miller stated that in regards to the county engineer road inspection and the pictures, it is the township trustees to go out and inspect and take pictures of the township roads and not the county engineer. As soon as this agreement is signed with county engineer this puts all responsibility on the county engineer and the townships will be left with no say.
Maniaci stated that trustees would hold off and table signing of any agreement until a later date.
Maniaci provided update that the culvert on Gorsuch Road has been taken care of.
Maniaci stated more research was needed on the Oakwood North project.
Mr. Cohagen asked about the minutes on the web site not all being available. Maniaci stated he would take care of.
Mr. Cohagen asked about the bids on the sale of trucks. Maniaci stated they have not been posted but would be by the June meeting.
Fusner stated that when researching the Ohio Revised Code on nuisance laws he notice Union Township had a township policy on junk motor vehicles and recommended that this may be something we may want to look into with our township.
Maniaci opened for new business.
Mrs. Cohagen asked about the insurance premium and if it is included on the federal tax reports and asked if it is required to be reported as taxable income or should be reported. The Fiscal Officer Baughman stated he will look into this and report back.
Mrs. Cohagen asked Mr. Hittle about his campaign and him stating he would not sign up for the township health insurance. She asked if he was taking the insurance. Mr. Hittle responded as no he is not signed up for the insurance as promised.
Maniaci discussed a state cooperative purchasing program and recommended being a part of this program. Maniaci made resolution authorizing political subdivision to participate in the State of Ohio cooperative purchasing program. Fusner seconded. Roll Call: Maniaci ayed, Fusner ayed, Hittle ayed.
Maniaci read a letter from Hei-Way, LLC. Cold Mix Company thanking us for our purchase of cold mix.
Maniaci stated letter was received from Ohio Division of Liquor Control regarding Vista View Golf Course enhancing their liquor license and the letter basically ask if we want a hearing on this request from Vista View Golf for their liquor license enhancement.
Maniaci made motion not to object Visa View Golf Course enhancement and no need for any hearing. Fusner seconded. Roll Call: Maniaci ayed, Fusner ayed, Hittle ayed.
Maniaci stated that due to mild winter we have a bin full of salt and still haven’t purchased all the salt we are suppose to. We have one truck load of salt remaining to purchase. We can pay $5 per ton, 23 tons, or $115 and we can store the salt at the vendor until December 31, 2012. Maniaci made motion to accept the $115 storage fee. Hittle seconded. Roll Call: Maniaci ayed, Fusner ayed, Hittle ayed.
Fusner asked about discussing chip-n-seal of roads.
Mrs. Cohagen stated that another base might be good to get ahead for next year.
Maniaci stated that last year we chip-n-sealed the following roads: Fawn, Squirrel, Dutch School, Stagecoach, Prior, Beech Run, Dresden, Jones and Kenlo Woods. Roads not done were: Chugg, McCaslin, New Riley, Fulton, and Schneider. Paved roads done were: Carnation, Wilson and part of Gorsuch.
Maniaci stated we would be paving part of McCaslin and recommended that McCaslin should be part of chip-n-seal also.
Fusner stated Kenlo Woods has always held well and Maniaci recommended we could take Kenlo Woods off list for chip-n-seal this year.
Mrs. Cohagen asked if we were any longer in the fire business and if we were responsible for anything other than securing a fire contract. Maniaci stated we are responsible for making sure Falls carries out the contract. Mrs. Cohagen stated that the discussion we have had at this evenings meeting is how our meetings should be carried out. As for future discussions regarding the fire department, she asked and recommended trustees to refer those residents insisting to discuss fire department issues to take it up with Falls Township’s Board who we have a contract with to handle fire department issues.
Mrs. Cohagen stated we are the fastest growing township in our community and asked about getting up a zoning committee. Fusner stated he would like to get one started soon and also we need to address township clean-up.
Mrs. Sellars stated that when a resident comes to a meeting to talk to the trustees they should have a right to talk without being thrown out to another board and have right to ask questions and voice their opinions. Fusner agreed and Maniaci stated this is why we let the residents talk.
Fusner discussed a call from a resident in Saddlebrook about the stones at the end of route 60. Fusner called Matt at county engineer and they said it was their stones and cinders but it’s a state road and not county’s responsibility.

MAY 2012 SPECIAL MEETING FOR MICROSEALING ROADS
BOARD OF MUSKINGUM TOWNSHIP TRUSTEES

PURPOSE OF MEETING: Special Meeting. Microsealing of Township roads.
OPENING: The Muskingum Township Trustees met in special session on May 24, 2012 at 6:30 p.m. in the Fire Building. Trustees Mike Maniaci, Matt Hittle and fiscal officer were present. There were 6 residents present.
The special meeting was called to present and discuss Microsealing of Muskingum Township roads. Maniaci opened by stating and reminded everyone that the only questions that can be entertained during the special meeting has to pertain to microsealing and any other questions will be entertained at our next regularly scheduled meeting on June 7. Maniaci introduced Tim Hurst from Terry Asphalt Materials.
Tim Hurst stated he was one of the featured speakers at the Township Association Conference in Columbus and spoke to the trustees about his company’s pavement preservation services.
Tim Hurst gave a brief history and background of Terry Asphalt Materials. Terry Asphalt Materials is a construction company and liquid asphalt and emulsion manufacturer, headquarters in Hamilton, Ohio. Construction division headquarters in Columbus, Ohio with asphalt plants in Hamilton, Ohio, Lansing, Michigan, Clearfield, Pennsylvania, and Nashville, Tennessee. They are owned by second largest paving company in world out of Europe and are the largest asphalt emulsion company in world. They touch about 23 states.
Tim Hurst stated he went out and evaluated Muskingum Township Roads and measured the roads and compared them to ODOT and the county engineer’s measurements. Tim Hurst presented a list of the township roads and his measurements for the trustees to review. The list of roads were rated based on what had previously been done to the roads and their condition and rated from best to worse using scale of 1 to 5, one (1) being the newest and best condition with five (5) being worse. Each road was listed and identified the maintenance or repair process recommended.
Maniaci questioned Tim Hurst on Wilson Lane, Gorsuch to end. Wilson Lane was rated as a 2 and identified needs microsealing soon. Maniaci stated that Wilson Lane was paved along with Gorsuch road at the same time and asked Tim Hurst if he thought it was in that bad of shape to need microsealing so soon. Tim Hurst stated the road is not in bad shape but it is starting to look pity and is cracking. Tim Hurst state what he is noticing a lot in this area is that the asphalt roads are not looking the same as they did in the past 5 or 10 years and we are receiving lower end asphalt that is not as tight and smooth as it used to be due to the rising cost of asphalt and due to the increased GBW on the trucks that our roads are not custom to handling.
Mrs. Cohagen asked for a clarification from Tim Hurst and Maniaci if they were talking more about aesthetics or quality of the Wilson Lane and Gorsuch roads discussed. Tim Hurst and Maniaci stated quality and functionality is the primary concern.
Tim Hurst stated that our Township roads are not in horrible shape but if we continue to sink our money into the roads with rating of a 4 or 5 we are not going to get our money’s worth and will continue to rapidly decline in quality and to ratings of 2 or 3’s.
Mrs. Lynn Sellars asked question if microsealing is to go over both asphalt and chip seal roads. Tim Hurst stated that most of our chip seal roads will remain chip seal roads and mainly pertains to the asphalt roads. Microseal is not a reconstruction material or hot mix asphalt instead is an asphalt emulsion with crushed limestone, portland cement, and goes down nominal, 3/8 to ½ inch thick. Microseal cannot correct swales in roads and is used as a preservation tool to protect roads that are in decent to good shape.
Mrs. Cohagen asked if microsealing is a preservation tool such as Valspar on a boat. Tim Hurst stated microseal is more identifiable as to an oil change in your car or replacing your roof. Microseal is used for preserving the functionality of the road and extending the life of the road. Without microseal the roads life may be 5 years and with microseal may preserve the life of the road to 8 or 9 years.
Tim Hurst presented a synopsis from ODOT on the effectiveness of chip sealing and micro surfacing on pavement serviceability and life. The synopsis studied the effectiveness and life of the two different surfaces. The study taken from 1999 to 2006 showed the surface treatment and cost associated with each surface and the service life. On average chip seal lasted 3-5 years with average cost per mile $11,500 vs. Microseal (4 lane road) 8 years service life with average cost per mile $26,350 and Microseal (2 lane road) 9 years service life with average cost per mile $17,450.
Tim Hurst stated that it is important for us to first identify our road priority and determine a budget before proceeding because the budget will justify a unit cost per mile. With microseal, the more volume of emulsion results in a lower cost per mile. The price comparison would be for every 1 mile of 1 to 1.5 inch of asphalt microseal would be approximately 2 to 2.5 miles, or double the miles of that of asphalt. Tim Hurst stated that every surface they service is also backed by a 1 year warranty and stated the 1 year warranty is offered because typically if anything would happen to the road after microsealing typically would happen in the first year of service.
Tim Hurst presented a letter from ODOT acknowledging Terry Asphalt Materials as an approved vendor and part of the Ohio Cooperative Purchasing Program. The price for the microsealing has already been agreed to, and cannot increase, with the Cooperative Purchasing Program, #101H-13. The next step as a Township would be for us to pass a resolution to accept the product in place, and agreed to, with the Cooperative Purchasing Program and letter from the Township requesting to participate in the use of ODOT’s Cooperative Purchasing pricing as defined on the #101H-13 state contract. A letter then would be received from ODOT with the approval. Tim Hurst also stated that the new ORC bid requirement has been increased from $25K to $50K but by working on the State of Ohio’s Cooperative Purchasing Program lifts the $50K ceiling.
Mrs. Cohagen asked the trustees if they were going to do their due diligence and follow-up on the vendor and go out to other areas or townships with microseal roads for more than 5 years. She also expressed her concerns with our township’s road and whether or not our roads were currently in good enough shape to justify the cost and benefits of the microseal surface.
Maniaci stated that he has seen roads with microseal and is impressed with this product and is why Tim Hurst is here presenting this product to everyone and its benefits to our township. Maniaci stated that there are some roads microseal is not an option and others that are in pretty good shape that could benefit. Tim Hurst stated that his analysis is surface functional and no has no idea what is going on below the surface however the survey presented of the cost and performance justifies the ability of the microseal product.
Maniaci stated that roads that are too bad and need of patching or smoothing Curtis and Charles would patch and repair these roads before applying the microseal.
Mrs. Cohagen asked if the chip seal could be treated with the microseal after the chip seal is applied to the asphalt. Tim Hurst stated that the process would be chip seal, roll and sweep it, let traffic run for 3-5 days on it to let chip seal settle and then come in with microseal. Tim Hurst provided that the City of Columbus as a reference for the microseal process.
Tim Hurst also presented an advertisement for a bid that they were awarded for ODOT district 7, Sydney area North of Dayton. He mentioned they are also doing district 3, Ashland, Mansfield, Medina/Richland County and the I71 corridor which includes 3 counties, 6 lanes which is the largest microsealing job in the history of ODOT.
Mrs. Cohagen asked about road closure during the microsealing process. Tim Hurst stated microseal is a water based product and can speed up or slow down the curing of the product as they need it. They would go around 24-48 hours before the process to all the residents to talk and explain the process and lane and road closures during the process. If residents not home at this time door hangers would be left to notify the residents of a name and number to contact for follow-up of the process and lane closures.
Mrs. Sellars asked about the microseal process and if it starts with blacktop, then chip seal then microseal. Tim Hurst said in some cases this is the process and is most cost effective in most cases. The object is to pick those roads that are crack seal and microseal conducive for your biggest bang for your dollar.
Hittle asked if we are looking at roads that are rated 3 or below to do the microseal. Tim Hurst stated that we would want to look at our roads that are rated at 2.5 to 3 to perform crack seal and microseal. Roads with 3.25 and above chip seal is recommended.
Tim Hurst stated the next step would be to come up with a budget and identify roads to apply microseal and Tim would come back and re-measure the roads and determine the pricing per mile. Tim Hurst also mentioned that summer months typically start seeing increased pricing from asphalt companies as prices have increased over 20% since end of last year.
Hittle asked if we Tim Hurst could provide us with an estimate on the cost. Tim Hurst stated that approximately for 1 mile of microseal you’re looking at $25-30K per mile and for 1 mile of crack seal you’re looking at $3-5K per mile. Tim Hurst stated that the City of Cambridge, Plain Township, and Perry Township is part of the Cooperative Purchasing Program and using microseal.
Maniaci stated our past pricing of chip seal and asphalt our township roads was approximately $7,000 per mile and asphalt was approximately $75,000 per mile. Maniaci also stated that we are looking for a longer term solution and to get longer life of the roads.
Gentlemen asked about the some township roads being small in lane size and concerns about the roads being closed for long period of time. Maniaci stated that closure of roads during the microseal process would depend on number of residents needing to travel on such road.
Mrs. Cohagen asked about how salt would affect the microseal on the roads. Maniaci stated that microseal would provide for a tighter seal than asphalt surface. Tim Hurst stated that microseal is multifunctional, provides tighter seal, less void area than asphalt, seals off roads from water and provides for speed correction and skid resistant, less frictious than asphalt, and is black that helps with melting of snow faster and also can be striped.

OPENING: The Muskingum Township Trustees met in regular session on June 7, 2012 at 7:00 p.m. in the Fire Building. All trustees and fiscal officer were present. There were 6 residents.

Maniaci introduced Dan McCombs from Houston Insurance agency. Houston Insurance deals with Burnham Flowers OTARMA insurance for Muskingum Township’s property and liability. Mr. McCombs went over changes to our insurance which included dropping insurance liability for fire department since Falls Twp. takes care of it and dropping coverage on 93 Ford Tanker and the 87 Mini Pumper that was just sold.
Maniaci made motion to take off the Tanker and Mini Pumper that was just sold. Hittle seconed. All ayed.
Maniaci introduced Dave Hibner from Kinstle Sterling/Western Star Truck Center. Mr. Hibner discussed with the trustees and presented bid proposal for a Sterling/Western Star Dump Truck. The Western Star truck would be a replacement option for the township’s current 1997 International Dump Truck. Mr. Hibner discussed details, recommendations and comparison of the Western Star truck bid vs. the ODOT State bid price. Mr. Hibner passed out handouts to the trustees that detailed out and compared the various options, variations and additions from the Western Star truck vs. the ODOD State bid truck. The Western Star truck bid was for $82,443 vs. the ODOT State bid of $88,047. The additional equipment options for the Western Star would be another $2,057. The total bid with options for the Western Star was $84,500 vs. ODOT State bid of $90,104. Western Star bid is $10,390 lower than the State bid.
Maniaci opened for old business.
Female resident ask about the minutes on the web site only including 2011 minutes and not 2012. Maniaci stated that only 2011 minutes and 2012 minutes except for April and May to-date. Maniaci would look to confirm the minutes are still on the website.
Fiscal Officer, Jason Baughman followed-up with Mrs. Cohagen questions about the taxability of insurance benefits at the May regular meeting. Baughman state per IRS Publication 15B Fringe Benefits, typically most fringe benefits are taxable but there are some exclusions. The list of exclusions includes health insurance benefits and is not subject to federal, Medicare, social security, federal unemployment and not included on W2. Baughman also indicated that there is a new Affordable Care Act that requires employers to include on employees W2, box 12, code DD the amount of insurance benefits that is paid for by the employer for informational purpose only. This Affordable Care Act is not yet law or required to-date. The exclusion of insurance taxability is for both employer paid insurance benefit or reimbursements for insurance benefits paid to the employee.
Mrs. Cohagen asked if this code reference the insurance benefits coming out of an employee’s salary or is specific to elected officials. Baughman stated the code doesn’t state or define any distinction.
Maniaci ask trustee about the engineer agreement regarding the repair and maintenance contract for our township roads due to the shale drilling trucks traveling on our roads. Due to waiting on OTARMA to work out another option and waiting to receive more facts the trustees agreed to table this issue to later date.
Maniaci addressed issue with Falls Township and JD Johnson. Maniaci stated he has been informed of the decision that was made and Falls Township ask him to not release this information to public at this time, however as trustees we are pleased with their decision and should be seeing something released in the newspaper soon from Falls Township.
Maniaci indicated that McClaslin road has been paved from Gorsuch Road to Swingle Drive, 1,400 ft, 2 lanes. Maniaci stated his conversation with Shelly & Sands and the original contract stated 900 feet however the measurement was inaccurate and Maniaci made decision to take the top coat from Harper Drive and add it to McClaslin plus another $80 for the other 300 feet.

Mr. Wint asked about Fulton Lane repairs. Mr. Wint stated there is 2 deep spots on Fulton Lane needing fixed before any paving is started. Maniaci stated that he Charley and Curtis is working on fixing this road before the 18th when the county is coming out to start chip-n-sealing this road. Ditches will be cleaned also once chip seal is completed.
Mrs. Cohagen asked about any follow-up on McCasslin road name. Fusner stated that this is up to the county. Maniaci stated unless resident raised issue to county this road name will remain the same.
Mrs. Cohagen asked about if the nuisance letters for the properties discussed at the May meeting have been sent. Fusner and Maniaci stated the 3 letters were sent and Todd and resident on route 60 responded and are working on the clean-up. The Vista View Market is tied up in bankruptcy and sheriff sale.
Mrs. Cohagen asked about the metal salt bin roof. Maniaci stated only the color of the roof has been discussed and at present time nothing has been scheduled but will follow-up.
Maniaci opened for new business.
Mrs. Cohagen stated that a township employee mowed over phone lines on Jones Road and was out of service for several hours. Cassies Way was also affected.
Mrs. Cohagen asked about why trustees are looking at new dump truck. Maniaci stated the current 97 Dump Truck is falling apart. The frame and springs are bad and the bed is rotting. The frame and front end is wearing out and shocks and are inching too close to the gas tank and is becoming too dangerous. The truck is to the point of un-repairable and concerns of safety issues with the truck.
Mrs. Cohagen asked if any due diligence has been done on the Micro Seal vendor (Mr. Hurst) that was introduced at the special meeting. Maniaci stated he has and presented a copy of a resolution obtained from ODOT’s web site and contacted Jim Schurch about the Ohio Cooperative Purchasing Program. Mr. Schurch indicated that we have to first, pass a resolution highlighting 5513.01 of ORC, and two, prepare letter to Jim Shurch stating that we passed a resolution and request use of Strauser Construction under the 101H-13 state contract.
Maniaci stated a list of roads were presented to Mr. Hurst of Terry Asphalt but has not heard back from him about them or attending this evenings meeting.
Mrs. Cohagen asked what we were looking at for this micro seal and budget. Maniaci stated that our budget for roads is approximately $250K. Maniaci stated that we will hold off tonight on a decision.
Maniaci indicated he received two visits about 5800 Dresden Road and the growing parking lot on the property with several cars located on property.

Maniaci stated he was informed by our Fiscal Officer about our current Health Insurance will be increasing 30%. Baughman and Maniaci are working on getting other quotes including OTARMA for review. Mrs. Cohagen asked about inquiring on joining the counties insurance. Mrs. Cohagen stated that the county commissioners said that the township’s can get on the county’s policy. Most of the township’s refused the county’s offer to join their policy. Maniaci stated we will look at all available options.

OPENING: The Muskingum Township Trustees met in regular session on July 5, 2012 at 7:00 p.m. in the Fire Building. Trustees Mike Maniaci, Steve Fusner, and fiscal officer were present. Trustee Matt Hittle was absent due to a family illness. There were 6 residents.

Maniaci introduced Todd Johnson from Rankin & Rankin Insurance to discuss our health insurance renewal options. Todd Johnson stated that health insurance premiums have been increasing. Mr. Johnson presented various options for renewal. Mr. Johnson addressed the townships option to join the county stating that 3 years ago the townships tried to join the county's plan and the county did not want this. Reason being the county didn't want the high risk townships on the plan and the townships had different plan designs with differing deductibles. Mr. Johnson stated another reason why the county decline the townships is the administrative nightmare of accounting for all the various deductible plans of the townships. As for the county plan it is a self-funded plan where as our township is a fully funded plan. Mr. Johnson indicated the options that he presented have differing deductibles which help reduce the premiums. He also stated the townships only have one plan design where as the city has a low/medium/high deductible option. Mr. Johnson stated that after taking the plans to market Aetna came back the best carrier and option available for Muskingum Township. As for renewal we need to decide by August 1st.
Baughman discussed his conversation with Theresa Tom and Rankin about quoting the property and liability insurance and Todd reiterated that we are in a very good plan with OTARMA. It's a claims paid plan and if you leave the plan you take your claims with you. Mr. Johnson recommended we should stay with OTARMA at this time.
Maniaci opened for old business.
Mrs. Sellers read Mr. JD Johnson's article in Times Recorder regarding Mr. Johnson's arrest and recent employment termination. Mrs. Sellers recommended more background checks. Mrs. Sellers stated that she was told that 14 members of the falls fire department board voted to keep Mr. Johnson. Mrs. Sellers requested copies of the Falls Township Volunteer Fire Department membership list, rank of office, how many respond to the 911 calls, and Muskingum Township trustees to do background checks on all of Falls Township board members. Mrs. Sellers stated that after background checks are complete on Falls Township fire department members we will see the benefit to reinstate Muskingum Township volunteer fire department and accept Licking Township's offer to run an ambulance business out of Muskingum Township building separate from either trustee’s ownership.
Maniaci stated we have no say as to the Falls board's vote. As for Mrs. Sellers membership request, we do not have this information and Mrs. Sellers must ask Falls Township for this information.
Maniaci and Fusner stated in regard to perform background checks on Falls employees, it’s up to Falls, and for example, we are not going to nor do we have to perform background checks on all vendors we contract services from. For example we don’t do background checks on all of the Shelly Company's employees who work on our roads.
Maniaci asked about any progress on shale agreement. Fusner stated he has not heard any status to date.
Maniaci gave a status on paving of roads. Chip seal is about 80% complete. Roads sealed to date include: Fawn, Squirrel, Dutch School, Stagecoach, Jones, and Beech Run. Remaining roads to chip seal include Fulton, New Riley, Schneider, McCasslin.
Fusner stated the gentlemen on Tunis Road that helped for 3 hours recommended we pay him something for his time. Maniaci made motion to pay the gentlemen $50 for his time. Fusner seconded. Roll Call: Maniaci ayed, Fusner ayed.
Maniaci discussed the salt bin roof repair. Maniaci spoke with Chris Mitchell and he is about 2 weeks away from finishing.
Maniaci discussed micro-seal. Maniaci received quotes based on the roads Maniaci presented. One quote which included Canadian Ontario trap rock black agg. was $129,536.36 and the second quote without trap rock black agg. was $121,080.20. Maniaci stated that the quote was higher than what we wanted to go and has heard no response. Maniaci recommended micro-seal of roads be put on hold until more information can be obtained.
Maniaci stated he received a call from Mark Blatt regarding the property on corner of Virginia and Babbs Road one owned by GVH and one owned by Virginia Helbling and Jack Newcome. Parcel 44-34-04-34-000 and 44-34-04-35-000. Maniaci presented pictures of the high grass and debris. Maniaci will prepare the proper nuisance resolution to address.
Maniaci discussed the purchase of new dump truck. Maniaci prepared and read resolution 7-5-2012A, in accordance with ORC 125.04, 125.05 and House Bill 204 to enter into agreement with Kinstle Sterling/Western Star Truck Center to purchase a 2013 Model Western Star 4700SF Truck, and related equipment for road maintenance and other duties so specified by the Muskingum Township Trustees. This vehicle will be purchased for no more than $113,801, which is lower than the State Bid for a similar Truck with same options. Fusner seconded. Roll Call: Maniaci ayed, Fusner ayed.
Maniaci prepared and read resolution 7-5-2012B, in accordance with ORC 125.05 resolve to enter into agreement with Henderson of Ohio to purchase a 2013 Stainless Steel Truck Bed for the existing 2005 Sterling Truck for road maintenance and other duties so specified by the Muskingum Township Trustees. This Stainless Steel Bed will be purchased and installed for no more than $16,125. Fusner seconded. Roll Call: Maniaci ayed, Fusner ayed.
Maniaci prepared and read resolution 7-5-2012C, in accordance with ORC 505.262, 133.20, and 9.95 to enter into an agreement with Daimler Truck Financial to finance the purchase of (1) 2013 Kinstle Sterling/Western Star, Model Western Star 4700SF Truck, and related equipment, and 2013 Stainless Steel Bed, installed, for the existing 2005 Sterling Truck for Muskingum Township, Muskingum County, Ohio. Loan amount including interest of 3.809% per annum = $139,165.

Fiscal officer Baughman presented the Alternate Tax Budget, for tax year January 1, 2013 to December 31, 2013, for review and approval to be submitted to the County Auditor due July 20, 2012. The Alternate Tax Budget is an estimate based on the Amended Certificate of Resources for the following tax year. The county budget commission will review the Alternate Tax Budget. Maniaci also made a motion in accordance with ORC, the fire marshal can be paid and because this situation is above and beyond the call of Mr. Brown's duty, motioned to pay out of fire fund $500 per year to Mr. Brown for the fire marshal position. Maniaci discussed the culvert on Welch Road. Maniaci made a motion to allow the county engineer to use their track hoe and supply a man to take care of the culvert on Welch Road using the funds we have credited to us from the county. Fusner recommended that since Welch is a designated county detour, due to the bridge closure on Creamery, that the county covers the cost of repairs to Welch Road. Fusner stated the county engineer receives money when county roads are used for detour and feels we should receive money for use of our township road when county uses our roads as detour. Maniaci and Fusner will address with Mr. Doug Davis.
Mr. Mendenhall asked the trustees if they heard anything regarding sunshine law and executive session from the attorney general office. For our protection when going into an executive session we must be very specific.

PURPOSE OF MEETING: Special Meeting. Bidding of asphalt road located at Northcrest Drive, trading in used dump truck bed on sterling truck and nuisance law on Babbs Road and Virginia Road.
OPENING: The Muskingum Township Trustees met in special session on July 10, 2012 at 7:00 p.m. in the Fire Building. Trustees Mike Maniaci, Steve Fusner, Matt Hittle and fiscal officer were present. There were 4 residents present.
Maniaci opened discussion in regards to the nuisance on Babbs Road and Virginia Road. Maniaci read resolution: property known as 44-34-04-34-0000, GVH Corporation, and 44-34-04-35-000, Jack Newcome and Virginia Helbling, constitutes a nuisance and are hereby ordered to abate such nuisance by removal of such vegetation, refuse and debris on the property and if no compliance within 7 days of notice the board will provide for the abatement of the nuisance by removal of such vegetation, refuse and debris with the expense certified to the county auditor to be entered upon the tax duplicate and lien on such property under ORC 505.87 and 505.871. Notice to be sent by certified mail to Jack Newcome, 2000 Andrew Court, Dresden, Ohio 43821 and Virginia Helbling, 21 West 4th Street, Dresden, Ohio 43821.
Mr. Helbling presented a letter sent to the county discussing the Crestmont Estates. Maniaci read the letter. The letter was addressed to Commissioner Brian Hill discussing information associated with the two wastewater treatment plants that served the Crestomont Estates residents operated and maintained by sanitary engineers office until 1997. The letter also addressed Ohio EPA rules and regulation regarding the construction and demolition debris under Ohio Administrative Code 374-400-01F. Mr. Helbling presented a map of the property and indicated that there was no access to the property. Mr. Helbling stated that there are documents at the courthouse stating the county was to take care of the property. Mr. Helbling also presented an interview summary, read by Maniaci, of Keith W. West dated 1/9/07 discussing the Crestmont Estates and the removal of the sanitation package plant parts and presented pictures of the property.
Maniaci stated to Mr. Helbling that all we want is the property grass mowed. Maniaci stated that he will get Mr. Helbling written permission from the apartment owners near the property so there is access to the property so it can be mowed.
Helbling indicated that he would like to wait until after his meeting scheduled with the EPA next week to see what they are going to do about the property. Maniaci stated that we will table this issue until we here the results of Mr. Helbling meeting with EPA.
Maniaci presented an opportunity to trade in our old truck bed on our sterling truck for $2,500 to Kinstle Sterling/Western Star. Maniaci made motion to accept Kinstle Sterling/Western Star’s bid to trade in our old truck bed for $2,500 to go against the cost of our new truck that was approved at our July 5, 2012 regular meeting. Maniaci presented two bid proposal options for asphalt paving of Northcrest Road.

PURPOSE OF MEETING: Special Meeting. Open bids for Asphalt paving of Northcrest Road and to review and approve health insurance options.
OPENING: The Muskingum Township Trustees met in special session on July 26, 2012 at 7:00 p.m. in the Fire Building. Trustees Steve Fusner, Matt Hittle and fiscal officer were present. Mike Maniaci was unable to attend as he was out of state for his employer stuck in traffic. There were 2 residents present and Kevin West from the Shelly Company present.
The special meeting was called to open bids for asphalt paving of Northcrest Road and Kingswood Circle, Winfield Circle, and Coachlite Circle. The special meeting was also called to discuss and approve health insurance options.
Paving bids were opened and read by Steve Fusner.

Hittle made a motion to table the acceptance of bids until next regular scheduled meeting so the road and bridge budget could be reviewed again and to decide on option A or B based on our available road and bridge fund. Fusner seconded. All ayed.
Fusner opened discussion for approval of health insurance options.
Fiscal Officer Baughman provided trustees with health insurance premium renewal options and quotes received from Rankin & Rankin Insurance and Miller Lynn Insurance. Rankin & Rankin provided quotes from Aetna and Miller Lynn provided quotes from Medical Mutual. Baughman stated that additional quotes were requested from Jeff Cashman of Wichert Insurance, however per Mr. Cashman’s email provided stated that he was still working on quotes and were not available at the time of the special meeting.
Baughman stated that he needed the trustees to approve a plan option to continue coverage. Baughman stated that our current plan under Aetna was renewing at an increase of 37% and trustees needed to decide if they wanted to renew the current plan at this increase or choose another plan option with a higher deductible, max out of pocket, and co-pay to off-set some of the premium increase. Baughman stated after his conversations with Charlie Brenner at Miller Lynn, the best options were to stay with the current carrier Aetna as most all of the premium options quoted with Medical Mutual were slightly higher than that of Aetna.
Baughman stated that we have to decide on a plan and payment this month to renew our insurance coverage. Baughman stated that we are max penalty rated therefore regardless of what carrier Rankin, Miller Lynn or Wichert quotes our premiums will be the same regardless of the broker. We will receive the max premium with every carrier that is quoted. Baughman stated the plan is month-to-month so if Wichert comes back later with other carriers than Aetna or Medical Mutual and is less expensive we can re-evaluate the plans at that time and choose the best available plan but as for now we have to at least choose a plan option so we can make the premium payment to avoid any lapse in coverage.
Fusner made a motion to choose the health insurance plan option, Aetna, Ohio Health Network with the $500 deductible option and to re-evaluate health insurance options as plan options are received from Wichert. The $500 deductible option will save 15% of the projected 37% premium increase. Hittle seconded. All Ayed. Roll Call: Fusner ayed, Hittle ayed.

August 2012 Regular Meeting

PURPOSE OF MEETING: Regular Meeting.
OPENING: The Muskingum Township Trustees met in regular session on August 2, 2012 at 7:00 p.m. in the Fire Building. Trustees Mike Maniaci, Steve Fusner, Matt Hittle and fiscal officer were present. There were 7 residents present.
The July 5, 2012 regular minutes were read and approved.
The July 7, 2012 special minutes were read and approved.
The July 26, 2012 special minutes were read and approved.

Maniaci opened for old business.
Maniaci asked about any update on shale agreement. Fusner stated nothing to date.
Maniaci stated roof replacement for salt bin has been completed.
Maniaci asked about insurance update. Baughman stated per Todd at Rankin insurance has been renewed and new cards issued within 15 days. No response from Wicert to-date. Baughman will contact Forker Company about insurance quotes.
Maniaci stated that Fiscal Officer Baughman and him went to the Muskingum County FEMA meeting to turn in time and cost information for reimbursement due to the recent storm damages. Nothing has been approved by the state nor have any of the townships been qualified yet for reimbursement from the state. The total Maniaci and Baughman reported for potential reimbursement was approximately $5,007.
Maniaci gave update on chip-seal. Tuesday, August 7th, the following roads will be finished with chip-seal: Fulton, Schneider, Chugg Run, McCasslin.
Fusner asked about decision on paving bids for Northcrest Road. Fusner made motion to accept the lower of the two bids, bid proposal B, from Shelly Company for $72,992.50 which includes asphalting of Northcrest Road from Richvale Road, including Kingswood Circle from Northcrest to end, Winfield Circle from Northcrest to end, and Coachlite Circle from Northcrest to end. Maniaci seconded. Roll Call: Maniaci ayed, Fusner ayed, Hittle ayed.
Mrs. Cohagen asked about appointing Mark Brown as Fire Chief and paying him $500 annually out of the fire fund. Mrs. Cohagen asked about the legal ramification due to the fire contract and whether we should be paying Mr. Brown out of the fire fund. Maniaci stated he will verify this with the contract.
Mr. Paul Dunfee, from Licking Township, asked about chip-seal of Vanbark and asked if we wanted to them to go all the way down to the highway from Vanbark. Fusner stated Licking Twp. has done this in the past for a small fee. Fusner made motion to compensate Licking Twp. for this extra 100 feet providing that compensation isn't excessive. Maniaci seconded. Roll Call: Maniaci ayed, Fusner ayed, Hittle ayed.
Mr. Dunfee asked about how many employees the township pays for health insurance? Maniaci stated there are 3 employees on health insurance and 2 that are reimbursed for out-of-pocket premiums paid.
Mrs. Cohagen asked about township zoning. She referred to the article in the Times Recorder about the city port authority expansion plans. Mrs. Cohagen asked trustees why haven't zoning in our township been addressed? Maniaci stated that his understanding is that the zoning process was addressed years ago and cards were issued to the township residents addressing zoning and they were never returned, therefore the zoning issue was never brought to the ballot. Fusner state that years ago the township hired the city planner to prepare a zoning plan and $10K later only maps were drawn. Mrs. Cohagen stated there are different levels of zoning and mentioned that there were individuals in township willing to be on a zoning board. Maniaci stated that he would have a zoning report at the next regular meeting.

Maniaci stated that the Falls Township Fire Department Chicken Barbeque is Sunday August 5th.
Maniaci made proposal and motion to reword the resolution 7-5-2012A for the dump truck. Instead of reading the vehicle would be purchased for no more than $113,801 which is $10,246 lower than state bid for similar truck with same option, we are rewording the first paragraph to read the vehicle would be purchased for no more than $81,991 which is $10,246 lower than state bid. Also, the paragraph in the center of the same page which read Kinstle Sterling Western Star truck and related equipment not to exceed $113,801, will now be reworded to read equipment from Henderson Ohio totaling $31,810 to be mounted on 2013 Western Star Chassis not exceeding a total price of $113,801. Maniaci stated he received a bid to trade in the truck for $5,000. Maniaci, Fusner, and Hittle rejected this bid.
Fusner asked about a dry hydrant on Friendly Hills from Mark Brown. Maniaci stated he would ask him about this.
Maniaci stated that the no outlet sign on Aaron Place was missing and we replaced.
Maniaci stated he noticed that the sign where Gorsuch meets McCasslin was gone and also needs replaced.
Fusner stated we are going to need to do something about Welch Road. Maniaci stated with this last 2.5 mile run on McCasslin, we could get a second tank and finish McCasslin, go over to Welch and Fawn. Maniaci would check with Gary on this and try to buy some additional time to get Welch ready.
Mr. Dunfee asked about Stagecoach. Fusner stated we can't get any property now. Maniaci stated he spoke with Becky Vansickle and her position was that the trees were cut down on her side and the gentleman on other side planted trees which is now slowly pushing the road over to her side. Maniaci stated that the county engineer surveyed it and said they couldn't find a center line and we need to get lease agreements for us to do anything with it now.

September 2012 Regular Meeting

PURPOSE OF MEETING: Regular Meeting.
OPENING: The Muskingum Township Trustees met in regular session on September 6, 2012 at 7:00 p.m. in the Fire Building. Trustees Mike Maniaci, Steve Fusner, Matt Hittle and fiscal officer were present. There were 4 residents present.
The August 2, 2012 regular minutes were read and approved.

Maniaci opened for old business. No old business.
Maniaci asked trustees about progress on shale agreement. Fusner stated still nothing from Connie Fink or Ohio Township Association to-date.
Maniaci asked fiscal officer about health insurance. Baughman stated Wicert has not responded to his follow-ups and he also spoke with Jared Dosch at Forker Company regarding additional quotes. The only quote that came back from Forker Company that was competitive was from Medical Mutual, which Miller Lynn also quoted the same plan options, however Jared Dosch's quote was different than that of Charlie Brenner at Miller Lynn. Baughman stated he was in the process of contacting Charlie Brenner and Todd Johnson and Jared Dosch to discuss why there are differences in the same plan from Medical Mutual that was quoted.
Maniaci stated that there is a FEMA meeting on September 7th at 1pm and Jason will be attending to see if we will be getting any money back for the June storms.
Maniaci stated that chip-seal has been finished on Welch and Fawn.
Maniaci stated that Northcrest is being prepared for paving and Shelly Company will be paving sometime in the next week or two.
Maniaci asked trustees about the change on the township sign. Mike Davis quoted $425 per sign. Hittle made motion to make the sign change to Falls EMS Station #3. Fusner seconded. Roll call: Maniaci ayed, Fusner ayed, Hittle ayed.
Fusner also recommended adding sign or adding sign out front that would say regular township meeting first Thursday of every month at 7pm so we don't have to update every month. Maniaci will ask Mike Davis about signage.
Maniaci discussed the dry hydrant on Friendly Hills and stated that Falls is just waiting on Zemba.
Maniaci stated he had reviewed the fire contract and there are two different places within the contract allowing us to pay Mark Brown the $500 from the fire fund.
Maniaci opened for new business.
Todd Graham asked about guard rail St. Mary's road. Fusner stated he talked with Doug Culbertson on this and is waiting on county to get back with him on what the cost is to fix this.
Mr. Forest Mendenhall stated that he had been asked by another township trustee about our township employees and our employees policy and procedures. Mr. Mendenhall stated that this trustee has seen our township employees and vehicles at various places in town multiple times during the week. Mr. Mendenhall, in light of his conversation with the above mentioned trustee, asked some questions to the trustees regarding our township employees, administrative control over our employees and enforcing employee policy and procedures. He asked the following questions:
How many employees do we have? Is there a set of employee rules that cover hours such items as hours of work, lunch hours, work breaks, time cards, work reports, overtime, mileage logs, travel time to and from work sites and lunch hours and how does the trustees administer these rules over the employees. Is there any one trustee or anyone appointed to oversee township employees. How is overtime authorized and is any set rules regarding overtime.
Maniaci stated that there are 2 employees and we have a employee policy manual. Time cards are completed with detail of work performed. Mileage logs are not presently maintained. There are no such rules regarding when lunch hours are to be taken, when and where. There may be such times when the employees will stop and eat lunch while on their way to pick up something in town. The employees work an 8 hour day which includes their 1 hour lunch. As for overtime, the general rule is that they are not to work overtime however there are some circumstances that overtime is needed such as emergency situations like tree or snow removal.
Maniaci stated that there is constant communication with the employees regarding the employees work day and week and generally know what the employees are doing where they are going and when. All trustees oversee the employees and advise one another with any issues. Maniaci and Hittle stated that the trustees have had previous discussions with the employees, regarding their work hours, overtime, lunch hours and making changes to these policies. In addition to the policy and procedures there is a give and take relationship regarding these policies and administering the employees work hours including their daily work breaks and lunch hours. Maniaci stated that we as trustees don't feel that the employees are taking advantage of the policy and procedures especially for the amount of work that we get out of our two employees.
Fusner also stated that our township employees, in particularly Curtis, has done things such welding, mechanic work and has fixed a rear-end of one of our trucks that would typically cost us thousands of dollars if we had to contract these services outside. Curtis along with Charley looks out for our township and our best interest. Maniaci stated that for the amount of work we get out of our workers and for what they earn we get a lot more back from them than what we pay out.
Hittle stated that he understands Mr. Mendenhall's inquiry and that everyone is watching and how these things can be interpreted.
Maniaci stated he appreciates Mr. Mendenhall's concerns and at the present time we as trustees believe we are not being taken advantage of and our employee policy and procedure system in place is working, however we will always be open to changes at any time.
Mr. Mendenhall ask about wages. Maniaci stated Curtis makes $15.50 per hour and Charley makes $13.75 per hour.
Hittle stated that he talked with Mr. Steinment regarding his property and water issues and the trustees would meet with him anytime to discuss his water issues and culvert options.
Todd Graham asked the trustees if the fire building could be used for a Coon Hunters Club Meeting. Maniaci made a motion to allow the use of the fire building for the Coon Hunter Club Meeting. Hittle seconded. All ayed.

Maniaci stated that we have received the final approved resolution from the County Commissioners dedicating Northern Place Drive to Muskingum Township.

October Regular Meeting

PURPOSE OF MEETING: Regular Meeting.
OPENING: The Muskingum Township Trustees met in regular session on October 4, 2012 at 7:00 p.m. in the Fire Building. All trustees and fiscal officer were present. There were 2 residents present and 2 representatives from Wicert Insurance.

Maniaci introduced Jeff Cashman and Kevin Howe from Wicert Insurance. Jeff indicated that Wicert works with over 400 townships in Ohio and in July Jason had been in contact with him about getting some health insurance quotes for Muskingum Township. Jeff indicated that he wanted to come to our meeting to discuss Wicert and their services they offer and answer any questions we may have regarding our health insurance options and assist us with reducing our current health care cost. Jeff indicated that the carrier and the plan are just one part of the health care cost equation and there are other options that can be incorporated in the plan such as health reimbursement options. Every plan is different and part of Wicert’s services is to help their clients find a plan and tailor it with options to meet the customer needs and within their budget.
Mrs. Cohagen asked Mr. Cashman if the cost of a health insurance would decrease if the size of participants was increased.
Mr. Cashman indicated that there are varying factors that determine the cost of the plan other than just the number of participants. The plan design, deductibles and make up of participants as to their health, age, or sex impact the overall cost of the plan.
Hittle asked Mr. Cashman if we could custom design our plan or if these plan options are already set. Mr. Cashman stated that the plans are a little of both. The carriers have to file the rates of the plans with the state with a predetermined benefit however there are varying options to choose from such as deductible, co-pays, or employee reimbursement options. The options vary as no two townships or plans are the same.
Mrs. Cohagen asked what our current health insurance premiums are for the township as of October 1. Baughman stated that the monthly premiums are $4,687 per month. Mrs. Cohagen states that the county employees contribute 20% and in Muskingum County there are 18 out of 25 townships that provide insurance and 5 townships have a cap to their plan. Mrs. Cohagen stated that our township employees should contribute more toward the cost of the monthly premiums.
Maniaci asked Mr. Cashman, of all the township's that he works with, how much do these townships pay toward their employees health insurance premiums. Mr. Cashman stated that it varies anywhere from 50% to 100%. Some provide a monthly stipend and some provide a cap to the monthly premium for the employees.
Maniaci stated that we are not done with exploring all our options with lowering our health insurance cost and Wicert is just another option to us with helping us manage our health care cost. Maniaci stated that even though our annual budget is still increasing, even with the loss of the LTAP and Inheritance tax funds, we continue to explore our options to cut our health insurance cost without any added out-of-pocket cost to our employees.
Baughman discussed and stated to Wicert that he had received quotes from three local agents which had quoted the same carriers as Wicert would have quoted. Baughman stated that when the carriers were quoted in July and August the rates for Medical Mutual vs. Aetna, for the same plan, were about the same. Jared Dosch, from the Forker Company, quoted the same plan for Medical Mutual in September and, effective October 1st, the Medical Mutual plan rates came in lower than what was quoted by Rankin & Rankin and Miller Lynn back in July and August. Jared stated that Medical Mutual lowered their rates effective October 1st. Baughman also stated that next year, based on our current plan's premium rate table, 3 of our 4 plan participants rates are expected to increase another 25%.
Maniaci asked Wicert if they would come back to our next meeting to discuss what they have purposed to our health insurance plan options and our options available to us to lower our health insurance cost. Mr. Cashman stated that they would get to work on our options and be back at our next meeting to present these options.
Maniaci opened for old business.
Fusner discussed the bridge on St. Mary's Road. Fusner stated that Doug Davis said a 36 inch culvert would handle the repair.
Fusner stated he had talked with Connie Fink and Stephen Bradley about the shale agreements and talks have currently subsided and things are quiet right now until after the election. Most of the agreements for the townships have been left up to Doug Davis right now. Maniaci stated we will table for now and revisit these at a later time.
Maniaci asked Baughman about the FEMA meeting. Baughman stated he attended the FEMA meeting and completed and submitted all the required forms that were due by September 19th. Baughman stated he is authorized as the main point of contact in our FEMA grant process and is meeting with a FEMA representative on Friday, October 5th to start the application process.
Maniaci stated Northcrest Road has been paved and the bill from Shelly Company came in $3,000 less than the bid.
Hittle stated that Mr. Meyer's culverts and ditches on Rollins Drive were completed.
Fusner asked Maniaci and Hittle whether or not the culvert replacement cost is the responsibility of the township or landowner so he knows how to handle this when other residents need culvert replacement. Maniaci stated historically this has been on a case by case basis and typically if the landowner wants to replace a culvert the landowner is responsible for the cost of the culvert and the township will install it for the landowner. If we see that a culvert needs replaced the township would cover the cost. Fusner stated we need to be consistent. Maniaci stated on average we may replace a dozen culverts per year and going forward we should discuss this with the landowner before we do a culvert replacement and recommend we charge the landowner for the cost of the culvert replacement.

Mrs. Cohagen asked about the side yard of the township. Maniaci stated we had some issues with the mower.
Mrs. Cohagen asked about any plans for a building or shelter for all of our equipment that we have sitting outside. Fusner stated that the extra lot we have was intended for a shelter. Maniaci stated that we have and will discuss plans for another building or structure to house our equipment and work on getting some quotes on this.

Mrs. Cohagen asked if there has been any more thought on making our township facility a disaster shelter site. Maniaci stated he would talk with Bo Keck about how to proceed.
Fusner stated that he discussed with a Falls Township trustee on zoning requirements and process and stated that we should definitely go through an attorney. Fusner stated they go through Albers and he would call them to give us some information on zoning process and the cost associated with this process.
Mrs. Sellars asked trustees about the type of zoning we were thinking about. Maniaci stated we don't know much about zoning right now and will bring in attorney Albers to discuss this with us.
Baughman asked trustees if our 2 hour safety training requirement for the Frank Gates workers compensation group rating program has been met this year. Maniaci stated all the trustees have done the training but will call and confirm that we have met the requirement.
Baughman stated that he met with Loren Bates about our 2010 and 2011 audit and Loren stated the audit is complete and is waiting on the Auditor of State to sign off on it so we can schedule an exit conference. Baughman will advise trustees when finalized.

Maniaci introduced Jeff Cashman and Kevin Howell from Wicert to follow-up on insurance options. Mr. Cashman presented a five point program outlining items to consider when choosing a health insurance plan, plan options, carrier and broker. Mr. Cashman discussed options such as maintaining our current plan and carrier, selecting a different broker, such as Wicert, or choosing a high deductible plan with a (HRA) or (HSA) option to name a few. Mr. Cashman stated he would be at next meeting to discuss options again but it's up to the township on how we want to proceed with our plan and broker.
Maniaci opened for old business.
Fiscal officer Baughman gave an update on FEMA grant. Baughman met with FEMA representative on October 5th to complete initial application forms and review information the FEMA representative needs to prepare the grant. The due date for submission of the grant is 60 days from the October 5, 2012 meeting. Baughman is gathering the information needed for the grant application and will submit to the FEMA representative.
Maniaci indicated that the township sign at entrance has been updated.
Maniaci asked Fusner about an update on St. Mary's culvert. Fusner stated 36" culvert would suffice in order to put up the guardrail. Doug Davis and Zemba both feel structure is good but not quite wide enough for road. Maniaci asked about extending the box culvert. Fusner stated he would talk with Doug Davis again about this option and suggest the route we should go.
Maniaci addressed the use of the township garage as a Shelter. Maniaci spoke with Bo Keck, Chris Fenton, Mark Brown and James Applegate of the Red Cross. The garage with the restrooms and kitchen is suitable for the shelter needs and Mr. Brown and Mr. Keck were in favor and said they use their Falls Twp. buildings as a shelter. Maniaci stated that if we decide to go with the shelter we should consider adding a generator. We also need to look into adding all our Township buildings with smoke and fire alarm security. Maniaci made a motion to use the "original" fire building as a shelter for the Red Cross and future disasters. Fusner seconded. Roll Call: Maniaci ayed, Fusner ayed, Hittle ayed.
Fusner addressed zoning. Fusner stated before working with attorney we will contact the Ohio State Extension Office for more information. Fusner talked with Springfield Township and he referred to ORC 519 regarding Township Zoning to assist us through the zoning process.
Maniaci stated he spoke with The Frank Gates Company about training BWC requirements. We need to take one class. Matt Hittle will be attending this class to full-fill our training requirement.
Maniaci stated that he and Fiscal Officer Baughman met with Loren Bates for our 2010 and 2011 audit exit meeting. The audit was good and will be available after Auditor of State signs off on it and provides us with the final reports.
Maniaci addressed the equipment shelter spoke of at our last meeting. Maniaci met with couple different people about some estimates and indicated that without any engineering we would be looking at couple hundred thousand dollars. We will continue to explore our options. Jerry Miller suggested building an actual salt bin first and cost compare before pursuing the shelter.
Maniaci addressed status of new Kinstle Sterling Dump Truck. The truck ordered was wrong and is being fixed. Maniaci stated because of this we have to fix the paper work for the financing and also need legal counsel to sign off on opinion letter required by Mercedes Benz Financing.
Mrs. Cohagen asked Maniaci if we had contacted our prosecuting attorney, Bud Chess. Maniaci stated we did and Mr. Chess stated this is not something he is comfortable addressing an opinion on and deferred to other legal counsel. Because of Mr. Chess’s un-comfortableness, we have to seek outside legal counsel to render this opinion. Maniaci made and read resolution for legal counsel. Be it resolved that this board finds it necessary to obtain legal counsel for purpose of rendering an opinion to Mercedes Benz Financial, Jim Kirshack is hereby appointed for said purpose, with compensation to be $175 per hour to a maximum 5 hours to be paid from township fund. The trustees or any one of them is hereby authorized to execute any documents necessary to carry out intent of this resolution. Fusner seconded. Roll Call: Maniaci ayed, Fusner ayed, Hittle ayed.
Mrs. Cohagen asked about mowing of the township back yard. Maniaci stated the mowing has been started but not yet completed.
Mrs. Cohagen asked about status of the installation of our township logo on our trucks that had been approved earlier this year. Maniaci stated he would get them on the trucks.
Mrs. Cohagen asked why the Dump Truck and John Deere tractor was sitting at Mr. Moran's house this morning at 10:30am. Maniaci stated it needed refueled and there was an issue with the battery and a bad starter on the John Deere. Mrs. Cohagen also referenced missing signs on various roads and the need to mow high weeds along various roads and the cemetery on Shannon road.
Hittle asked if this was unusual that the equipment sits at other places other than the township and mowing on days it rains. Mrs. Cohagen stated that she called Maniaci and asked why our employees were mowing now instead of the weeks prior when the weather was nice. Maniaci stated that the weeks prior Curtis and Charlie were working on repairing and painting our existing spreader. For safety reasons it takes two of them to lift and bolt up the spreader. Also, painting in closed doors in the heat is too volatile. Maniaci indicated that we are mowing and weather has had impact on the amount and times needed to mow.
Mrs. Cohagen asked if we were ready for winter. Maniaci stated we were prepared and fully stocked for winter.
Mr. Dunfee asked about the Vanderbark chip-seal. Fusner stated that we need to measure Vanderbark in order to reimburse Licking Twp for their service.

Maniaci stated that due to timing of meeting we didn't receive fire report for October but would post to the web site when we get it.
Maniaci made note that the Welch Road culvert was done for $647 by the county engineer and was paid for out of our type 1 funds we are awarded each year. Zemba had previously quoted us $4,495, therefore we experienced significant cost savings and we continue to monitor and watch how we spend our tax dollars.

OPENING: The Muskingum Township Trustees met in regular session on December 6, 2012 at 7:00 p.m. in the Fire Building. All trustees and fiscal officer were present. There were 4 residents present.

Fiscal officer presented a payment to Falls Township Fire Department for trustee approval. Maniaci made motion to approve payment of $10,000 to Falls Township Fire Department to comply with our contract. Hittle seconded. Roll call: Maniaci ayed, Fusner ayed, Hittle ayed.

Fiscal officer presented “then-and-now” appropriation for approval for the first payment on the new Kinstle Sterling truck. Mrs. Sellars asked clarification of the minutes read pertaining to zoning and hiring an attorney. Maniaci stated that the attorney was not for zoning and was only hired one-time in order to issue an opinion required by Mercedes Benz financing of the new Kinstle Sterling truck.
Fusner stated he spoke with Doug Davis regarding St. Mary’s drive culvert. The trustees will meet with Doug Davis at beginning of next year to finalize plans for the culvert.
Fusner stated he spoke with Matt Russell about a cost for the chip-seal for Vandenbark Drive that Licking Township did for us. The total was about 4 tenths of a mile approximately $330.
Baughman gave an update on the FEMA Grant. The grant application was finalized and submitted as of November 6, 2012 for $3,983.12.
Baughman stated that the 2010 and 2011 Muskingum Township financial audit has been finalized and released by the Auditor of State of Ohio on November 9, 2012 and is available for inspection at www.auditor.state.oh.us.
Maniaci stated Jeff Cashman from Wicert Insurance was unable to attend meeting this evening and read an email received from Mr. Cashman which reiterates previous discussions about deciding on a broker to manage our healthcare cost and basically they receive the same carrier quotes as the ones we have already received.
Baughman stated that he met Jared Dosch and again with Todd Johnson to discuss health insurance cost. There is significant savings available by incorporating a (HRA) Health Reimbursement account or (HAS) Health Saving Account option. Fusner stated he had also spoke with Todd earlier about changes to health insurance. Todd Johnson did however indicate that first of the year changes could be delayed due to the high volume of open-enrollment processing by the carriers. Todd also indicated that with the new health care law headed our way any changes made now may need to be changed again by the end of 2013. There is significant savings available, however this depends on implementing the aforementioned changes and impending health care law changes coming in 2013.
Maniaci asked about any new updates on zoning. Fusner stated nothing at this time and is waiting on return call from John Congolosse, the OSU extension Land Use Team Coordinator, and a David Bibipplo from Medina County OSU extension office.
Maniaci stated the new truck is being completed and painted and should have next week.

Fusner read a thank you card received from Shirly and Darrell Woods to the trustees for a job well done on the chip-seal roads this year.
Fusner state he spoke with Chippy Vanderbark. Mr. Vanderbark was concerned about how and if the fire department would be able to access his house due to the recent train derailment near his property.
Fusner stated that he and Curtis discussed the need to trim some overhanging trees on McCoach Road.
Fusner stated there was a culvert on 8037 Cranberry needing replaced. Maniaci stated he thought that the Township would replace the one at the bus turnaround and the landowner would replace the other one. Hittle stated that it is up to our discretion and case by case if it affects our roads and culverts.
Baughman presented a letter from State of Ohio regarding the annual renewal of liquor permits by vendors in our township. If we object to this requirement and wish to have a hearing we need to make a resolution. Maniaci made a motion not to object to the State requirement, defined under O.R.C 4303.271(b), for the annual renewal of liquor licenses by vendors located within our township. Hittle seconded. Baughman presented and stated he filed the required Annual Notice of Exemption from Continuing Education Requirements Pursuant to the Ohio Revised Code 135.22, as required by Fiscal Officer’s.
Baughman asked trustees if they were aware of any current contracts or terms with Time Warner or ATT before he contacts them to discuss and negotiate contract renewals. Trustees stated previous fiscal officer would have negotiated our current contracts.
Baughman asked trustees if there is a meter on our diesel fuel tank to monitor and compare against our invoice from Co-Alliance as they replenish the tank monthly. Maniaci will discuss with Curtis on process to monitor this so we can compare with our monthly invoicing.
Hittle stated we need to decide the monthly meeting sign panels to install on the township sign at the front entrance. Hittle made motion to approve the signs not to exceed $300. Maniaci seconded. Roll call: Maniaci ayed, Fusner ayed, Hittle ayed.
Maniaci stated he spoke with Mark Brown about available grants for a generator. Mark stated he was not able to locate any grants for such purchase at this time.

2012 YEAR END MEETING MINUTES
BOARD OF MUSKINGUM TOWNSHIP TRUSTEES
December 27, 2012
PURPOSE OF MEETING: Regular Meeting.
OPENING: The Muskingum Township Trustees met in regular session on December 27, 2012 at 7:00 p.m. in the Fire Building. All trustees and fiscal officer were present. There were 2 residents present.

Fiscal Officer presented trustees with resolution to amend two appropriations necessary to realign funds from one account to another for the December insurance premiums. Appropriations were realigned from other expenses to health and medical expenses within the General Fund and the Road and Bridge Fund. Fiscal Officer certified funds availability and Maniaci made motion to accept appropriation #53-2012 and #54-2012 and to realign appropriations within the said mentioned General Fund and Road and Bridge Fund from one account to another per O.R.C. 5705.14 and 5705.16. Fusner seconded. Roll Call: Maniaci ayed, Fusner ayed, Hittle ayed.
Fiscal Officer Baughman stated we received a check in the amount of $6,115 from Mar-Zane for reimbursement of duplicated payments on invoices dated July 31, 2009 and August 31, 2009. The payments were duplicated due to payments made off of a monthly statement rather than a matching invoice. Baughman indicated he did go back and review 2009-2012 and did not identify any other similar duplicated payments.
Maniaci opened for old business.
Maniaci stated that he spoke with Curtis about the diesel fuel provided by Co-Alliance. The vendor has a monitoring device on his truck that tracks the amount of diesel fuel put in our tank and billed on our monthly invoice.
Maniaci stated that after the last meeting he went down and met with Todd Johnson at Rankin regarding insurance premiums and learned about the HSA and HRA options. Todd Johnson stated that in another 6 months we will find out more about the new healthcare law and how this will impact everyone and would hold off any changes until we know more about the coming law and new requirements. Fusner stated he did however receive paper work and discussed with Todd potential savings due to changes to his policy.
Maniaci asked about Zoning. Fusner stated he has been in contact with OSU extension office for information. Fusner stated he had talked with another trustee from another township and the trustee mentioned if he had to do over again he would have had the residents get a petition for zoning first before spending all the time and township money on it first.
Maniaci stated Matt Hittle completed the 2 hour safety training as required by Frank Gates Company for our workers compensation premiums and rates.
Maniaci stated the new truck is finally here.

Maniaci stated that with the first snowfall we are out on the roads and trying to stay ahead of the weather.
Maniaci stated that we need to schedule our annual back-flow testing required by the health department for 2013. Hittle stated he will speak with Professional Plumbing, Dean Burkhart about getting the inspection taken care of.
Maniaci stated the annual inventory is being worked on and will be submitted to county engineer by 2nd week of January as required.

PURPOSE OF MEETING: Re-Organizational Meeting
OPENING: Muskingum Township Trustees met in special session at 9:00 a.m. on January 1, 2012 for the re-organizational meeting in the Fire Building. Trustees Mike Maniaci and Steve Fusner and Fiscal Officer Jerri Salmons were present. Matt Hittle was absent due to being out of town. There were 5 residents present.
Steve Fusner nominated Mike Maniaci for Chairman, Maniaci seconded. All ayed. Maniaci nominated Steve Fusner for Vice-President, seconded by Fusner, all ayed.
Maniaci made the motion to have Matt Hittle and Steve Fusner on the Burial Committee. Seconded by Fusner. All ayed.
Maniaci made the motion to keep the emergency labor at $8.00 per hour unless they have a CDL and then they would be paid $10.00 per hour. Seconded by Fusner. All ayed.
Trustees Maniaci and Fusner tabled the cemetery mowing discussion until February since they have no estimates at this time.
Steve Fusner made a motion to increase the road crew workers Curtis Salmons and Charles Mattingly’s pay rate by $.25 per hour. Salmons would increase to $15.50 and Mattingly to $13.50. Maniaci seconded. All ayed.
Mike Maniaci stated that according to the public records policy, public records will be provided in a timely manner/or the next regularly scheduled meeting. That there will be a written request advising what records is requested. The charge will be $.05 per page and $2.50 for cassette tape copies. There will be no free copies made. The handbook will be amended at the next meeting. Fusner seconded. All ayed.
Maniaci passed a credit card resolution stipulating who has township credit cards, who uses them and how much can be spent.

Maniaci made the motion that the Township equipment can be operated by all road crew and trustees or any other person who has been authorized by the trustees or road crew to do so. Fusner seconded. All ayed.
Maniaci made a resolution to have the health insurance premiums and trustees salaries taken from the road and bridge fund and also the general fund. The trustees will use the new “Payroll Certification” form which indicates a percentage of how much time was spent in the service of the Road and Bridge Fund and the General Fund. This resolution allows for the health insurance premiums and salaries to be partially taken out of the road and bridge and general fund. Fusner seconded. All ayed.
Trustees were also in agreement to approve the temporary appropriations until the permanent appropriations come into effect.
Maniaci stated that the public records policy is posted in the township hall, the township garage and both fire stations.
Mike Maniaci made a resolution to nominate J.D. Johnson as the Fire Prevention Officer for our township. He would assume all official duties according to O.R.C.505.38. Fusner seconded. All ayed.
Maniaci stated the inventory will be completed next month and then submitted to the County Engineer within the next two weeks.
The Records Commission, according to O.R.C. 149.42 will consist of a Chairman of the Board; this being Mike Maniaci and the Fiscal Officer, Jerri Salmons will be the Records Commission. Maniaci made the motion, seconded by Fusner. All ayed.
Maniaci made the motion that employees/elected officials who are authorized to use their private vehicles for township business such as conferences, training, etc. will be reimbursed at the standard mileage reimbursement rate established by the I.R.S. of $.50 per mile which is allowable under the O.R.C. Fusner seconded. All ayed.
Trustees agreed to keep the record keeping policies that are in place now, the same as in the past. Which are according to the handbook we have. Fusner seconded.
Maniaci moved to keep the regular monthly township meetings the first Thursday of every month at the township fire station at 7:00 p.m. That is will be posted in the newspaper once, on the website and posted monthly on the sign in the front of the township. Any changes or special meetings will be posted on the website, the sign out in the front of the township hall at least 24 hours before the meeting. Fusner seconded.
In regards to “Storage and distribution of personnel files and personal information”, Maniaci appointed the fiscal officer to have control of all files. Fusner seconded. All personnel files will be in a locked filing cabinet at the township building. There is to be a written request specifying what type of personal information people want. Fiscal Officer was informed that he/she is responsible for all the rules adopted in accordance with these section and will show trustees the requests made; they can sign off on the request which will show they are monitoring the accuracy of the requests. If there is a question of what can or cannot be released, fiscal officer is to contact legal counsel, Bud Chess. If above rules are not followed a written reprimand could be issued from the prosecutor’s office and could lead to termination depending on the situation. Maniaci made the motion to accept this procedure. Fusner seconded.

Todd Sands who is a candidate for County Commissioner and Carol Friel candidate for County Treasurer were present at the meeting and also spoke briefly.
Maniaci made the motion to go into executive session for item #4 which reads: Reason for executive session preparing for conducting or reviewing negotiations or bargaining sessions with public employees concerning their compensation or other terms and conditions of their employment. He also wanted to invite the two township workers, Curtis Salmons and Charles Mattingly to go into executive session with the trustees. Steve Fusner seconded. All ayed. Roll Call: Maniaci ayed. Lynn Sellars asked about the closing of the Muskingum Township Fire Department mentioned in previous minutes. Maniaci stated he thought it was mentioned in previous minutes and he was wrong.
Thelma Cohagen asked about filing charges of the fire department missing equipment. Maniaci advised we are waiting for Falls Twp Fire Chief to provide him an accurate list.
Thelma Cohagen also inquired about the letters to homeowners when debris needs to be cleaned up around their residence. A certified letter was sent out to the resident on Creamery Road and it was received on February 1st. He has 7 days to comply before we can clean it up and assess his taxes.
Cohagen asked about the status of Northern Place. Maniaci advised that Mr. Tanner will be taking care of it himself.
Lynn Sellars had questions about the 2008 fire truck. Also about minutes being recorded correctly when they have been said in the meeting. Maniaci informed her that he spoke to the prosecutor’s office in regards to everything being put into the minutes and Maniaci was informed that basically what the township trustees say needs to be recorded accurately and put into the minutes and what the people in the audience say can be summed up and does not need to be printed word for word. In the future if we do not believe it needs to be done word for word we are just going to make mention of it that it was brought up in a meeting and not print things word for word.
Tom Huey wanted to say Thank you for putting the meeting dates and times in the paper. Maniaci advised he would come to Mr. Huey’s house and discuss the old fire department.
A female resident thought it should be put on the ballot where we want our tax dollars to go in regards to the fire department.

The telephone line on Chug Run Road has been taken care of. The phone line pole has been fixed.
Fusner asked if Maniaci had talked to the resident on Gorsuch Road about his culvert that is up out of the ground. Maniaci advised he had not done that yet.
Maniaci asked about anything from the R&L Trucking. Fusner advised he has not heard anything back from them yet.
Thelma Cohagen asked why the minutes were removed from the website. Maniaci stated they are still available like always, and a lot of people were taking information off of them for the wrong reasons to use against the trustees so it was decided to remove them.
Cohagen asked about a newsletter to the residents. Trustees stated yes they are, but will review the O.R.C. before doing so.

Thelma Cohagen inquired about the pavement on Jones Road breaking up.
Maniaci stated there is culvert that is sinking on Welsh Road. Encased in concrete on both ends of it. It is heavier than our backhoe can handle by itself. Maniaci did have Zemba’s give an estimate to remove it. No reply back from Kendrick’s Excavating. Zemba’s bid was almost $4,500. Trustees did have a meeting with the County Engineer and they talked to him about having them work something out with their workers to take it out and our guys can replace it. Or if they could bust the headwalls off of it, our guys could take care of it. It should be able to be taken care of without outside help.
Maniaci advised that the salt bin roof is leaking on the back side. He spoke with Chris Mitchell, contractor and he asked if we had contacted our insurance company because it is due to wind damage. He stated for a very low price he would go up on the roof and repair it so it will quit dripping until we decide if we want to replace the roof. Matt Hittle advised he will look at it and take care of fixing it. Curtis Salmons said the whole roof does not need replaced, just the few shingles replaced. Hittle said he can do it.

Maniaci informed the residents that the Attorney fee for the lawsuit against Steve Fusner and Jerry Miller totaled over $44,000.00. Our portion of that fee due by the township is $6,688.00.
Thelma Cohagen asked about the property on Creamery Road. Trustees advised that the property owners are working on it at the time. Property owner did speak with Matt Hittle in regards to burning some items, and Hittle advised him that he could. Fusner stated there are other properties in our township that need attention. That he went to a class at the township conference in regards to “Abatement Control and Removal of Vegetation, Garbage Debris and Refuge”. Ohio Revised Codes 3767.41 and 505.87. Thelma Cohagen asked about the missing fire department equipment. Maniaci received a list from Chief Johnson. He informed Maniaci that all missing gear and radios have been turned in according to the list we had. The only thing he is pursuing at this time is the missing projector, door lock system and personnel files.
Thelma asked if the salt bin roof had been repaired yet. Hittle advised no it has not, but will be soon. Maniaci advised we do have insurance to cover damage to the roof.
Maniaci advised that the signs for the trucks are in and look good.
Maniaci stated in regards to the truck from R&L trucking that was in Kenlo Woods and did road damage, did reply back to our letter asking for reimbursement. They informed trustees they will not pay for road damage because drive was in a housing development making an in-home delivery and there was no other alternate route available. Fusner did call R&L back and left her a message advising we would be following up with our prosecuting attorney. He will also send a letter to R&L’s insurance company.
Maniaci also advised when we had our sub-driver working on Conn Road spreading salt, he was hit head on by another vehicle. No injuries. State Patrol came and a report was made. Insurance Companies have been contacted. Curtis did get estimates. There was damage to front bumper and fender. One quote he did get back was for $3,600. He is awaiting two additional quotes.
Maniaci spoke with Becky Mock Vansickle, Phil Mock’s daughter, in regards to Stagecoach Road. She stated the person on the other side of the road purposely planted pine trees on the edge of the road. And as they grow, every time we chip and seal or do something it is always being pushed over onto her property. She did cut the trees down on that bank. She thinks that he should be made to take those trees out and let the road go back over where it started out. They spoke to the engineer about it and they were going to send someone out to look at it. Maniaci did speak to him today, and they did send a guy out and they are questioning where the right-of-way line is and where the middle of the road belongs. They are pursuing it at this time.
Maniaci said in regards to culvert on Gorsuch Road that he did speak to the wife of Chris Luthi and she advised that one section of it is really bad. She stated her husband would take it out and put it back to a ditch. Maniaci will pursue this if he doesn’t see any action in the near future.
Brian Williams had an issue the trustees need to take care of dealing with lined fences. He was advised by the recorders office at the courthouse that one of his adjoining neighbor’s fences is reversed. Looking at your lined fence, your neighbor is responsible for the right had side. If he looks at his, it is the same way. It needs to be recorded in the courthouse, because as it stands right now it was just a gentleman’s agreement made many years ago. Williams’ neighbor is in agreement and will sign a paper stating this. Fusner advised it may have to be submitted to the trustees in writing. Fusner said he will get with Williams so they can go look at the fence.
Don Clark said the trustees need to contact Brady Johnson and see if they can get scored. His insurance agent said we are still at the old ISO rating. Maniaci said these are steps that Falls Township Fire Dept must take. Maniaci stated they must rate and evaluate all 3 stations at one time and he will find out how long before this can be done.

Don Clark asked about getting the end of Powellson Road swept. Maniaci will call the engineers office and check on this.
Maniaci discussed a new type of mixture called micro-seal, he thought might be good for our township that he seen while at the township conference. It is harder than asphalt and water doesn’t penetrate as well through it. It would be approximately $30,000 a mile. The cost of chip and seal is around about $7,000 a mile. So it would be around $37,000 for this type of road. He feels it is something we should look into this. This should last approximately 6-9 years and is only good on certain roads. Two representatives from this company will come to our township the week of March 12 and ride all of our roads and assess and rate them. At the meeting in April they will present us with a proposal as to what they can do for the budget that we give them.
Mike also spoke with a Company rep from HEI-WAY in regards to cold mix. They will deliver 22 tons for a minimum of $87.55 a ton. MarZane charge $90.00 a ton. Sidwells price is $110.00 a tone and we had to get it. This company did offer us 20% off our first load. All trustees agreed to try this company, they will deliver it. Trustees had an open meeting in regards to roads, with the engineer at the Welcome Center. He gave them an agreement to sign in regards to roads because of the Shale Company and overweight permits. This agreement would allow them to monitor and use permit fees for their monitoring. It would be both theirs and our agreements when the roads got put back, that everybody would have to agree that the roads were in shape. Trustees are not signing tonight, because it is being re-written. It will be ready next Friday and will look at it at the April meeting for signing.
A letter was received from the County Engineers office stating that the amount of road our township must maintain is 47.175 miles.
Last year we did chip and seal with the county and Maniaci would like to make a motion to continue that again this year to let the county do our chip and seal. Hittle seconded. Roll Call: Maniaci ayed, Fusner ayed, Hittle ayed.
Maniaci said that last year we bought our own limestone for the chip and seal, which we bid out. He wanted to make a motion to put the stone, pea gravel and limestone, out for bid again. He will get a letter of requirements to the fiscal officer to put in the paper for up to 1,500 ton of gravel. Maniaci made the motion to bid out the stone for chip seal. Hittle seconded. All ayed. APRIL 2012 Regular Meeting
BOARD OF MUSKINGUM TOWNSHIP TRUSTEES
DATE: April 5, 2012
PURPOSE OF MEETING: Regular Meeting.
OPENING: The Muskingum Township Trustees met in regular session on April 5, 2012 at 7:00 p.m. in the Fire Building. All trustees and fiscal officer were present. There were 8 residents present.
The minutes were read and approved.
Checks were approved and signed for payment.
Bids for gravel and limestone were opened. 1 bid received from Shelly Materials. $19.35 per ton for limestone and $13.75 per ton for gravel. Difference in cost based on 1200 tons bid was $5.60 per ton or $6,700.
Maniaci made a motion to accept bid for gravel at $13.75 per ton. Fusner seconded. Roll Call: Maniaci ayed, Fusner ayed, Hittle no.
Bids for lawn mowing were opened. 3 bids were received.
Twin Hills Landscaping bid was $3,710, $530 per month for 7 months. Muskingum River Lawncare, Colbie Kensie, Dresden, Ohio bid was $3,500, $500 per month for 7 months. One bid was thrown out due to not being received in non-sealed envelope as required per bid proposal requirements. Mrs. Sellars ask why trustees weren’t looking at the one bid. Maniaci stated due to not being sealed bid and risk of being tampered with we have to throw it out based on bid proposal requirements. Mrs. Sellars ask if we take the lowest bid. Maniaci indicated we take the lowest and best bid. Hittle made motion to accept the lowest bid. Maniaci second. Roll Call: Maniaci ayed, Fusner ayed, Hittle ayed.
Maniaci opened up for old business. Mrs. Sellars asked if we still have the following Township equipment: International, 1988 Chevy 4x4, 1994 Ford Tanker, 1979 Red Tanker and 2001 Yukon. Maniaci stated we still have this equipment. Mrs. Sellars ask if equipment was kept at Muskingum Township. Maniaci stated equipment is here and Yukon stays mostly at Falls Township. Fusner said Falls leaves squad at our township. Maniaci said Falls is allowed to use vehicles as they need.
A Female resident asked about clean up of properties and mentioned old shell station and if health department was contacted about the contents still remaining inside. Fusner stated this property was on our list and trustees weren’t aware of the contents still remaining inside. Mr. Benson stated it was owned now by Huntington Bank. Fusner stated he would follow-up on this property.
Mrs. Cohagen stated property on Creamery Road, owned by Mr. Hallack, was not much better and asked trustees if there was a time frame when property was to be cleaned and suggested another follow-up. Fusner stated next letter will indicate more specific nuisance and cite Ohio revised code pertaining to trash and vehicle clean-up.
Mrs. Cohagen asked about property next to Green Tea Room. Fusner stated prosecuting attorney recommended trustees contact sheriff’s department regarding removal of vehicles. Mrs. Cohagen also referred to the property South of Bogeys for clean-up.
Mrs. Cohagen asked about the salt bin roof repair. Maniaci stated insurance looked at it and we received the check. Maniaci has received one bid from Chris Mitchell, Camm Construction Services. The roof has 3 tab shingles, which are not the best and Camm recommended 3 dimensional shingles which are better. Bid was for $4,800. Mrs. Cohagen asked about getting bids for steel roof vs. asphalt shingles. Fusner stated Higgins previously talked us out of the steel vs. asphalt due to the sweating and salt. Maniaci stated we can look more into the asphalt shingles vs. the steel roof before decision is made.
Mrs. Cohagen asked about follow-up on the Kenlo woods property damage. Fusner stated he has not followed-up due to not knowing name or address to contact. Mrs. Cohagen stated to contact PUCO to obtain name and address to contact. Fusner stated he would do so.
Mrs. Cohagen asked about insurance claim and estimate on damaged truck from accident. Maniaci stated truck in process of being finished this week. Insurance had obtained 3 estimates which they settled on $3,600 estimate. $700 has been spent so far with this repair and will be finished this weekend.
Mrs. Cohagen asked about culvert on Gorsuch Road. Fusner stated we need to move on this as nothing has been done and Maniaci stated the resident has been given deadline of this meeting to get something done and if it wasn’t the Township would come and take it out for him.
Mrs. Cohagen asked about Brian Williams’s fence issue. Fusner stated Mr. Williams has not contacted him about this to-date. Fusner will get with Mr. Williams on this.
Mrs. Cohagen asked about contacting JD Johnson about fire department rating. Maniaci stated he has contacted JD Johnson and JD indicated Muskingum and Falls Township’s Fire Department are about 1 year apart on how they figure the rating and he is trying to get both somewhere in the middle so he can get both departments rated at same time. No exact time frame was given, maybe within 6-8 months, not guaranteeing it.
Mrs. Cohagen asked about minutes and updated Fiscal Officer Information on web-site. Maniaci said he would work on it this evening.
Mrs. Cohagen asked about Powelson Road. Maniaci stated he talked with Donny and he said it’s not something they are doing this time of year but would make a point when they get their brush out to brush off that corner for him.
Mrs. Cohagen asked about meetings on shale drilling. Mrs. Cohagen stated most township were present except ours. Maniaci stated Muskingum Township Trustees were present at the first meeting they were invited to. Mrs. Cohagen stated each meeting was different. Maniaci stated according to engineer first meeting was for the township officials to get on board and second were for businesses. Fusner stated he was at meeting in St. Clairsvile that was the same as one at welcome center. Mrs. Cohagen indicated a lot of good information presented about township roads and what county was doing about obtaining good contract and what state wasn’t doing. Fusner stated Ohio Township Association is working on RUMA (Road Use Maintenance Agreement) and everyone is working on putting these contracts together. Hittle stated the meetings were run by Steve Strauss. Maniaci stated commissioners are not involved with these meetings except for Steve Strauss. Fusner stated our secretary of Township Association is second Vice President of Ohio Township Association and keeps us updated.
Mrs. Cohagen asked about Vista View Road issue. No knowledge of a petition raised to-date. Maniaci stated he has not talked to Lepi but has talked with Dave Smith about it. Maniaci stated he would also try to make contact again. Maniaci said Zemba’s estimate was approx. $110-120K and county’s estimate was approx. $80K without double chip and seal. County revised estimate with asphalt for approx. $100K. Estimates were over year ago and will need to be revised. Maniaci stated a petition has to be obtained with 51% brought to trustees before we can proceed or obtain right-away agreement. Fusner stated South View has been most paved road since he has been trustee and is very bad and continues to roll. Maniaci stated a revised agreement has been received by county engineers with a sample of road repair/maintenance agreement. Maniaci presented it to trustees for review.
Fusner said Micro Seal was not present tonight due to wife illness and would be at May meeting.
Maniaci read letter from Muskingum county engineer’s office regarding Old Stage Coach Road. The letter indicated research regarding Old Stage Coach road has found no established right away with for this road. The existing right away is considered what is necessary to keep the road safe and efficient for the traveling public and does not allow for widening the road. Based on these finding and discussions with Muskingum County prosecutor office the only way to legally widen any portion of this road would be to acquire property or easement from adjoining land owners first. This can be accomplished with an easement document. Maniaci stated we are back to square one and need to talk with property owner who planted trees to chop them down.

Mr. Benson asked about missing equipment discussed in minutes and discussions with JD Johnson. Mr. Benson stated when department was dissolved the doors were locked and changed unbeknownst to the members and does not know what was there or not after the locks were changed. Mr. Benson stated he did not understand why trustees would take Mr. Johnson word and judgment instead of Mr. Benson’s staff regarding the inventory. Maniaci stated it wasn’t judgment. Maniaci stated minutes were meant to portray was a list of gear that we had record of and not accounted for. Maniaci asked Mr. Johnson for a list of inventory recovered and Maniaci compared this to his list of missing equipment. Maniaci stated only the projector and door lock system have not been returned but no gear. Maniaci didn’t ask Mr. Johnson about the projector and door lock and only about the missing gear.
Mr. Benson stated he received some anonymous information about Mr. JD Johnson. Mr. Benson stated Mr. Johnson had been terminated from his position of employment which is a private fire service entity and raises a question about Mr. Johnson receiving our township tax levy money, access to, and how used. Maniaci stated Falls has a board that makes these decisions and votes where money goes.
Mr. Benson stated he received a phone call from a person from same fire station regarding Mr. Johnson’s termination. Mr. Benson did a Google search on Mr. Johnson to follow-up with this information received. Mr. Benson Google search stated Mr. Johnson had been arrested for indecent exposure in Big Walnut Park in May 2008.
Mr. Benson mentioned that in the past as fire chief he had brought to Muskingum Township two names, Tyler Starling and Mark Lewis, to be approved. Their background check was clean but was denied joining fire department due to attitude and poor disposition. Mr. Benson asks if any investigation was done with any members of Falls Township fire department employees before contracting with them. Maniaci stated he can only speak for himself and said he did not. Fusner stated he did not. Mr. Benson stated he would have thought the trustees had done due diligence on Mr. Johnson and held Mr. Johnson to same standard as was done with our own members. Mr. Benson offered all paper work he has to trustees and recommended trustees to investigate Mr. Johnson public records and charges.
Mr. Benson stated he contacted trustees’ employers about policy regarding similar circumstances surrounding Mr. Johnson’s termination and employer’s stated circumstances would be grounds on termination. Mr. Maniaci asked Mr. Benson who he spoke to and Mr. Benson said he agreed to anonymity and Maniaci stated Mr. Benson statement is conjecture because Mr. Benson wouldn’t reveal names and no proof of the conversation.
Mrs. Cohagen stated she understand Mr. Benson’s concerns and motivation but doesn’t understand why he is bringing these questions to our trustees when this should be brought to is Falls Township’s Fire Department board who employs Mr. Johnson. Mr. Benson stated he is concerned with our fire levy money of $111K being given to Falls with a man in charge convicted with indecent exposure. Mr. Hittle asked Mr. Benson if Falls Fire Department board have a policy where background checks are done. Mr. Benson did not know. Mr. Maniaci asked Mr. Benson if he would turn his records over to trustees. Mr. Benson stated he found it strange that Mr. Johnson was convicted in 2008 and later terminated in 2012. Mr. Benson asked if trustees would do an investigation and have Mr. Johnson at next meeting for more answers.
Maniaci said he understand Mr. Benson’s reports in writing however Mr. Benson’s information regarding Mr. Johnson’s termination is what he heard from a friend of his in the fire department. No actual proof other than someone else’s word. Mr. Benson said he called human resources of rural metro, out of Tennessee, to confirm Mr. Johnson’s termination.
Maniaci stated the township did not hire JD Johnson personally to run matters but Falls Township Fire Department which is run by a board. Maniaci stated trustees would look into this matter and make a request for Mr. Johnson’s attendance. Hittle stated we can’t guarantee JD Johnson attendance. Maniaci thanked Mr. Benson and said trustees will look into this.
Mrs. Cohagen asked about competitive bidding threshold. Fusner stated this was increased September 2011 to $50K. Fusner said we still should get competitive bids and Maniaci stated we intend to bid strictly to keep amount we pay and get the best service we get.
Fusner indicated Shelly Company gave us estimate last year on McCasslin road and will still honor estimate. Maniaci stated trustees already accepted the bid last year for the $18,960 bid. Maniaci stated he spoke with Kevin West about the alternate bid for Harper Drive. The Harper Drive alternate for $5,400 was not decided at time and still will honor the price. Fusner made motion to accept the Harper Drive alternate bid of $5,400, Hittle second. Roll Call: Maniaci ayed, Fusner ayed, Hittle ayed.
Fusner stated Northern Place, when their ready, one of trustees or Curtis should be present to make sure soft spots are dug out to and taken care of.
Fusner stated he spoke to Rob Thompson about Oakwood 3 getting this done this year. Fusner stated he would follow-up.
Fusner stated the high grass on Vista View drive owned by Dot.com investments and another letter needs sent identifying nuisance law and Ohio revised code, vehicles 505.871 and 3767.41 for inhabitable places, public menace. They have 7 days to reply before we can decide on mowing. Fusner to get addresses for letters to send.
Fusner stated he received phone call regarding Woods Road. This road was changed to McCasslin road years ago and no one knows why. According to ODOT it should be Woods Road. Mrs. Sellars ask Fusner about previous discussions with resident not wanting road name changed. Mrs. Sellars stated there is an ORC regarding if one person doesn’t want changed it has to be left alone. Fusner stated all county maps and on our inventories indicate Woods Road. Bud Chess will let us know about this change and all details that will affect this.

Maniaci ask Mr. Benson follow-up question – do you have any idea where projector is? Mr. Benson stated he did not know. Maniaci stated sheriff will probably pursue the missing inventory.
Mr. Benson asked about Yukon being used by Falls Township. Is there any discretion on how they can use it since it was purchased by our township funds? Mr. Benson said he has seen it at Buffalo Wild Wings, West Pike McDonalds and all over their township. Mr. Benson stated it was purchased for our township and not Falls Township. Maniaci stated Falls is a subcontractor of our township. Mr. Benson asked for our township to contact Falls to be more discretionary about the use of our township’s vehicles and hold them to a higher standard. Maniaci stated Falls Township’s jurisdiction is Falls and Muskingum Township but would address Falls Township about the use of the vehicles when asking them about previously discussed issues.
Maniaci discussed the 1994 Ford Tanker and the 1988 GMC Rescue that were not in use and hasn’t been used since Falls took over Fire Department and proposes to offer them up for sealed bids. Fusner stated they are costing Township more in insurance than they’re worth. A male resident ask if we sold these would we replace them. Maniaci stated Falls will replace the tanker with another squad in our building. A male resident asked about the staffing Muskingum fire station because Falls Township response time was 9:45 minutes roughly and Muskingum Township previous was 8:18 minutes roughly. Maniaci and Fusner stated maybe down the road but there is not enough runs to warrant more staff paid to be in here on regular basis. Maniaci stated that fire districts are becoming more prevalent and more economical and will be coming soon in the near future. Fusner stated that other Townships are dealing with unemployment issues with a partial paid Fire Department staff.
Maniaci made a resolution, in accordance with ORC 505.10, resolution 4-2012 to put up for bid and accept sealed bids for the 1994 Ford Tanker and 1988 GMC Rescue due to vehicle no longer useful to Muskingum Township, Muskingum County of Ohio. Sealed bids will be advertised in Zanesville Times Recorder and Township website and any other means available to get the best bids possible. Hittle advised to add a reserve or an accept or reject clause to any and all bids to protect the Township on the bids. Fusner second. Roll Call: Maniaci ayed, Fusner ayed, Hittle ayed.
Maniaci asked Mr. Benson about a particular avenue to bid these vehicles. Mr. Benson stated local newspaper and recommended Ebay. Ebay would involve additional fees and cautioned about making sure equipment is specific to what we are bidding out with the truck, and no warranty implied.

Mrs. Sellars stated her research shows McCaslin Road previously was named route 1 and around 1974 or 1975 was changed to McCaslin Road. She provided a picture from Doug Davis that showed the road identified as McCaslin Road and not Woods Road. Mrs. Sellars also presented trustees with maps for their use. According to Doug Davis when the document was signed to change the name of the road to McCaslin it null-an-voided any previous document and road name.
Fusner stated the map presented by Mrs. Sellars was before GPS which was before 1975 and wouldn’t show the road as being Woods Road. Fusner stated he needs to get with Doug Davis about this so he can follow-up with Darryl Woods and let him know about the road name change issue.
Maniaci stated Fusner has done research on this and the prosecuting attorney stated that it is up to county engineer as to what the name of the road is since the county owns it and not the residents, post office or Muskingum Township Trustees. We (the trustees) have no say in the name. The county owns the roads and passes the roads to us (the township) to maintain them.
Hittle stated that he spoke with Mr. Benson and Mr. Benson wanted to let the trustees know he had a medical emergency to attend to and would not be able to attend this evenings meeting for follow-up to the April 5 meeting regarding issues surrounding Falls Township Fire Chief Mr. JD Johnson.
Maniaci stated he reported what was discussed at our April 5 meeting regarding Mr. Benson’s information regarding Mr. JD Johnson circumstances with Falls Township Board and they informed Maniaci that they are looking into this and has put Mr. JD Johnson on administrative leave without pay until a decision is made on what they will do about Mr. JD Johnson. A decision could be made by end of this month.
Maniaci introduced Michael Moses, Mr. JD Johnson’s attorney.
Mr. Moses stated that he represents Mr. Johnson and they are waiting on scheduling a hearing in front of Falls Township Fire Department and hopes to dispose of all the allegations. Mr. Moses is aware of our contract with Falls Township and our interest and offered to come back to the next meeting and report the outcome and resolutions decided. He will also copy Maniaci on any correspondence regarding Mr. JD Johnson.
Fusner stated in regards to Vista View Market, it has no food inside the premises. Jason Tilton from the Health Department visited Vista View Market and stated he has no jurisdiction with this building. Fusner stated we will proceed with the abatement notice. The owner is Vista View Drive Drive-Thru, LLC. The taxpayer is Todd Kaib and we will address the letter to him about the building and nuisance law. Fusner stated that Mr. Kaib is $61,484 behind in his taxes and we need to decide if the township wants to pursue this property with thousands of dollars without being able to recoup any back.
Fusner presented three (3) resolutions referencing ORC 505.87, Abatement, Control, or Removal of Vegetation, Garbage, Refuse and other Debris. The owners be and hereby are Ordered to abate such nuisance by removal of such vegetation, garbage, refuse and other debris on the property and if no compliance within seven (7) days after notice is given, this board will provide for abatement of the nuisance in accordance with Section 505.87 and 3767.41 of ORC.

Fusner stated as for junk motor vehicles, per the prosecuting attorney he has to contact Muskingum County Sheriff regarding properties with junk cars.
Fusner stated while the Sheriff is looking into the above mentioned properties he will have the Sheriff look into other such properties with junk cars; 6415 McCaslin and 6240 Rollins Drive.
Mrs. Cohagen asked about follow-up regarding Mr. Hallack property.
Fusner stated beside the notices sent to Mr. Hallack he is holding off any further action until he can get with the Sheriff on the other properties mentioned above and will address all the properties and resolutions all at once.
Maniaci asked Hittle about an estimate from Hittle roofing on salt bin roof. No estimate was given to date. Maniaci did get estimate from Camm Construction, 18 sqf metal roof replacement, all felt, drip, disposal and accessories for $4,670. The original estimate for an asphalt roof previously quoted was $4,800.

Maniaci gave an update on the accident involving township truck earlier this year, the girl went to court and denied claim, plead not guilty. Maniaci stated he talked with prosecuting attorney lawyers and they are trying to get back our deductible. The truck has been repaired. John Weyer did the body work costing us $700.
Maniaci discussed North Vista View Drive and indicated he talked with Jim Lepi and Lepi is in favor of doing something with this road. Jim Lepi would like to do the repairs but wants to be fair about it as he is concerned that one owner can’t pay the taxes on this repair.
Mrs. Cohagen asked Maniaci how we would take over North Vista View Drive without the same specification with every other subdivision. Maniaci stated that the township would not take it over without same specifications and Mr. Lepi understands that the township could not take it over without these same specifications. Maniaci said Mr. Lepi would like to look into some other ways to take care of this road other than assessing taxes.
Maniaci stated individual from Terry Asphalt could not come to meeting and has no report on when he would be attending.
Maniaci stated that township needs to get our Fiscal Officer, Jason Baughman on the banks signature card and a resolution authorizing Jason as a check signer. Maniaci asked the trustees if they had chance to read permit deal with the county engineer. Maniaci stated the state is trying to pass a Road Use Agreement. The Road Use Agreement is for protection from the heavy equipment traveling on our township roads due to the shale drilling. If the state passes this before we sign ours with the county our township will have to file with the state.
Mr. Forrest Mendenhall asked the trustees if there has been any discussion in any of these shale meetings about bonding of our township roads for the use of the heavy equipment used on the roads. He had not heard anything about bonding in Ohio, only Pennsylvania. The bonds provide that these companies that use these roads will maintain and repair back to original these roads that have been specifically bonded.
Maniaci stated that the Road Use Agreement is not exactly a bond but a similar agreement with the county engineer to perform the work repair on our township roads from the use of heavy equipment on our roads. The engineer would get the money from these repairs and our roads would be restored back to original.
Mr. Mendenhall stated we (township) may be selling ourselves out by contracting with the county engineer. He referenced Pennsylvania townships as an example, townships that did their own repair work worked out better than letting someone else take care of their own roads.
Fusner stated that the Ohio Township Association was working on something regarding these agreements and he would have to ask our Secretary Connie Fink about this as they represent the county township.
Maniaci stated that the trustees meetings with the county engineer led us to believe Pennsylvania was a nightmare and learned the hard way as many roads did not get put back together due to not having an agreement in place.
Hittle stated that the county engineer wants an agreement in place so the townships don’t get left high and dry on these repairs.
Maniaci stated the county engineer agreement would allow to forgo a permit fee and for the county engineer to come out and inspect township roads, take pictures and rate the roads before any truck is traveled on the township roads. The agreement would also call for the roads to be put exactly back to the way it was before these trucks started traveling these roads. The money would go to the county engineer but the money would also go toward the specific township road the trucks are traveling and need of repair.
Mr. Mendenhall stated that if these roads were bonded, this would leave the county engineer out of this and call for these companies to have the road repair work done on their own dollars and not the taxpayer’s tax dollars. Mr. Mendenhall questioned the county ability to repair our township roads and referenced the problems our county has had with repairing North Point Road.
Mrs. Cohagen stated that another issue to take into consideration is the past flooding our township had with flooding on Tunis Road.
Mr. Jerry Miller stated that in regards to the county engineer road inspection and the pictures, it is the township trustees to go out and inspect and take pictures of the township roads and not the county engineer. As soon as this agreement is signed with county engineer this puts all responsibility on the county engineer and the townships will be left with no say.
Maniaci stated that trustees would hold off and table signing of any agreement until a later date.
Maniaci provided update that the culvert on Gorsuch Road has been taken care of.
Maniaci stated more research was needed on the Oakwood North project.
Mr. Cohagen asked about the minutes on the web site not all being available. Maniaci stated he would take care of.
Mr. Cohagen asked about the bids on the sale of trucks. Maniaci stated they have not been posted but would be by the June meeting.
Fusner stated that when researching the Ohio Revised Code on nuisance laws he notice Union Township had a township policy on junk motor vehicles and recommended that this may be something we may want to look into with our township.
Maniaci opened for new business.
Mrs. Cohagen asked about the insurance premium and if it is included on the federal tax reports and asked if it is required to be reported as taxable income or should be reported. The Fiscal Officer Baughman stated he will look into this and report back.
Mrs. Cohagen asked Mr. Hittle about his campaign and him stating he would not sign up for the township health insurance. She asked if he was taking the insurance. Mr. Hittle responded as no he is not signed up for the insurance as promised.
Maniaci discussed a state cooperative purchasing program and recommended being a part of this program. Maniaci made resolution authorizing political subdivision to participate in the State of Ohio cooperative purchasing program. Fusner seconded. Roll Call: Maniaci ayed, Fusner ayed, Hittle ayed.
Maniaci read a letter from Hei-Way, LLC. Cold Mix Company thanking us for our purchase of cold mix.
Maniaci stated letter was received from Ohio Division of Liquor Control regarding Vista View Golf Course enhancing their liquor license and the letter basically ask if we want a hearing on this request from Vista View Golf for their liquor license enhancement.
Maniaci made motion not to object Visa View Golf Course enhancement and no need for any hearing. Fusner seconded. Roll Call: Maniaci ayed, Fusner ayed, Hittle ayed.
Maniaci stated that due to mild winter we have a bin full of salt and still haven’t purchased all the salt we are suppose to. We have one truck load of salt remaining to purchase. We can pay $5 per ton, 23 tons, or $115 and we can store the salt at the vendor until December 31, 2012. Maniaci made motion to accept the $115 storage fee. Hittle seconded. Fusner asked about discussing chip-n-seal of roads.
Mrs. Cohagen stated that another base might be good to get ahead for next year.
Maniaci stated that last year we chip-n-sealed the following roads: Fawn, Squirrel, Dutch School, Stagecoach, Prior, Beech Run, Dresden, Jones and Kenlo Woods. Roads not done were: Chugg, McCaslin, New Riley, Fulton, and Schneider. Paved roads done were: Carnation, Wilson and part of Gorsuch.
Maniaci stated we would be paving part of McCaslin and recommended that McCaslin should be part of chip-n-seal also.
Fusner stated Kenlo Woods has always held well and Maniaci recommended we could take Kenlo Woods off list for chip-n-seal this year.
Mrs. Cohagen asked if we were any longer in the fire business and if we were responsible for anything other than securing a fire contract. Maniaci stated we are responsible for making sure Falls carries out the contract. Mrs. Cohagen stated that the discussion we have had at this evenings meeting is how our meetings should be carried out. As for future discussions regarding the fire department, she asked and recommended trustees to refer those residents insisting to discuss fire department issues to take it up with Falls Township’s Board who we have a contract with to handle fire department issues.
Mrs. Cohagen stated we are the fastest growing township in our community and asked about getting up a zoning committee. Fusner stated he would like to get one started soon and also we need to address township clean-up.
Mrs. Sellars stated that when a resident comes to a meeting to talk to the trustees they should have a right to talk without being thrown out to another board and have right to ask questions and voice their opinions. Fusner agreed and Maniaci stated this is why we let the residents talk.
Fusner discussed a call from a resident in Saddlebrook about the stones at the end of route 60. Fusner called Matt at county engineer and they said it was their stones and cinders but it’s a state road and not county’s responsibility.

MAY 2012 SPECIAL MEETING FOR MICROSEALING ROADS
BOARD OF MUSKINGUM TOWNSHIP TRUSTEES
DATE: May 24, 2012
PURPOSE OF MEETING: Special Meeting. Microsealing of Township roads.
OPENING: The Muskingum Township Trustees met in special session on May 24, 2012 at 6:30 p.m. in the Fire Building. Trustees Mike Maniaci, Matt Hittle and fiscal officer were present. There were 6 residents present.
The special meeting was called to present and discuss Microsealing of Muskingum Township roads. Maniaci opened by stating and reminded everyone that the only questions that can be entertained during the special meeting has to pertain to microsealing and any other questions will be entertained at our next regularly scheduled meeting on June 7. Maniaci introduced Tim Hurst from Terry Asphalt Materials.
Tim Hurst stated he was one of the featured speakers at the Township Association Conference in Columbus and spoke to the trustees about his company’s pavement preservation services.
Tim Hurst gave a brief history and background of Terry Asphalt Materials. Terry Asphalt Materials is a construction company and liquid asphalt and emulsion manufacturer, headquarters in Hamilton, Ohio. Construction division headquarters in Columbus, Ohio with asphalt plants in Hamilton, Ohio, Lansing, Michigan, Clearfield, Pennsylvania, and Nashville, Tennessee. They are owned by second largest paving company in world out of Europe and are the largest asphalt emulsion company in world. They touch about 23 states.
Tim Hurst stated he went out and evaluated Muskingum Township Roads and measured the roads and compared them to ODOT and the county engineer’s measurements. Tim Hurst presented a list of the township roads and his measurements for the trustees to review. The list of roads were rated based on what had previously been done to the roads and their condition and rated from best to worse using scale of 1 to 5, one (1) being the newest and best condition with five (5) being worse. Each road was listed and identified the maintenance or repair process recommended.
Maniaci questioned Tim Hurst on Wilson Lane, Gorsuch to end. Wilson Lane was rated as a 2 and identified needs microsealing soon. Maniaci stated that Wilson Lane was paved along with Gorsuch road at the same time and asked Tim Hurst if he thought it was in that bad of shape to need microsealing so soon. Tim Hurst stated the road is not in bad shape but it is starting to look pity and is cracking. Tim Hurst state what he is noticing a lot in this area is that the asphalt roads are not looking the same as they did in the past 5 or 10 years and we are receiving lower end asphalt that is not as tight and smooth as it used to be due to the rising cost of asphalt and due to the increased GBW on the trucks that our roads are not custom to handling.
Mrs. Cohagen asked for a clarification from Tim Hurst and Maniaci if they were talking more about aesthetics or quality of the Wilson Lane and Gorsuch roads discussed. Tim Hurst and Maniaci stated quality and functionality is the primary concern.
Tim Hurst stated that our Township roads are not in horrible shape but if we continue to sink our money into the roads with rating of a 4 or 5 we are not going to get our money’s worth and will continue to rapidly decline in quality and to ratings of 2 or 3’s.
Mrs. Lynn Sellars asked question if microsealing is to go over both asphalt and chip seal roads. Tim Hurst stated that most of our chip seal roads will remain chip seal roads and mainly pertains to the asphalt roads. Microseal is not a reconstruction material or hot mix asphalt instead is an asphalt emulsion with crushed limestone, portland cement, and goes down nominal, 3/8 to ½ inch thick. Microseal cannot correct swales in roads and is used as a preservation tool to protect roads that are in decent to good shape.
Mrs. Cohagen asked if microsealing is a preservation tool such as Valspar on a boat. Tim Hurst stated microseal is more identifiable as to an oil change in your car or replacing your roof. Microseal is used for preserving the functionality of the road and extending the life of the road. Without microseal the roads life may be 5 years and with microseal may preserve the life of the road to 8 or 9 years.
Tim Hurst presented a synopsis from ODOT on the effectiveness of chip sealing and micro surfacing on pavement serviceability and life. The synopsis studied the effectiveness and life of the two different surfaces. The study taken from 1999 to 2006 showed the surface treatment and cost associated with each surface and the service life. On average chip seal lasted 3-5 years with average cost per mile $11,500 vs. Microseal (4 lane road) 8 years service life with average cost per mile $26,350 and Microseal (2 lane road) 9 years service life with average cost per mile $17,450.
Tim Hurst stated that it is important for us to first identify our road priority and determine a budget before proceeding because the budget will justify a unit cost per mile. With microseal, the more volume of emulsion results in a lower cost per mile. The price comparison would be for every 1 mile of 1 to 1.5 inch of asphalt microseal would be approximately 2 to 2.5 miles, or double the miles of that of asphalt. Tim Hurst stated that every surface they service is also backed by a 1 year warranty and stated the 1 year warranty is offered because typically if anything would happen to the road after microsealing typically would happen in the first year of service.
Tim Hurst presented a letter from ODOT acknowledging Terry Asphalt Materials as an approved vendor and part of the Ohio Cooperative Purchasing Program. The price for the microsealing has already been agreed to, and cannot increase, with the Cooperative Purchasing Program, #101H-13. The next step as a Township would be for us to pass a resolution to accept the product in place, and agreed to, with the Cooperative Purchasing Program and letter from the Township requesting to participate in the use of ODOT’s Cooperative Purchasing pricing as defined on the #101H-13 state contract. A letter then would be received from ODOT with the approval. Tim Hurst also stated that the new ORC bid requirement has been increased from $25K to $50K but by working on the State of Ohio’s Cooperative Purchasing Program lifts the $50K ceiling.
Mrs. Cohagen asked the trustees if they were going to do their due diligence and follow-up on the vendor and go out to other areas or townships with microseal roads for more than 5 years. She also expressed her concerns with our township’s road and whether or not our roads were currently in good enough shape to justify the cost and benefits of the microseal surface.
Maniaci stated that he has seen roads with microseal and is impressed with this product and is why Tim Hurst is here presenting this product to everyone and its benefits to our township. Maniaci stated that there are some roads microseal is not an option and others that are in pretty good shape that could benefit. Tim Hurst stated that his analysis is surface functional and no has no idea what is going on below the surface however the survey presented of the cost and performance justifies the ability of the microseal product.
Maniaci stated that roads that are too bad and need of patching or smoothing Curtis and Charles would patch and repair these roads before applying the microseal.
Mrs. Cohagen asked if the chip seal could be treated with the microseal after the chip seal is applied to the asphalt. Tim Hurst stated that the process would be chip seal, roll and sweep it, let traffic run for 3-5 days on it to let chip seal settle and then come in with microseal. Tim Hurst provided that the City of Columbus as a reference for the microseal process.
Tim Hurst also presented an advertisement for a bid that they were awarded for ODOT district 7, Sydney area North of Dayton. He mentioned they are also doing district 3, Ashland, Mansfield, Medina/Richland County and the I71 corridor which includes 3 counties, 6 lanes which is the largest microsealing job in the history of ODOT.
Mrs. Cohagen asked about road closure during the microsealing process. Tim Hurst stated microseal is a water based product and can speed up or slow down the curing of the product as they need it. They would go around 24-48 hours before the process to all the residents to talk and explain the process and lane and road closures during the process. If residents not home at this time door hangers would be left to notify the residents of a name and number to contact for follow-up of the process and lane closures.
Mrs. Sellars asked about the microseal process and if it starts with blacktop, then chip seal then microseal. Tim Hurst said in some cases this is the process and is most cost effective in most cases. The object is to pick those roads that are crack seal and microseal conducive for your biggest bang for your dollar.
Hittle asked if we are looking at roads that are rated 3 or below to do the microseal. Tim Hurst stated that we would want to look at our roads that are rated at 2.5 to 3 to perform crack seal and microseal. Roads with 3.25 and above chip seal is recommended.
Tim Hurst stated the next step would be to come up with a budget and identify roads to apply microseal and Tim would come back and re-measure the roads and determine the pricing per mile. Tim Hurst also mentioned that summer months typically start seeing increased pricing from asphalt companies as prices have increased over 20% since end of last year.
Hittle asked if we Tim Hurst could provide us with an estimate on the cost. Tim Hurst stated that approximately for 1 mile of microseal you’re looking at $25-30K per mile and for 1 mile of crack seal you’re looking at $3-5K per mile. Tim Hurst stated that the City of Cambridge, Plain Township, and Perry Township is part of the Cooperative Purchasing Program and using microseal.
Maniaci stated our past pricing of chip seal and asphalt our township roads was approximately $7,000 per mile and asphalt was approximately $75,000 per mile. Maniaci also stated that we are looking for a longer term solution and to get longer life of the roads.
Gentlemen asked about the some township roads being small in lane size and concerns about the roads being closed for long period of time. Maniaci stated that closure of roads during the microseal process would depend on number of residents needing to travel on such road.
Mrs. Cohagen asked about how salt would affect the microseal on the roads. Maniaci stated that microseal would provide for a tighter seal than asphalt surface. Tim Hurst stated that microseal is multifunctional, provides tighter seal, less void area than asphalt, seals off roads from water and provides for speed correction and skid resistant, less frictious than asphalt, and is black that helps with melting of snow faster and also can be striped.

OPENING: The Muskingum Township Trustees met in regular session on June 7, 2012 at 7:00 p.m. in the Fire Building. All trustees and fiscal officer were present. There were 6 residents.
Bids were opened for 93 Ford 2500 Gallon Tanker and the 87 Chevy 1 Ton Mini Pumper. Four (4) bids were received for the 93 Tanker and three (3) bids were received for the 87 Mini Pumper.

Maniaci introduced Dan McCombs from Houston Insurance agency. Houston Insurance deals with Burnham Flowers OTARMA insurance for Muskingum Township’s property and liability. Mr. McCombs went over changes to our insurance which included dropping insurance liability for fire department since Falls Twp. takes care of it and dropping coverage on 93 Ford Tanker and the 87 Mini Pumper that was just sold.
Maniaci made motion to take off the Tanker and Mini Pumper that was just sold. Hittle seconed. All ayed.
Maniaci introduced Dave Hibner from Kinstle Sterling/Western Star Truck Center. Mr. Hibner discussed with the trustees and presented bid proposal for a Sterling/Western Star Dump Truck. The Western Star truck would be a replacement option for the township’s current 1997 International Dump Truck. Mr. Hibner discussed details, recommendations and comparison of the Western Star truck bid vs. the ODOT State bid price. Mr. Hibner passed out handouts to the trustees that detailed out and compared the various options, variations and additions from the Western Star truck vs. the ODOD State bid truck. The Western Star truck bid was for $82,443 vs. the ODOT State bid of $88,047. The additional equipment options for the Western Star would be another $2,057. The total bid with options for the Western Star was $84,500 vs. ODOT State bid of $90,104. Western Star bid is $10,390 lower than the State bid.
Maniaci opened for old business.
Female resident ask about the minutes on the web site only including 2011 minutes and not 2012. Maniaci stated that only 2011 minutes and 2012 minutes except for April and May to-date. Maniaci would look to confirm the minutes are still on the website.
Fiscal Officer, Jason Baughman followed-up with Mrs. Cohagen questions about the taxability of insurance benefits at the May regular meeting. Baughman state per IRS Publication 15B Fringe Benefits, typically most fringe benefits are taxable but there are some exclusions. The list of exclusions includes health insurance benefits and is not subject to federal, Medicare, social security, federal unemployment and not included on W2. Baughman also indicated that there is a new Affordable Care Act that requires employers to include on employees W2, box 12, code DD the amount of insurance benefits that is paid for by the employer for informational purpose only. This Affordable Care Act is not yet law or required to-date. The exclusion of insurance taxability is for both employer paid insurance benefit or reimbursements for insurance benefits paid to the employee.
Mrs. Cohagen asked if this code reference the insurance benefits coming out of an employee’s salary or is specific to elected officials. Baughman stated the code doesn’t state or define any distinction.
Maniaci ask trustee about the engineer agreement regarding the repair and maintenance contract for our township roads due to the shale drilling trucks traveling on our roads. Due to waiting on OTARMA to work out another option and waiting to receive more facts the trustees agreed to table this issue to later date.
Maniaci addressed issue with Falls Township and JD Johnson. Maniaci stated he has been informed of the decision that was made and Falls Township ask him to not release this information to public at this time, however as trustees we are pleased with their decision and should be seeing something released in the newspaper soon from Falls Township.
Maniaci indicated that McClaslin road has been paved from Gorsuch Road to Swingle Drive, 1,400 ft, 2 lanes. Maniaci stated his conversation with Shelly & Sands and the original contract stated 900 feet however the measurement was inaccurate and Maniaci made decision to take the top coat from Harper Drive and add it to McClaslin plus another $80 for the other 300 feet.

Maniaci stated Northern Place, although not our road yet, when McClaslin road was done the county patched and paved Northern Place. Mrs. Cohagen asked if observed this and if this came out of our budget. Maniaci stated that he did observe and no it didn’t come out of our budget.
Mr. Wint asked about Fulton Lane repairs. Mr. Wint stated there is 2 deep spots on Fulton Lane needing fixed before any paving is started. Maniaci stated that he Charley and Curtis is working on fixing this road before the 18th when the county is coming out to start chip-n-sealing this road. Ditches will be cleaned also once chip seal is completed.
Mrs. Cohagen asked about any follow-up on McCasslin road name. Fusner stated that this is up to the county. Maniaci stated unless resident raised issue to county this road name will remain the same.
Mrs. Cohagen asked about if the nuisance letters for the properties discussed at the May meeting have been sent. Fusner and Maniaci stated the 3 letters were sent and Todd and resident on route 60 responded and are working on the clean-up. The Vista View Market is tied up in bankruptcy and sheriff sale.
Mrs. Cohagen asked about the metal salt bin roof. Maniaci stated only the color of the roof has been discussed and at present time nothing has been scheduled but will follow-up.
Maniaci opened for new business.
Mrs. Cohagen stated that a township employee mowed over phone lines on Jones Road and was out of service for several hours. Cassies Way was also affected.
Mrs. Cohagen asked about why trustees are looking at new dump truck. Maniaci stated the current 97 Dump Truck is falling apart. The frame and springs are bad and the bed is rotting. The frame and front end is wearing out and shocks and are inching too close to the gas tank and is becoming too dangerous. The truck is to the point of un-repairable and concerns of safety issues with the truck.
Mrs. Cohagen asked if any due diligence has been done on the Micro Seal vendor (Mr. Hurst) that was introduced at the special meeting. Maniaci stated he has and presented a copy of a resolution obtained from ODOT’s web site and contacted Jim Schurch about the Ohio Cooperative Purchasing Program. Mr. Schurch indicated that we have to first, pass a resolution highlighting 5513.01 of ORC, and two, prepare letter to Jim Shurch stating that we passed a resolution and request use of Strauser Construction under the 101H-13 state contract.
Maniaci stated a list of roads were presented to Mr. Hurst of Terry Asphalt but has not heard back from him about them or attending this evenings meeting.
Mrs. Cohagen asked what we were looking at for this micro seal and budget. Maniaci stated that our budget for roads is approximately $250K. Maniaci stated that we will hold off tonight on a decision.
Maniaci indicated he received two visits about 5800 Dresden Road and the growing parking lot on the property with several cars located on property.

Mrs. Cohagen ask about sign damage on Kenlo Woods and if our responsibility. Maniaci stated not our responsibility.
Maniaci stated he was informed by our Fiscal Officer about our current Health Insurance will be increasing 30%. Baughman and Maniaci are working on getting other quotes including OTARMA for review. Mrs. Cohagen asked about inquiring on joining the counties insurance. Mrs. Cohagen stated that the county commissioners said that the township’s can get on the county’s policy. Most of the township’s refused the county’s offer to join their policy. Maniaci stated we will look at all available options.

BOARD OF MUSKINGUM TOWNSHIP TRUSTEES

PURPOSE OF MEETING: Regular Meeting.
OPENING: The Muskingum Township Trustees met in regular session on July 5, 2012 at 7:00 p.m. in the Fire Building. Trustees Mike Maniaci, Steve Fusner, and fiscal officer were present. Trustee Matt Hittle was absent due to a family illness. There were 6 residents.
The regular minutes were read and approved.
Checks were approved and signed for payment.
Maniaci introduced Todd Johnson from Rankin & Rankin Insurance to discuss our health insurance renewal options. Todd Johnson stated that health insurance premiums have been increasing. Mr. Johnson presented various options for renewal. Mr. Johnson addressed the townships option to join the county stating that 3 years ago the townships tried to join the county's plan and the county did not want this. Reason being the county didn't want the high risk townships on the plan and the townships had different plan designs with differing deductibles. Mr. Johnson stated another reason why the county decline the townships is the administrative nightmare of accounting for all the various deductible plans of the townships. As for the county plan it is a self-funded plan where as our township is a fully funded plan. Mr. Johnson indicated the options that he presented have differing deductibles which help reduce the premiums. He also stated the townships only have one plan design where as the city has a low/medium/high deductible option. Mr. Johnson stated that after taking the plans to market Aetna came back the best carrier and option available for Muskingum Township. As for renewal we need to decide by August 1st.
Baughman discussed his conversation with Theresa Tom and Rankin about quoting the property and liability insurance and Todd reiterated that we are in a very good plan with OTARMA. It's a claims paid plan and if you leave the plan you take your claims with you. Mr. Johnson recommended we should stay with OTARMA at this time.
Maniaci opened for old business.
Mrs. Sellers read Mr. JD Johnson's article in Times Recorder regarding Mr. Johnson's arrest and recent employment termination. Mrs. Sellers recommended more background checks. Mrs. Sellers stated that she was told that 14 members of the falls fire department board voted to keep Mr. Johnson. Mrs. Sellers requested copies of the Falls Township Volunteer Fire Department membership list, rank of office, how many respond to the 911 calls, and Muskingum Township trustees to do background checks on all of Falls Township board members. Mrs. Sellers stated that after background checks are complete on Falls Township fire department members we will see the benefit to reinstate Muskingum Township volunteer fire department and accept Licking Township's offer to run an ambulance business out of Muskingum Township building separate from either trustee’s ownership.
Maniaci stated we have no say as to the Falls board's vote. As for Mrs. Sellers membership request, we do not have this information and Mrs. Sellers must ask Falls Township for this information.
Maniaci and Fusner stated in regard to perform background checks on Falls employees, it’s up to Falls, and for example, we are not going to nor do we have to perform background checks on all vendors we contract services from. For example we don’t do background checks on all of the Shelly Company's employees who work on our roads.
Maniaci asked about any progress on shale agreement. Fusner stated he has not heard any status to date.
Maniaci gave a status on paving of roads. Chip seal is about 80% complete. Roads sealed to date include: Fawn, Squirrel, Dutch School, Stagecoach, Jones, and Beech Run. Remaining roads to chip seal include Fulton, New Riley, Schneider, McCasslin.
Fusner stated the gentlemen on Tunis Road that helped for 3 hours recommended we pay him something for his time. Maniaci made motion to pay the gentlemen $50 for his time. Fusner seconded. Roll Call: Maniaci ayed, Fusner ayed.
Maniaci discussed the salt bin roof repair. Maniaci spoke with Chris Mitchell and he is about 2 weeks away from finishing.
Maniaci discussed micro-seal. Maniaci received quotes based on the roads Maniaci presented. One quote which included Canadian Ontario trap rock black agg. was $129,536.36 and the second quote without trap rock black agg. was $121,080.20. Maniaci stated that the quote was higher than what we wanted to go and has heard no response. Maniaci recommended micro-seal of roads be put on hold until more information can be obtained.
Maniaci stated he received a call from Mark Blatt regarding the property on corner of Virginia and Babbs Road one owned by GVH and one owned by Virginia Helbling and Jack Newcome. Parcel 44-34-04-34-000 and 44-34-04-35-000. Maniaci presented pictures of the high grass and debris. Maniaci will prepare the proper nuisance resolution to address.
Maniaci discussed the purchase of new dump truck. Maniaci prepared and read resolution 7-5-2012A, in accordance with ORC 125.04, 125.05 and House Bill 204 to enter into agreement with Kinstle Sterling/Western Star Truck Center to purchase a 2013 Model Western Star 4700SF Truck, and related equipment for road maintenance and other duties so specified by the Muskingum Township Trustees. This vehicle will be purchased for no more than $113,801, which is lower than the State Bid for a similar Truck with same options. Fusner seconded. Roll Call: Maniaci ayed, Fusner ayed.
Maniaci prepared and read resolution 7-5-2012B, in accordance with ORC 125.05 resolve to enter into agreement with Henderson of Ohio to purchase a 2013 Stainless Steel Truck Bed for the existing 2005 Sterling Truck for road maintenance and other duties so specified by the Muskingum Township Trustees. This Stainless Steel Bed will be purchased and installed for no more than $16,125. Fusner seconded. Roll Call: Maniaci ayed, Fusner ayed.
Maniaci prepared and read resolution 7-5-2012C, in accordance with ORC 505.262, 133.20, and 9.95 to enter into an agreement with Daimler Truck Financial to finance the purchase of (1) 2013 Kinstle Sterling/Western Star, Model Western Star 4700SF Truck, and related equipment, and 2013 Stainless Steel Bed, installed, for the existing 2005 Sterling Truck for Muskingum Township, Muskingum County, Ohio. Loan amount including interest of 3.809% per annum = $139,165.

Fiscal officer Baughman presented the Alternate Tax Budget, for tax year January 1, 2013 to December 31, 2013, for review and approval to be submitted to the County Auditor due July 20, 2012. The Alternate Tax Budget is an estimate based on the Amended Certificate of Resources for the following tax year. The county budget commission will review the Alternate Tax Budget. Maniaci stated in light of Mr. JD Johnson's termination, Maniaci made motion to make Mark Brown, Falls Township's fire chief, fire marshal of Muskingum Township. Fusner seconded. Roll Call: Maniaci ayed, Fusner ayed.
Maniaci also made a motion in accordance with ORC, the fire marshal can be paid and because this situation is above and beyond the call of Mr. Brown's duty, motioned to pay out of fire fund $500 per year to Mr. Brown for the fire marshal position. Maniaci discussed the culvert on Welch Road. Maniaci made a motion to allow the county engineer to use their track hoe and supply a man to take care of the culvert on Welch Road using the funds we have credited to us from the county. Fusner recommended that since Welch is a designated county detour, due to the bridge closure on Creamery, that the county covers the cost of repairs to Welch Road. Fusner stated the county engineer receives money when county roads are used for detour and feels we should receive money for use of our township road when county uses our roads as detour. Maniaci and Fusner will address with Mr. Doug Davis.
Mr. Mendenhall asked the trustees if they heard anything regarding sunshine law and executive session from the attorney general office. For our protection when going into an executive session we must be very specific.

PURPOSE OF MEETING: Special Meeting. Bidding of asphalt road located at Northcrest Drive, trading in used dump truck bed on sterling truck and nuisance law on Babbs Road and Virginia Road.
OPENING: The Muskingum Township Trustees met in special session on July 10, 2012 at 7:00 p.m. in the Fire Building. Trustees Mike Maniaci, Steve Fusner, Matt Hittle and fiscal officer were present. There were 4 residents present.
Maniaci opened discussion in regards to the nuisance on Babbs Road and Virginia Road. Maniaci read resolution: property known as 44-34-04-34-0000, GVH Corporation, and 44-34-04-35-000, Jack Newcome and Virginia Helbling, constitutes a nuisance and are hereby ordered to abate such nuisance by removal of such vegetation, refuse and debris on the property and if no compliance within 7 days of notice the board will provide for the abatement of the nuisance by removal of such vegetation, refuse and debris with the expense certified to the county auditor to be entered upon the tax duplicate and lien on such property under ORC 505.87 and 505.871. Notice to be sent by certified mail to Jack Newcome, 2000 Andrew Court, Dresden, Ohio 43821 and Virginia Helbling, 21 West 4th Street, Dresden, Ohio 43821.
Mr. Helbling presented a letter sent to the county discussing the Crestmont Estates. Maniaci read the letter. The letter was addressed to Commissioner Brian Hill discussing information associated with the two wastewater treatment plants that served the Crestomont Estates residents operated and maintained by sanitary engineers office until 1997. The letter also addressed Ohio EPA rules and regulation regarding the construction and demolition debris under Ohio Administrative Code 374-400-01F. Mr. Helbling presented a map of the property and indicated that there was no access to the property. Mr. Helbling stated that there are documents at the courthouse stating the county was to take care of the property. Mr. Helbling also presented an interview summary, read by Maniaci, of Keith W. West dated 1/9/07 discussing the Crestmont Estates and the removal of the sanitation package plant parts and presented pictures of the property.
Maniaci stated to Mr. Helbling that all we want is the property grass mowed. Maniaci stated that he will get Mr. Helbling written permission from the apartment owners near the property so there is access to the property so it can be mowed.
Helbling indicated that he would like to wait until after his meeting scheduled with the EPA next week to see what they are going to do about the property. Maniaci stated that we will table this issue until we here the results of Mr. Helbling meeting with EPA.
Maniaci presented an opportunity to trade in our old truck bed on our sterling truck for $2,500 to Kinstle Sterling/Western Star. Maniaci made motion to accept Kinstle Sterling/Western Star’s bid to trade in our old truck bed for $2,500 to go against the cost of our new truck that was approved at our July 5, 2012 regular meeting. Mike Maniaci was unable to attend as he was out of state for his employer stuck in traffic. There were 2 residents present and Kevin West from the Shelly Company present.
The special meeting was called to open bids for asphalt paving of Northcrest Road and Kingswood Circle, Winfield Circle, and Coachlite Circle. The special meeting was also called to discuss and approve health insurance options.

Hittle made a motion to table the acceptance of bids until next regular scheduled meeting so the road and bridge budget could be reviewed again and to decide on option A or B based on our available road and bridge fund. Fusner seconded. All ayed.
Fusner opened discussion for approval of health insurance options.
Fiscal Officer Baughman provided trustees with health insurance premium renewal options and quotes received from Rankin & Rankin Insurance and Miller Lynn Insurance. Rankin & Rankin provided quotes from Aetna and Miller Lynn provided quotes from Medical Mutual. Baughman stated that additional quotes were requested from Jeff Cashman of Wichert Insurance, however per Mr. Cashman’s email provided stated that he was still working on quotes and were not available at the time of the special meeting.
Baughman stated that he needed the trustees to approve a plan option to continue coverage. Baughman stated that our current plan under Aetna was renewing at an increase of 37% and trustees needed to decide if they wanted to renew the current plan at this increase or choose another plan option with a higher deductible, max out of pocket, and co-pay to off-set some of the premium increase. Baughman stated after his conversations with Charlie Brenner at Miller Lynn, the best options were to stay with the current carrier Aetna as most all of the premium options quoted with Medical Mutual were slightly higher than that of Aetna.
Baughman stated that we have to decide on a plan and payment this month to renew our insurance coverage. Baughman stated that we are max penalty rated therefore regardless of what carrier Rankin, Miller Lynn or Wichert quotes our premiums will be the same regardless of the broker. We will receive the max premium with every carrier that is quoted. Baughman stated the plan is month-to-month so if Wichert comes back later with other carriers than Aetna or Medical Mutual and is less expensive we can re-evaluate the plans at that time and choose the best available plan but as for now we have to at least choose a plan option so we can make the premium payment to avoid any lapse in coverage.
Fusner made a motion to choose the health insurance plan option, Aetna, Ohio Health Network with the $500 deductible option and to re-evaluate health insurance options as plan options are received from Wichert. The $500 deductible option will save 15% of the projected 37% premium increase. Hittle seconded. All Ayed. Roll Call: Fusner ayed, Hittle ayed.

PURPOSE OF MEETING: Regular Meeting.
OPENING: The Muskingum Township Trustees met in regular session on August 2, 2012 at 7:00 p.m. in the Fire Building. Trustees Mike Maniaci, Steve Fusner, Matt Hittle and fiscal officer were present. There were 7 residents present.

Maniaci asked about any update on shale agreement. Fusner stated nothing to date.
Maniaci stated roof replacement for salt bin has been completed.
Maniaci asked about insurance update. Baughman stated per Todd at Rankin insurance has been renewed and new cards issued within 15 days. No response from Wicert to-date. Baughman will contact Forker Company about insurance quotes.
Maniaci stated that Fiscal Officer Baughman and him went to the Muskingum County FEMA meeting to turn in time and cost information for reimbursement due to the recent storm damages. Nothing has been approved by the state nor have any of the townships been qualified yet for reimbursement from the state. The total Maniaci and Baughman reported for potential reimbursement was approximately $5,007.
Maniaci gave update on chip-seal. Tuesday, August 7th, the following roads will be finished with chip-seal: Fulton, Schneider, Chugg Run, McCasslin.
Fusner asked about decision on paving bids for Northcrest Road. Fusner made motion to accept the lower of the two bids, bid proposal B, from Shelly Company for $72,992.50 which includes asphalting of Northcrest Road from Richvale Road, including Kingswood Circle from Northcrest to end, Winfield Circle from Northcrest to end, and Coachlite Circle from Northcrest to end. Maniaci seconded. Roll Call: Maniaci ayed, Fusner ayed, Hittle ayed.
Mrs. Cohagen asked about appointing Mark Brown as Fire Chief and paying him $500 annually out of the fire fund. Mrs. Cohagen asked about the legal ramification due to the fire contract and whether we should be paying Mr. Brown out of the fire fund. Maniaci stated he will verify this with the contract.
Mr. Paul Dunfee, from Licking Township, asked about chip-seal of Vanbark and asked if we wanted to them to go all the way down to the highway from Vanbark. Fusner stated Licking Twp. has done this in the past for a small fee. Fusner made motion to compensate Licking Twp. for this extra 100 feet providing that compensation isn't excessive. Maniaci seconded. Roll Call: Maniaci ayed, Fusner ayed, Hittle ayed.
Mr. Dunfee asked about how many employees the township pays for health insurance? Maniaci stated there are 3 employees on health insurance and 2 that are reimbursed for out-of-pocket premiums paid.
Mrs. Cohagen asked about township zoning. She referred to the article in the Times Recorder about the city port authority expansion plans. Mrs. Cohagen asked trustees why haven't zoning in our township been addressed? Maniaci stated that his understanding is that the zoning process was addressed years ago and cards were issued to the township residents addressing zoning and they were never returned, therefore the zoning issue was never brought to the ballot. Fusner state that years ago the township hired the city planner to prepare a zoning plan and $10K later only maps were drawn. Mrs. Cohagen stated there are different levels of zoning and mentioned that there were individuals in township willing to be on a zoning board. Maniaci stated that he would have a zoning report at the next regular meeting.

Maniaci made proposal and motion to reword the resolution 7-5-2012A for the dump truck. Instead of reading the vehicle would be purchased for no more than $113,801 which is $10,246 lower than state bid for similar truck with same option, we are rewording the first paragraph to read the vehicle would be purchased for no more than $81,991 which is $10,246 lower than state bid. Also, the paragraph in the center of the same page which read Kinstle Sterling Western Star truck and related equipment not to exceed $113,801, will now be reworded to read equipment from Henderson Ohio totaling $31,810 to be mounted on 2013 Western Star Chassis not exceeding a total price of $113,801. Maniaci stated he received a bid to trade in the truck for $5,000. Maniaci, Fusner, and Hittle rejected this bid.
Fusner asked about a dry hydrant on Friendly Hills from Mark Brown. Maniaci stated he would ask him about this.
Maniaci stated that the no outlet sign on Aaron Place was missing and we replaced.
Maniaci stated he noticed that the sign where Gorsuch meets McCasslin was gone and also needs replaced.
Fusner stated we are going to need to do something about Welch Road. Maniaci stated with this last 2.5 mile run on McCasslin, we could get a second tank and finish McCasslin, go over to Welch and Fawn. Maniaci would check with Gary on this and try to buy some additional time to get Welch ready.
Mr. Dunfee asked about Stagecoach. Fusner stated we can't get any property now. Maniaci stated he spoke with Becky Vansickle and her position was that the trees were cut down on her side and the gentleman on other side planted trees which is now slowly pushing the road over to her side. Maniaci stated that the county engineer surveyed it and said they couldn't find a center line and we need to get lease agreements for us to do anything with it now.

Maniaci asked fiscal officer about health insurance. Baughman stated Wicert has not responded to his follow-ups and he also spoke with Jared Dosch at Forker Company regarding additional quotes. The only quote that came back from Forker Company that was competitive was from Medical Mutual, which Miller Lynn also quoted the same plan options, however Jared Dosch's quote was different than that of Charlie Brenner at Miller Lynn. Baughman stated he was in the process of contacting Charlie Brenner and Todd Johnson and Jared Dosch to discuss why there are differences in the same plan from Medical Mutual that was quoted.
Maniaci stated that there is a FEMA meeting on September 7th at 1pm and Jason will be attending to see if we will be getting any money back for the June storms.
Maniaci stated that chip-seal has been finished on Welch and Fawn.
Maniaci stated that Northcrest is being prepared for paving and Shelly Company will be paving sometime in the next week or two.
Maniaci asked trustees about the change on the township sign. Mike Davis quoted $425 per sign. Hittle made motion to make the sign change to Falls EMS Station #3. Fusner seconded. Roll call: Maniaci ayed, Fusner ayed, Hittle ayed.
Fusner also recommended adding sign or adding sign out front that would say regular township meeting first Thursday of every month at 7pm so we don't have to update every month. Maniaci will ask Mike Davis about signage.
Maniaci discussed the dry hydrant on Friendly Hills and stated that Falls is just waiting on Zemba.
Maniaci stated he had reviewed the fire contract and there are two different places within the contract allowing us to pay Mark Brown the $500 from the fire fund.

Todd Graham asked about guard rail St. Mary's road. Fusner stated he talked with Doug Culbertson on this and is waiting on county to get back with him on what the cost is to fix this.
Mr. Forest Mendenhall stated that he had been asked by another township trustee about our township employees and our employees policy and procedures. Mr. Mendenhall stated that this trustee has seen our township employees and vehicles at various places in town multiple times during the week. Mr. Mendenhall, in light of his conversation with the above mentioned trustee, asked some questions to the trustees regarding our township employees, administrative control over our employees and enforcing employee policy and procedures. He asked the following questions:
How many employees do we have? Is there a set of employee rules that cover hours such items as hours of work, lunch hours, work breaks, time cards, work reports, overtime, mileage logs, travel time to and from work sites and lunch hours and how does the trustees administer these rules over the employees. Is there any one trustee or anyone appointed to oversee township employees. How is overtime authorized and is any set rules regarding overtime.
Maniaci stated that there are 2 employees and we have a employee policy manual. Time cards are completed with detail of work performed. Mileage logs are not presently maintained. There are no such rules regarding when lunch hours are to be taken, when and where. There may be such times when the employees will stop and eat lunch while on their way to pick up something in town. The employees work an 8 hour day which includes their 1 hour lunch. As for overtime, the general rule is that they are not to work overtime however there are some circumstances that overtime is needed such as emergency situations like tree or snow removal.
Maniaci stated that there is constant communication with the employees regarding the employees work day and week and generally know what the employees are doing where they are going and when. All trustees oversee the employees and advise one another with any issues. Maniaci and Hittle stated that the trustees have had previous discussions with the employees, regarding their work hours, overtime, lunch hours and making changes to these policies. In addition to the policy and procedures there is a give and take relationship regarding these policies and administering the employees work hours including their daily work breaks and lunch hours. Maniaci stated that we as trustees don't feel that the employees are taking advantage of the policy and procedures especially for the amount of work that we get out of our two employees.
Fusner also stated that our township employees, in particularly Curtis, has done things such welding, mechanic work and has fixed a rear-end of one of our trucks that would typically cost us thousands of dollars if we had to contract these services outside. Curtis along with Charley looks out for our township and our best interest. Maniaci stated that for the amount of work we get out of our workers and for what they earn we get a lot more back from them than what we pay out.
Hittle stated that he understands Mr. Mendenhall's inquiry and that everyone is watching and how these things can be interpreted.
Maniaci stated he appreciates Mr. Mendenhall's concerns and at the present time we as trustees believe we are not being taken advantage of and our employee policy and procedure system in place is working, however we will always be open to changes at any time.
Mr. Mendenhall ask about wages. Maniaci stated Curtis makes $15.50 per hour and Charley makes $13.75 per hour.
Hittle stated that he talked with Mr. Steinment regarding his property and water issues and the trustees would meet with him anytime to discuss his water issues and culvert options.
Todd Graham asked the trustees if the fire building could be used for a Coon Hunters Club Meeting. Maniaci made a motion to allow the use of the fire building for the Coon Hunter Club Meeting. Hittle seconded. All ayed.

October Regular Meeting
BOARD OF MUSKINGUM TOWNSHIP TRUSTEES

PURPOSE OF MEETING: Regular Meeting.
OPENING: The Muskingum Township Trustees met in regular session on October 4, 2012 at 7:00 p.m. in the Fire Building. All trustees and fiscal officer were present. There were 2 residents present and 2 representatives from Wicert Insurance.
The September 6, 2012 regular minutes were read and approved.
Checks were approved and signed for payment.
Maniaci introduced Jeff Cashman and Kevin Howe from Wicert Insurance. Jeff indicated that Wicert works with over 400 townships in Ohio and in July Jason had been in contact with him about getting some health insurance quotes for Muskingum Township. Jeff indicated that he wanted to come to our meeting to discuss Wicert and their services they offer and answer any questions we may have regarding our health insurance options and assist us with reducing our current health care cost. Jeff indicated that the carrier and the plan are just one part of the health care cost equation and there are other options that can be incorporated in the plan such as health reimbursement options. Every plan is different and part of Wicert’s services is to help their clients find a plan and tailor it with options to meet the customer needs and within their budget.
Mrs. Cohagen asked Mr. Cashman if the cost of a health insurance would decrease if the size of participants was increased.
Mr. Cashman indicated that there are varying factors that determine the cost of the plan other than just the number of participants. The plan design, deductibles and make up of participants as to their health, age, or sex impact the overall cost of the plan.
Hittle asked Mr. Cashman if we could custom design our plan or if these plan options are already set. Mr. Cashman stated that the plans are a little of both. The carriers have to file the rates of the plans with the state with a predetermined benefit however there are varying options to choose from such as deductible, co-pays, or employee reimbursement options. The options vary as no two townships or plans are the same.
Mrs. Cohagen asked what our current health insurance premiums are for the township as of October 1. Baughman stated that the monthly premiums are $4,687 per month. Mrs. Cohagen states that the county employees contribute 20% and in Muskingum County there are 18 out of 25 townships that provide insurance and 5 townships have a cap to their plan. Mrs. Cohagen stated that our township employees should contribute more toward the cost of the monthly premiums.
Maniaci asked Mr. Cashman, of all the township's that he works with, how much do these townships pay toward their employees health insurance premiums. Mr. Cashman stated that it varies anywhere from 50% to 100%. Some provide a monthly stipend and some provide a cap to the monthly premium for the employees.
Maniaci stated that we are not done with exploring all our options with lowering our health insurance cost and Wicert is just another option to us with helping us manage our health care cost. Maniaci stated that even though our annual budget is still increasing, even with the loss of the LTAP and Inheritance tax funds, we continue to explore our options to cut our health insurance cost without any added out-of-pocket cost to our employees.
Baughman discussed and stated to Wicert that he had received quotes from three local agents which had quoted the same carriers as Wicert would have quoted. Baughman stated that when the carriers were quoted in July and August the rates for Medical Mutual vs. Aetna, for the same plan, were about the same. Jared Dosch, from the Forker Company, quoted the same plan for Medical Mutual in September and, effective October 1st, the Medical Mutual plan rates came in lower than what was quoted by Rankin & Rankin and Miller Lynn back in July and August. Jared stated that Medical Mutual lowered their rates effective October 1st. Baughman also stated that next year, based on our current plan's premium rate table, 3 of our 4 plan participants rates are expected to increase another 25%.
Maniaci asked Wicert if they would come back to our next meeting to discuss what they have purposed to our health insurance plan options and our options available to us to lower our health insurance cost. Mr. Cashman stated that they would get to work on our options and be back at our next meeting to present these options.
Maniaci opened for old business.
Fusner discussed the bridge on St. Mary's Road. Fusner stated that Doug Davis said a 36 inch culvert would handle the repair.
Fusner stated he had talked with Connie Fink and Stephen Bradley about the shale agreements and talks have currently subsided and things are quiet right now until after the election. Most of the agreements for the townships have been left up to Doug Davis right now. Maniaci stated we will table for now and revisit these at a later time.
Maniaci asked Baughman about the FEMA meeting. Baughman stated he attended the FEMA meeting and completed and submitted all the required forms that were due by September 19th. Baughman stated he is authorized as the main point of contact in our FEMA grant process and is meeting with a FEMA representative on Friday, October 5th to start the application process.
Maniaci stated Northcrest Road has been paved and the bill from Shelly Company came in $3,000 less than the bid.
Hittle stated that Mr. Meyer's culverts and ditches on Rollins Drive were completed.
Fusner asked Maniaci and Hittle whether or not the culvert replacement cost is the responsibility of the township or landowner so he knows how to handle this when other residents need culvert replacement. Maniaci stated historically this has been on a case by case basis and typically if the landowner wants to replace a culvert the landowner is responsible for the cost of the culvert and the township will install it for the landowner. If we see that a culvert needs replaced the township would cover the cost. Fusner stated we need to be consistent. Maniaci stated on average we may replace a dozen culverts per year and going forward we should discuss this with the landowner before we do a culvert replacement and recommend we charge the landowner for the cost of the culvert replacement.

Mrs. Cohagen asked about the side yard of the township. Maniaci stated we had some issues with the mower.
Mrs. Cohagen asked about any plans for a building or shelter for all of our equipment that we have sitting outside. Fusner stated that the extra lot we have was intended for a shelter. Maniaci stated that we have and will discuss plans for another building or structure to house our equipment and work on getting some quotes on this.

Mrs. Cohagen asked if there has been any more thought on making our township facility a disaster shelter site. Maniaci stated he would talk with Bo Keck about how to proceed.
Fusner stated that he discussed with a Falls Township trustee on zoning requirements and process and stated that we should definitely go through an attorney. Fusner stated they go through Albers and he would call them to give us some information on zoning process and the cost associated with this process.
Mrs. Sellars asked trustees about the type of zoning we were thinking about. Maniaci stated we don't know much about zoning right now and will bring in attorney Albers to discuss this with us.
Baughman asked trustees if our 2 hour safety training requirement for the Frank Gates workers compensation group rating program has been met this year. Maniaci stated all the trustees have done the training but will call and confirm that we have met the requirement.
Baughman stated that he met with Loren Bates about our 2010 and 2011 audit and Loren stated the audit is complete and is waiting on the Auditor of State to sign off on it so we can schedule an exit conference. Baughman will advise trustees when finalized.

November 2012 Regular Meeting

OPENING: The Muskingum Township Trustees met in regular session on November 6, 2012 at 7:00 p.m. in the Fire Building. All trustees and fiscal officer were present. There were 6 residents present and 2 representatives from Wicert Insurance.

Maniaci introduced Jeff Cashman and Kevin Howell from Wicert to follow-up on insurance options. Mr. Cashman presented a five point program outlining items to consider when choosing a health insurance plan, plan options, carrier and broker. Mr. Cashman discussed options such as maintaining our current plan and carrier, selecting a different broker, such as Wicert, or choosing a high deductible plan with a (HRA) or (HSA) option to name a few. Mr. Cashman stated he would be at next meeting to discuss options again but it's up to the township on how we want to proceed with our plan and broker.
Maniaci opened for old business.
Fiscal officer Baughman gave an update on FEMA grant. Baughman met with FEMA representative on October 5th to complete initial application forms and review information the FEMA representative needs to prepare the grant. The due date for submission of the grant is 60 days from the October 5, 2012 meeting. Baughman is gathering the information needed for the grant application and will submit to the FEMA representative.
Maniaci indicated that the township sign at entrance has been updated.
Maniaci asked Fusner about an update on St. Mary's culvert. Fusner stated 36" culvert would suffice in order to put up the guardrail. Doug Davis and Zemba both feel structure is good but not quite wide enough for road. Maniaci asked about extending the box culvert. Fusner stated he would talk with Doug Davis again about this option and suggest the route we should go.
Maniaci addressed the use of the township garage as a Shelter. Maniaci spoke with Bo Keck, Chris Fenton, Mark Brown and James Applegate of the Red Cross. The garage with the restrooms and kitchen is suitable for the shelter needs and Mr. Brown and Mr. Keck were in favor and said they use their Falls Twp. buildings as a shelter. Maniaci stated that if we decide to go with the shelter we should consider adding a generator. We also need to look into adding all our Township buildings with smoke and fire alarm security. Maniaci made a motion to use the "original" fire building as a shelter for the Red Cross and future disasters. Fusner seconded. Roll Call: Maniaci ayed, Fusner ayed, Hittle ayed.
Fusner addressed zoning. Fusner stated before working with attorney we will contact the Ohio State Extension Office for more information. Fusner talked with Springfield Township and he referred to ORC 519 regarding Township Zoning to assist us through the zoning process.
Maniaci stated he spoke with The Frank Gates Company about training BWC requirements. We need to take one class. Matt Hittle will be attending this class to full-fill our training requirement.
Maniaci stated that he and Fiscal Officer Baughman met with Loren Bates for our 2010 and 2011 audit exit meeting. The audit was good and will be available after Auditor of State signs off on it and provides us with the final reports.
Maniaci addressed the equipment shelter spoke of at our last meeting. Maniaci met with couple different people about some estimates and indicated that without any engineering we would be looking at couple hundred thousand dollars. We will continue to explore our options. Jerry Miller suggested building an actual salt bin first and cost compare before pursuing the shelter.
Maniaci addressed status of new Kinstle Sterling Dump Truck. The truck ordered was wrong and is being fixed. Maniaci stated because of this we have to fix the paper work for the financing and also need legal counsel to sign off on opinion letter required by Mercedes Benz Financing.
Mrs. Cohagen asked Maniaci if we had contacted our prosecuting attorney, Bud Chess. Maniaci stated we did and Mr. Chess stated this is not something he is comfortable addressing an opinion on and deferred to other legal counsel. Because of Mr. Chess’s un-comfortableness, we have to seek outside legal counsel to render this opinion. Maniaci made and read resolution for legal counsel. Be it resolved that this board finds it necessary to obtain legal counsel for purpose of rendering an opinion to Mercedes Benz Financial, Jim Kirshack is hereby appointed for said purpose, with compensation to be $175 per hour to a maximum 5 hours to be paid from township fund. The trustees or any one of them is hereby authorized to execute any documents necessary to carry out intent of this resolution. Fusner seconded. Roll Call: Maniaci ayed, Fusner ayed, Hittle ayed.
Mrs. Cohagen asked about mowing of the township back yard. Maniaci stated the mowing has been started but not yet completed.
Mrs. Cohagen asked about status of the installation of our township logo on our trucks that had been approved earlier this year. Maniaci stated he would get them on the trucks.
Mrs. Cohagen asked why the Dump Truck and John Deere tractor was sitting at Mr. Moran's house this morning at 10:30am. Maniaci stated it needed refueled and there was an issue with the battery and a bad starter on the John Deere. Mrs. Cohagen also referenced missing signs on various roads and the need to mow high weeds along various roads and the cemetery on Shannon road.
Hittle asked if this was unusual that the equipment sits at other places other than the township and mowing on days it rains. Mrs. Cohagen stated that she called Maniaci and asked why our employees were mowing now instead of the weeks prior when the weather was nice. Maniaci stated that the weeks prior Curtis and Charlie were working on repairing and painting our existing spreader. For safety reasons it takes two of them to lift and bolt up the spreader. Also, painting in closed doors in the heat is too volatile. Maniaci indicated that we are mowing and weather has had impact on the amount and times needed to mow.
Mrs. Cohagen asked if we were ready for winter. Maniaci stated we were prepared and fully stocked for winter.
Mr. Dunfee asked about the Vanderbark chip-seal. Fusner stated that we need to measure Vanderbark in order to reimburse Licking Twp for their service.

Maniaci stated that due to timing of meeting we didn't receive fire report for October but would post to the web site when we get it.
Maniaci made note that the Welch Road culvert was done for $647 by the county engineer and was paid for out of our type 1 funds we are awarded each year. Zemba had previously quoted us $4,495, therefore we experienced significant cost savings and we continue to monitor and watch how we spend our tax dollars.

Fiscal officer presented “then-and-now” appropriation for approval for the first payment on the new Kinstle Sterling truck. Mrs. Sellars asked clarification of the minutes read pertaining to zoning and hiring an attorney. Maniaci stated that the attorney was not for zoning and was only hired one-time in order to issue an opinion required by Mercedes Benz financing of the new Kinstle Sterling truck.
Fusner stated he spoke with Doug Davis regarding St. Mary’s drive culvert. The trustees will meet with Doug Davis at beginning of next year to finalize plans for the culvert.
Fusner stated he spoke with Matt Russell about a cost for the chip-seal for Vandenbark Drive that Licking Township did for us. The total was about 4 tenths of a mile approximately $330.
Baughman gave an update on the FEMA Grant. The grant application was finalized and submitted as of November 6, 2012 for $3,983.12.
Baughman stated that the 2010 and 2011 Muskingum Township financial audit has been finalized and released by the Auditor of State of Ohio on November 9, 2012 and is available for inspection at www.auditor.state.oh.us.
Maniaci stated Jeff Cashman from Wicert Insurance was unable to attend meeting this evening and read an email received from Mr. Cashman which reiterates previous discussions about deciding on a broker to manage our healthcare cost and basically they receive the same carrier quotes as the ones we have already received.
Baughman stated that he met Jared Dosch and again with Todd Johnson to discuss health insurance cost. There is significant savings available by incorporating a (HRA) Health Reimbursement account or (HAS) Health Saving Account option. Fusner stated he had also spoke with Todd earlier about changes to health insurance. Todd Johnson did however indicate that first of the year changes could be delayed due to the high volume of open-enrollment processing by the carriers. Todd also indicated that with the new health care law headed our way any changes made now may need to be changed again by the end of 2013. There is significant savings available, however this depends on implementing the aforementioned changes and impending health care law changes coming in 2013.
Maniaci asked about any new updates on zoning. Fusner stated nothing at this time and is waiting on return call from John Congolosse, the OSU extension Land Use Team Coordinator, and a David Bibipplo from Medina County OSU extension office.
Maniaci stated the new truck is being completed and painted and should have next week.

Fusner read a thank you card received from Shirly and Darrell Woods to the trustees for a job well done on the chip-seal roads this year.
Fusner state he spoke with Chippy Vanderbark. Mr. Vanderbark was concerned about how and if the fire department would be able to access his house due to the recent train derailment near his property.
Fusner stated that he and Curtis discussed the need to trim some overhanging trees on McCoach Road.
Fusner stated there was a culvert on 8037 Cranberry needing replaced. Maniaci stated he thought that the Township would replace the one at the bus turnaround and the landowner would replace the other one. Hittle stated that it is up to our discretion and case by case if it affects our roads and culverts.
Baughman presented a letter from State of Ohio regarding the annual renewal of liquor permits by vendors in our township. If we object to this requirement and wish to have a hearing we need to make a resolution. Maniaci made a motion not to object to the State requirement, defined under O.R.C 4303.271(b), for the annual renewal of liquor licenses by vendors located within our township. Hittle seconded. Baughman presented and stated he filed the required Annual Notice of Exemption from Continuing Education Requirements Pursuant to the Ohio Revised Code 135.22, as required by Fiscal Officer’s.
Baughman asked trustees if they were aware of any current contracts or terms with Time Warner or ATT before he contacts them to discuss and negotiate contract renewals. Trustees stated previous fiscal officer would have negotiated our current contracts.
Baughman asked trustees if there is a meter on our diesel fuel tank to monitor and compare against our invoice from Co-Alliance as they replenish the tank monthly. Maniaci will discuss with Curtis on process to monitor this so we can compare with our monthly invoicing.
Hittle stated we need to decide the monthly meeting sign panels to install on the township sign at the front entrance. Hittle made motion to approve the signs not to exceed $300. Maniaci seconded. Roll call: Maniaci ayed, Fusner ayed, Hittle ayed.
Maniaci stated he spoke with Mark Brown about available grants for a generator. Mark stated he was not able to locate any grants for such purchase at this time.

Fiscal Officer presented trustees with resolution to amend two appropriations necessary to realign funds from one account to another for the December insurance premiums. Appropriations were realigned from other expenses to health and medical expenses within the General Fund and the Road and Bridge Fund. Fiscal Officer certified funds availability and Maniaci made motion to accept appropriation #53-2012 and #54-2012 and to realign appropriations within the said mentioned General Fund and Road and Bridge Fund from one account to another per O.R.C. 5705.14 and 5705.16. Fiscal Officer Baughman stated we received a check in the amount of $6,115 from Mar-Zane for reimbursement of duplicated payments on invoices dated July 31, 2009 and August 31, 2009. The payments were duplicated due to payments made off of a monthly statement rather than a matching invoice. Baughman indicated he did go back and review 2009-2012 and did not identify any other similar duplicated payments.
Maniaci opened for old business.
Maniaci stated that he spoke with Curtis about the diesel fuel provided by Co-Alliance. The vendor has a monitoring device on his truck that tracks the amount of diesel fuel put in our tank and billed on our monthly invoice.
Maniaci stated that after the last meeting he went down and met with Todd Johnson at Rankin regarding insurance premiums and learned about the HSA and HRA options. Todd Johnson stated that in another 6 months we will find out more about the new healthcare law and how this will impact everyone and would hold off any changes until we know more about the coming law and new requirements. Fusner stated he did however receive paper work and discussed with Todd potential savings due to changes to his policy.
Maniaci asked about Zoning. Fusner stated he has been in contact with OSU extension office for information. Fusner stated he had talked with another trustee from another township and the trustee mentioned if he had to do over again he would have had the residents get a petition for zoning first before spending all the time and township money on it first.
Maniaci stated Matt Hittle completed the 2 hour safety training as required by Frank Gates Company for our workers compensation premiums and rates.
Maniaci stated the new truck is finally here.

Maniaci stated that with the first snowfall we are out on the roads and trying to stay ahead of the weather.
Maniaci stated that we need to schedule our annual back-flow testing required by the health department for 2013. Hittle stated he will speak with Professional Plumbing, Dean Burkhart about getting the inspection taken care of.
Maniaci stated the annual inventory is being worked on and will be submitted to county engineer by 2nd week of January as required.
